RESOLUTION 94-46
RESOLUTION OF THE PRIOR LAKE CITY COUNCIL TO RECOMMEND
APPROVAL OF VARIANCES AND THE PRELIMINARY PLAT OF "KNOB HILL".

WHEREAS,
the Prior Lake Planning Commission conducted a Public Hearing on the 7th day of July, 1994,
to act on a petition submitted by Gold Nugget Development, Inc., to approve the preliminary
plat of "Knob Hill"; and
WHEREAS,
notice of the public hearing on said motion has been duly published and posted in accordance
with the applicable Minnesota Statutes; and
WHEREAS,
the City Council considered the proposed preliminary plat and variances on August 1, 1994.
NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA,
that it approves the preliminary plat of "Knob Hill" subject to the following:
VARIANCES:
1. 10' front yard setback variances from the 85' setback requirement from the centerline of Pike Lake Trail
for proposed Lots 1, 2, 3, and 4, Block 14, Knob Hill.
2. 40' lot width variance for proposed Lot 7, Block 7, Knob Hill.
3. A 410' cul-de-sac length variance for proposed Street "I" and 150' cul-de-sac length variance for
proposed Street "G", Knob Hill.
4. A variance to allow the platting of proposed Streets "0 and P" without installation of a temporary turn
around.
a. Streets "0 and P" shall not include driveways and shall be posted with "No Outlet" signs and a
barricade at the end of the streets to discourage traffic.
COMPREHENSIVE PLAN:
5. Approval of the Comprehensive Plan Land Use Map and Transportation Plan amendments by the
Metropolitan Council.
PLANNING:
6. A revised landscape plan should be submitted indicating the location of clear view triangles and the
required 4' to 10' planting location for boulevard trees and to add 1 additional tree to the following lots:

Lot 8, Block 12 (on Carriage Hills Parkway)

Lot 1, Block 13 (on Street D)
Lot 11, Block 13 (on Street E)
Lot 10, Block 14, (move one of the trees in the middle of the lot to Street C)
7. The landscape plan be revised to indicate which trees the respective property owners are
responsible to plant.
8. The developer provide alternatives to mitigate tree loss and grading of steep slope areas.
9. That all necessary permits and approvals from other local, state and federal government agencies
be obtained by the Developer which are required due to the development.
10. That the all lots meet the Subdivision Ordinance 6-6-4:(F) which states 100% of the minimum
lot size requirement within a Residential Zoning District be outside the 100 year flood elevation
of a wetland or detention pond. Lots in questions are the following:
Lots 14 & 15, Block 8
Lots 5 & 6, Block 10
Lots 10 & 11, Block 12
11. The developer provide a title opinion or other information subject to approval of the City
Attorney, indicating the purpose of the Chatonka Beach easement and persons having an interest
in the easement.
12. The plat indicate the location of the easement outside of any proposed lots to protect future
owners from an encumbrance on their property or the need to clear title.
PARKS:
13. That portion of Outlot B that surrounds the wetland immediately south of Street F be removed
from the park land dedication. The area is a wetland, is not accessible to residents, has no street
exposure, and should be incorporated into the adjacent lots.
14. The developer submit an alternate plan for Blocks 1 and 9 indicating an east/west trail
connecting the proposed park in Outlot A, via the natural/wetland area, to the east property line
of the plat. The intent of the trail would be to provide an east/west link from the development to
North Shore Oaks park via a linear park system.
15. The developer and City provide a plan showing a sidewalk and/or trail system along the entire
length of Pike Lake Trail the objective being to provide both with separation from the road
surface. The areas where topography prohibits installation of both sidewalk and bike trail shall
be identified on the plan.

16. A north/south sidewalk be located within the plat on Street N. In the event that Street P is
relocated to intersect with Street M, the sidewalk should be relocated to Street M and an
additional sidewalk installed along Street P. The north/south section of Chatonka Beach Trail
right -of-way should be retained for public trail purposes. The sidewalk and trail locations to be
subject to approval of the Parks Director.
17. A sidewalk be installed by the developer on either side of Street G running from north to south.
18. The Park access point between Lot 8, Block 11, and Lot 1, Block 12, should have an 8' trail
segment installed from Street E to the back of the lots. That trail segment should be installed
prior to the construction of houses on these two lots and at the same time that the streets are
being paved. The trail link will be the responsibility of the City to reimburse the developer.
ENGINEERING:
19. Appropriate drainage and utility easements and wetland conservation easements be provided
acceptable to the City Engineer.
20. An acceptable phasing and traffic access plan be provided acceptable to the City Engineer. A
plan that adequately addresses the maintenance of access to existing residents throughout the
construction of improvements for each phase, and how utilities will be provided for each phase.
21. An agreement being reached with the property owners east of Street "P" on the location of a
driveway access. The plan shall be presented to the adjacent property owner to the east and be
subject to approval of the City Engineer.
22. Pike Lake Trail being built to State Aid Standards within the Knob Hill plat and contingent upon
City obtaining right of way and slope easements from adjacent property owners.
23. A plan for providing utility extensions and street improvements be acceptable to the City
Engineer for Pike Lake Trail from CSAH 42 to the plat north line. The Developer will be
responsible for cost of the sewer extension and also cost associated with interim paving of Pike
Lake Trail north of the plat boundary. The Pike Lake Trail is a gravel road and this does not
provide an acceptable access.
24. A Storm water Management Plan be provided acceptable to the City Engineer and in particular,
addressing drainage flows leaving the site.
25. A wetland replacement plan be approved by the City of Prior Lake for the Wetland Conservation
Act. The earliest date in which the City can act on the replacement plan is July 13, 1994.
26. The wetland mitigation plan should provide an alternative which combines the two water quality
ponds to determine if the extent of tree loss and grading can be reduced within Block 1.

27. The developer should review the storm water quality pond in Block 5, in conjunction with the
existing pond on the east end of Chatonka Beach Trail to determine proper sizing. The review
should be subject to approval of the City Engineer.
28. The fact and findings inter-office memorandum from Jeff Evens, and Lani Leichty be resolved
acceptable to the City Engineer.
29. Grading, utility, lighting, and street plan needs to be provided acceptable to the City Engineer.
Developer agree to pave the area within Carriage Hills Parkway as part of the Developer's
Agreement.
30. The grading plan be revised to eliminate grading of the steep slope areas within Outlot A.
31. The developer provide alternatives to mitigate tree loss and grading of steep slope areas.
32. The preliminary plat be submitted to the Minnesota Valley Transit Authority and School District
719 specifically to evaluate the need for bus turn out areas. Recommendations from the Transit
Authority and School District shall be incorporated into the final plat, subject to approval of the
City Engineer.
33. That Street "N" right of way connects with Beach Street right of way. The developer has to show
the connection with a detailed survey acceptable to the City Engineer.
34. The technical evaluation panel and City staff have reviewed and recommend approval of the
wetland replacement plan for the Knob Hill subject to the following conditions:
1) A $3,000.00 letter of credit from the applicant be submitted to ensure mitigation is
successful.
2) All deed recording forms be recorded before the project commences or shortly
thereafter.
35. If there are any abandoned wells on the site, the Developer must abandon them in accordance
with State statutes.
