INTRODUCTION:
The purpose of this Agenda item is to conduct a Public Hearing
for Project 94-01 and to consider the adoption of Resolution
94-13.
BACKGROUND:
On January 3,1994, the Council approved both the Feasibility
Study for the project and Resolution 94-04 calling for a Public
Hearing on the improvement project. Resolution 94-04 had
scheduled a Public Hearing for the Prior South street
improvement project for February 7,1994. The Council wanted
to review the assessment policy prior to the Public Hearing, thus
Resolution 94-07 was adopted which scheduled the public hearing
for March 21,1994 at 7:45 p.m. in the Council Chambers.
On March 15,1994 at 7:00 p.m. in the Council Chambers, staff
will be conducting an Informational Meeting to explain the
project scope and assessments as well as received feedback from
the residents. Information received from this meeting will be
presented to Council at the Public Hearing.
The street pavements in the Prior South area have severely
deteriorated in recent years. The pavement has extensive cracking
and has had bituminous patching done in several locations.
Currently, the streets do not have curb' and gutter and several
areas do not drain properly which contributed to the street
deteriorating condition. Approximately 3300 lineal feet of street
within the Prior South subdivision would be improved by the
project.
DISCUSSION:
Staff will make a presentation on the project showing the existing
conditions, proposed improvements, assessments and project
schedule. This project is known as a street overlay or
reconstruction project in which the City upgrades the existing

bituminous pavements on city streets. This type of project was
initiated in 1985 with Project 85-11 in the Willows and Green
Heights area. Two other projects, Project 86-11 (Oakwood Hills
and Hidden Oaks) and Project 89-11 (Downtown streets) have
been completed in the City's program.
The Council should receive and consider the impact from affected
property owners of the proposed improvements. Based on the
input received at the hearing and all other relevant factors, the
Council can discuss if the project merits approval at this time.
The feasibility study presented to Council on January 3,1994 had
an estimated total project cost of $584,000.00. The Project
Assessment per ordinance for street overlay/reconstruction
projects is 60% of the project cost which is $350,520.00. The
remaining 40% of the project cost is recovered by the City's ad
valorem tax levy. The project will be assessed by the front
footage method as per ordinance and the estimated assessment
rate is $67.41 per assessable front foot. The estimated tax
increase presented at the feasibility study approval for the City's
tax levy support of the project was approximately $6.33 or 1.1 %
increase for a home with a market value of $110,000.00.
Resolution 94-13 is attached which orders the improvement and
the preparation of plans. Approval of Resolution 94-13 is in order
if the project is to proceed. The preparation of plans will need to
be done by the City's engineering consultant. The preparation of
plans cost is estimated not to exceed $45,000.00 which is
approximately 10 % of the construction cost of the project. If
Resolution 94-13 is approved, Council should authorize MSA
Consulting Engineers to prepare the plans at a cost not to exceed
$45,000.00.
ALTERNATIVES:
The alternatives are as follows:
1. Adopt Resolution 94-13 ordering the improvement and
preparation of plans for Project 94-01. Approve a motion
authorizing MSA Consulting Engineers to prepare the
plans and specifications for the improvement project.
2. Deny approval of Resolution 94-13, and abandon Project
94-01 at this time.
3. Table this item for a specific reason.
RECOMMENDATION: The recommendation is to adopt Resolution approving the
project. Action on the resolution depends on public input and
should be withheld until after the Public Hearing and comments
have been received by the property owners.
FINANCIAL IMPACT: The Cost of the project will be recovered through special
assessments and ad valorem tax levy.

ACTION REQUIRED:
The action required will be to make a motion to approve or deny
Resolution 94-13. If Resolution 94-13 is approved, a motion
authorizing MSA Consulting Engineers is required for the
preparation of plans for the improvement project.

WHEREAS:
Ten days mailed notice and two weeks published notice of the hearing was given,
and the hearing called to order on the 21 st day of March. 1994 at which all
persons desiring to be heard were given an opportunity to be heard thereon: and
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, MINNESOTA,that:
1. Such improvement is hereby ordered as proposed in the Council
Reesolution 94-07 adopted the 18th day of January, 1994.
2. The City Engineer and the city's engineering consultant, MSA
Consulting Engineers, is hereby designated as the Engineer for this
improvement He shall prepare plans and specifications for the making
of this improvement.
