OF CARDINAL RIDGE SECOND ADDITION AND DEVELOPER'S
AGREEMENT
MARCH 21, 1994
The purpose of this item is to consider approval of Resolution 94-11
approving the final plat of Cardinal Ridge Second Addition. The
developer's agreement for installation of public improvements is
being prepared by Bruce Loney and Glenn Kessel and will be
forwarded to the Council under separate cover. Good Value
Homes, represented by John Peterson, has filed for final plat and
developers agreement approval for Cardinal Ridge Second
Addition. The final plat is being filed in accordance with Sections
6-5-1 and 6-7-1 through 6-7-17 of the Subdivision Ordinance.
The principle requirements for final plat approval include a signed
developer's agreement with surety for the installation of utilities and
streets and the satisfactory completion of all preliminary plat
contingencies.
The preliminary plat of Cardinal Ridge was approved by the City
Council on June 7, 1993 subject to ten conditions outlined in
Resolutions 93-40 and 93-47. See attached Council minutes and
Resolutions for reference to the contingencies placed upon the
preliminary plat. The 147 acre single family development was
contemplated to be completed in four phases over the next three to
five years. The first phase, containing 64 lots was approved by the
Council on October 18,1993. The final plat of Cardinal Ridge
Second Addition contains 47, single family lots. Staff has reviewed
the final plat and found it to be in substantial compliance with the
approved preliminary plat.
The conditions placed upon the preliminary plat have been satisfied
or will be accounted for in the developer's agreement and
Resolution 94-11 approving the final plat. The park improvements
associated with this phase include the installation of sidewalk
adjacent to Crossandra Street, and dedication of Outlot D, for
drainage and utility easement purposes. The developer will be
required to transfer title of Outlot D to the City in a manner

acceptable to City Attorney, Glenn Kessel. Part of Outlot 0 is
intended to be combined with City property located in Brooksville
Hills Fourth Addition for a well site, park and trail purposes.
The developer's agreement will be prepared by Bruce Loney and
Glenn Kessel. The agreement will specify that the developer is
responsible for installation of all utilities, streets, park trails and all
other improvements as specified by the Subdivision Ordinance.
Engineering staff will be present at the meeting to review details of
the developer's agreement with the Council.
ALTERNATIVES:
1.
Adopt Resolution 94-11 approving the final plat of Cardinal
Ridge Second Addition, and the attached developer's
agreement.
2. Table or continue this item for specific reasons as
determined by the City Council.
RECOMMENDATION: Alternative #1.
ACTION REQUIRED: Two motions are recommended, one to approve Resolution 94-11
approving the final plat and a separate motion to approve the
developer's agreement.

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL SETIlNG FORTH CONDITIONS TO BE MET
PRIOR TO RELEASE OF THE FINAL PLAT OF CARDINAL RIDGE SECOND ADDITION.

WHEREAS, the City Council has approved the Final Plat of Cardinal Ridge Second Addition.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE,
MINNESOTA, that it should and hereby does require the following conditions to be met, prior to release of, and
recording of said plat
1. A title opinion or commitment of title insurance be submitted acceptable to the City Attorney.
2. Payment of all fees including but not limited to: trunk sewer charge, (estimate $37,290.(0), stooo water
management fee, (estimate $90,988.(0), collector street fee, (estimate $15,538.(0), and all other fees
associated with the developer's agreement See memo from Ralph Teschner dated March 8, 1994 for
details related to the fee estimates.
3. The developer's agreement, as drafted by the City Engineer, shall be signed and fully executed prior to the
release of the Final Plat. All fees shall be paid prior to release of the Final Plat.
4. Four mylar sets of the final plat with all required signatures be submitted.
5. A complete set of construction plans and specifications for all public works facilities for subdivision be
submitted in accordance with the requirements of the "Public Works Design Manual" and acceptable to the
City Engineer.
6. Utility and drainage easements along with an erosion control plan and sewer/water plan be revised
acceptable to the City Engineer. All easements including those necessary on the plat be granted, acceptable
to the City Engineer.
7. A planting plan be addressing the tree planting requirements of Section 6-7-1 of the Subdivision Ordinance,
and consistent with the approved planting plan for the preliminary plat of Cardinal Ridge be submitted,
acceptable to the Director of Planning. Specifically, all listed tree species must comply with the "Street and
Yard Tree Planting Requirements" handout. The tree planting plans shall be submitted to the same scale as
the preliminary plat to verify trees are in acceptable locations. (See attached memo from Gina Mitchell
dated March 3,1994 for details related to the tree planting plan.
8. The developer submits a copy of and agrees in writing to distribute literature to future buyers of lots which
indicate the park/traiVsidewalk improvements approved as part of the PUD.
9. The final plat and all pertinent documents must be filed with Scott County within 60 days from the date of
final plat approval. Failure to record the documents by May 20, 1994 will render the fmal plat null and
void.
10. Outlot D be given to the City for parks/open space, drainage and utility areas as specified on the
preliminary plat and in a manner acceptable to the City Attorney.
11. A sidewalk easement along the south side of Crossandra Street be submitted, acceptable to the City
Engineer.

b) Building permits shall not be issued until a contraCt has been awarded for the construction of municipal
sewer and water. Occupancy permits will not be issued until sewer, water and storm sewers are accepted by

the City Council held a hearing on the 7th day of June, 1993 to consider a
petition submitted by Sienna Corporation to approve the Schematic and
Preliminary P.U.D. Plan for Cardinal Ridge; and
WHEREAS,
The Prior Lake Planning Commission conducted a public hearing on the
20th day of May, 1993, to consider a petition submitted by Sienna
Corporation to approve the Schematic and Preliminary P.U.D. Plan for
Cardinal Ridge; and
WHEREAS
Notice of the public hearing on said motion has been duly published and
posted in accordance with the applicable Minnesota Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that it should and hereby does approve the Schematic and Preliminary P.U.D.
Plan for Cardinal Ridge subject to the following:
1. Approve the revised Schematic and Preliminary P.U.D. Plan for Cardinal Ridge dated
May 12, 1993.
2. To reduce the sideyard setback for the 46 lots which received front yard setback reduction
to be no less than five (5) feet for the garage.
3. A sidewalk shall be installed the entire length of Crossandra Street.
4. The trail connecting Oudots B and D contain a sidewalk alternative.
5. The Developer be allowed to plant the total required front yard trees of all lots in
clustered locations throughout the P.U.D. as approved by the Parks Department.
6. Reduction of lots to satisfy the maximum number of eighty (80) foot frontages in Block
8, Block 11, Block 14, Block 15 and readjustment of the flag lot proposed for Lot 13,
Block 7, but in no ev~nt shall the width be less than seventy (70) feet. The redesign
resulted in a total of , lots with a lot width of less than 80' in accordance with the
Exhibit dated 3-15-93 a, revised.

dimensions for the 46 lots, set back deviations to garages and 1ree
dusters, trail system and aJl-de-sacs. Councllmembers expressed
concern regarding stonn water and sanitary sewer easements. Rick
Packer, representing the Sienna Corporation, explained the reasoning
for tree dusterlng as opposed to spreading them throughout
subdivision. Discussion occurred on banning along Flshpolnt Road,
notification of buyers who purchase land adjoining the proposed
parkland, the overall five yard set back and the need for a master park
plan. Another topic of discussion was the proposed Island In
aJl-de-sacs and who would be responsible for future maintenance of
them, traffic on CR 44 and future plans for signalization.

CARDINAL RIDGE
Project Overview
Cardinal Ridge is a Planned Unit Development approved by the City of Prior Lake. The site
is located directly south of the Prior Lake High School on the east side of the community and
directly north of Markley Lake.
Cardinal Ridge consists of 223 single family lots on 147 acres. The site plan was developed to
accommodate the site's natural features by protecting natural wetlands, steep slopes, existing
vegetation stands and Markley Lake. These natural areas are located in outlots which will be
dedicated to the City of Prior Lake, who will own and maintain them. Besides preserving and
protecting the natural features of this site, these outlots will also function for stormwater
retention and park purposes. The largest outlot, located on the west side of Cardinal Ridge,
will be made up of wetlands and stormwater ponding on the north half and an active
neighborhood park on the south half.
A trail system is planned through a majority of the outlots, eventually leading to Markley
Lake. This trail system will be installed by the project developer and funded by the City of
Prior Lake. A sidewalk which will connect to the future trail system, will be installed the total
length of Crossandra Street by the project developer. In addition,-a sidewalk and bike trail
will be installed on Fish Point Road.
Although formal plans have not been developed by the City of Prior Lake on the outlots,
prospective homebuyers are encouraged to contact the City Parks Department for additional
information.

Based on the letter to Mr. Peterson dated February 15, 1994 from Deb
Garross, the only comments relating to parks and open space concern the sidewalk
along Crossandra Street, the trail alternative listed for connection between Outlots
B and D, and Outlot D be given to the City as parkland. All of these items are per
the Preliminary plat. Deb has addressed all of these item in the February 15th
letter.

2. The developer's agreement, as drafted by the City Engineer, shall be signed
and fully executed prior to the release of the Final Plat. All fees shall be paid
prior to release of the Final Plat.
3. A complete set of construction plans and specifications for all public works
facilities for subdivision be submitted in accordance with the requirements of
the "Public Works Design Manual" and acceptable to the City Engineer.
4. Utility and drainage easements along with an erosion control plan and
sewer/water plan be revised, acceptable to the City Engineer. All easements
including those necessary on the plat be granted, acceptable to the City
Engineer.
5. A sidewalk easement along the south side of Crossandra Street be submitted,
acceptable to the City Engineer.

Outlots D and F-K, Cardinal Ridge (PIN numbers 252990680 & 25 299 0700 thru 25 2990750) are
proposed to be replatted into Cardinal Ridge 2nd Addition. This area has received no prior assessments
for City municipal utilities.
Since utilities are available to the property site, the cost for the extension of services internally will be the
responsibility of the developer. In addition to these improvement costs, the subdivision will be subject to
the following City charges outlined below:

The application of these City charges would generate the following costs to the developer based upon a

12.43 acres @ 3000.00/acre = $37,290.00
Storm Water Management Fee:
541,598 sf @ 16.8/sf= $90,988.00
Collector Street Fee:
12.43 acres @ $1250.00/ac = $15,538.00
These charges represent an approximate cost of $4200.00 per lot for the 34 proposed lots within Cardinal
Ridge 2nd Addition. Assuming the initial net lot area of the plat does not change, the above referenced
storm water, collector street and trunk water and sewer charges would be determined and collected within
the context of a developer's agreement for the construction of utility improvements at the time of each
phase of the planned unit development.
There are no other outstanding special assessments currently certified against the property. Also, the tax
status of the property is current with no outstanding delinquencies.

FOR NEW SUBDMSIONS
The species of trees that the applicant has proposed for replacement are: Green Ash,
Linden, and Emerald Luster Maple. The Green Ash and Emerald Luster Maple are not
permitted species on file in the office of the City Planner. Also, the variety of the Linden
trees to be planted must be specified as one of the permitted varieties. (See Street and Yard
Tree Planting Requirements list of acceptable species and varieties)
The tree planting plans have not been submitted to scale. This plan has to be submitted to
scale to verify that the trees are in acceptable locations. (See Section 6-7-1:A of the
Subdivision Ordinance)
Had the types of trees been of acceptable varieties, the distribution of the trees on each
block would be adequate. (See #3, Street and Yard Tree Planting Requirements)

1. All boulevard and yard trees shall have a trunk not less than 2 1/2" in
caliper and the root shall be balled and burlapped.
2. ReqUired street trees shall be located as shown above: between four
.and ten feet fran the front property line. Front yard trees may be
located anywhere in the front yard but not less than four feet fran the
front property line. Trees may not be planted in areas which would
interfere with underground utilities (water, SeNer, gas, telephone,
electric). Consult utility canpany before planting.
On comer lots, no trees shall be permitted within the clear view
triangular area defined as follows: Beginning at the intersection of
the projected lot lines of the comer lot, thence forty feet (40')
along one lot line, thence diagonally to a point forty feet (40') fran
the point of beginning on the opposite lot line. See diagram for
clarification.

3. Not less than two nor more than three species of trees shall be planted
in any block. Not less than 20 percent nor more than SO percent of the
total trees planted in a block may be of the same species.
4. No required tree shall be planted in soil too poor to insure the growth
of such trees unless 27 cubic feet of soil is rerooved am replaced with
loam.
