AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE PURCHASE
AND CONVEYANCE OF TAX FORFEITED PROPERTY
DISCUSSION: Introduction
The purpose of this agenda item is to consider the disposition of two properties
that have been forfeited to the State of Minnesota due to non-payment of property
taxes and/or special assessments.
Histo
Properties for which property taxes or special assessments or a combination
thereof have not been paid and the redemption period has expired become tax for-
feit and revert to state ownership. The state delegates its authority to dispose of
such properties to the county within which the property is located. The county de-
termines first if they have a public purpose for the property. If not, the city in which
the property is located is provided the opportunity. Properties may be received by
the city for various public purposes. The county charges certain fees to recoup
their costs.
Minnesota State Statute 282.01 addresses the classification and sale of forfeited
properties. Scott County Taxation Department notified the City on July 25 and Au-
gust 6, 2013 of two parcels (see below) that had been forfeited to the State of Min-
nesota due to non-payment of property taxes. The notification letters from the
county, aerial photographs and property information are attached as Exhibit A.

Scott County staff has requested that the City notify them if the Council is inter-
ested in having either of the two parcels withheld from the public auction sched-
uled this Fall. This will provide City staff sufficient time to further evaluate whether
a parcel should be acquired by purchase or conveyance.
The following actions may be considered by the city council with respect to each
parcel:
• Approve the parcel for sale in which case it will be sold at auction or private
sale to a private party.
• Purchase it at the appraised value in which case the City can own the par-
cel and dispose or use the parcel as it wishes. ;
• Purchase it at a reduced cost for a public purpose which includes right of
way, park, wetland, storm water or similar purpose; or
• Request a conveyance for public use as above but the City must continue
to use the property for the specified public purpose in perpetuity or give it
back to the state.
The city has elected not to become a residential landlord. This is more of a county
or CDA role. Accordingly, the staff recommends that parcel one be approved for
auction. Staff is recommending that vacant parcel #2 in Maple Glen 2"d Addition be
withheld for further consideration regarding purchase versus conveyance. This
property would be beneficial for city use for right of way purposes for Thorton Cir-
cle and for storm water drainage.
Conclusion
The City must provide a response to Scott County within 60 days of the date of the
letters received (July 25 and August 6, 2013). If the City Council fails to respond
within 60 days of the date of the letter received, the public auction sale will be
deemed to be approved. Actions taken by the City Council on August 26, 2013
are within the 60 days.
ISSUES: The City can purchase the property for any public purpose for which the City is au-
thorized to acquire property. If the property is conveyed to the City, the convey-
ance is subject to the conditions provided in law, including, but not limited to, re-
version provisions of State Statute 282.01 subd (1) ( c) and (d).
Any property acquisitions must also be considered by the Planning Commission.
If the Council determines that they would like to proceed with the acquisition of this I
parcel, staff will bring this forward to the Planning Commission at an upcoming
meeting.
FINANCIAL Exhibit B shows the charges and fees that would be required to purchase each of
IMPACT: the tax-forfeited parcels. If the City would decide to have the parcels conveyed,
staff understands that the purchase price and state assurance fee would be elimi-
nated and a minimum state deed tax applied. The other fees would still be re-
quired in addition to a State Conditional Use Deed Fee and a review by the Com-
missioner of Revenue.
ALTERNATIVES: The following alternatives are available to the City Council:
1. Adopt a Resolution Relating to Tax Forfeit Properties providing for approval of
public sale for parcel 1 and further consideration of parcel 2 for city purchase
or conveyance.
2. Table this item for a specific reason.

WHEREAS, Scott County, in accordance with MS 282.01, has notified the City of certain tax
forfeited lands within the City; and
WHEREAS, The City staff has reviewed each for public purpose; and
WHEREAS, The City must notify Scott County within 60 days of receipt of the notifications if the City
is interested in purchasing the parcels or having the parcels conveyed to the City.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The staff is directed to request Scott County to withhold parcel number 25-442-0420 Outlot A, Maple
Glen 2�d Addition, Prior Lake, MN, from public auction for further consideration by the City.
3. The staff is directed to advise Scott County that parcel number 25-186-0040, 16616 Franklin Trail SE,
Prior Lake, MN, is hereby approved for public auction.
