PROJECT 94-02, NORTHWOOD ROAD, AND CONSIDER
RESOLUTION 94-15 ORDERING IMPROVEMENTS
AND PREPARATION OF PLANS.

INTRODUCTION:
The purpose of this Agenda item is to conduct a Public Hearing for
Project 94-02 and to consider the adoption of Resolution 94-15.
BACKGROUND:
On January 3,1994, the Council approved both the Feasibility
Study for the 1994 projects, and Resolution 94-04 calling for a
Public Hearing on the Northwood Road improvement project.
Resolution 94-04 had scheduled a Public Hearing for the
Northwood Road street improvement project for February 22,
1994. The Council wanted to review the assessment policy prior to
the Public Hearing, thus Resolution 94-07 was adopted which
rescheduled the Public Heating for April 4, 1994 at 7:45 p.m. in
the Council Chambers.
The street pavement on Northwood Road from CSAH 12 to Island
View Road has severely deteriorated in recent years. The
pavement has extensive cracking and has had bituminous patching
done in several locations. The street pavement section for
Northwood Road was initially installed in 1970-71 prior to
annexation into the City of Prior Lake. This street was built as a
rural road section with ditches and culverts under driveways to
handle the drainage. The initial pavement section was
approximately 2 inches of bituminous with 6 inches of aggregate
base. Portions of the street were replaced with Project 76-1 in
1977 which installed sanitary sewer and watermain to this area.

Northwood Road is designated on the City's Municipal State Aid
System (MSA) as a local collector. The current traffic count is

DISCUSSION:
approximately 1200 vehicles per day. To be eligible for MSA
funding, the reconstruction of the road must meet MSA Standards
for street design. The street width is approximately twenty-two
feet to twenty-four feet wide and the proposed street width for
Northwood Road from CSAH 12 to Fremont Avenue is
twenty-eight feet wide from face to face of curb. With a
twenty-eight foot street width, State Aid Standards will require a
no parking resolution from the City. Staff has proposed this width
to minimize the project cost and a narrower street would help in
controlling the traffic speed on this road. Most of the residents
have long driveways from Northwood Road and thus the need to
park on the street is minimal. In order to meet State Aid
Standards, the street width would have to be widened to 32 feet to
allow parking on one side only. The proposed street width for
Northwood Road from Fremont Avenue to Island View Road is 24
feet face to face of curb which is the City's minimum street width.
The proposed project is considered a reconstruction improvement
project and the City's Ordinance 85-01 requires these types of
projects to have 60% of the project cost assessed to benefitting
properties and the remaining 40% of the project cost to be paid by
the City. In the Feasibility Study, the City would use Municipal
State Aid funds to pay for the 40% project cost.
On March 28, 1994 at 7:00 p.m. in the Council Chambers, staff
conducted an Informational Meeting to explain the project scope
and assessments as well as receiving feedback from the residents.
A total of 44 persons attended this meeting. In general, the
concerns of the residents were in regards to traffic speed, sidewalk
location, parking, drainage problems, and assessments. The
majority of property owners supported the improvements.
Staff will make a presentation on the project showing the existing
conditions, proposed improvements, assessments and proposed
project schedule.
Included in the Council agenda packet are copies of the handout
material presented at the Informational Meeting. One set is the
exhibits from MSA Consulting Engineers on the proposed project
improvements, and one set on the Local Chapter 429 Improvement
Process, proposed project schedule, and sample assessment on this
project.
The main elements with this project can be summarized in the

Right of way acquisition is necessary to properly construct
Northwood Road and to provide a sidewalk. Sidewalks have been
installed on local collectors to provide a safe route for pedestrians
on higher than normal volume roads. Sidewalks on Municipal

State Aid streets have not been assessed previously and is not
proposed to be assessed on Northwood Road. The sidewalk was
proposed to be located on the west side of Northwood Road. Also
storm sewer and sanitary sewer easements need to be obtained. It
is staff's intent to negotiate the acquisitions, if possible, during the
design phase.
The location of the sidewalk was discussed at the meeting. It was
suggested that on the south portion of the project the sidewalk be
on the east side of Northwood Road. Staff believes this may be a
good alternative and will research this in the design of the project.
The undeveloped parcel to the west of Northwood Road is
currently in Green Acres status. This parcel will have a significant
assessment due to its length along Northwood Road. As long as
the property is in Green Acres, the assessment is deferred until the
property develops. The property is currently on the market to be
developed.
State Aid Design Standards must be met in order to use MSA
funds on this project. The City normally would pay the 40% of the
project cost with ad Valorem tax levy as per ordinance. However,
since this is a MSA street, the 40% City portion is proposed to be
paid with MSA funds. The street must meet MSA Standards or
MSA funds cannot be used.
After the information meeting, one resident called to state that after
thinking about the proposed no parking design and that she has
second thoughts about this. When informed that the width would
have to be wider to meet MSA Standards and the cost would
increase, she was not sure whether or not she supported providing
parking. This will be discussed at the public hearing.
Converting a rural section to an urban section involves lowering
the roadway grade to remove the ditches and culverts and replace
the drainage system to a curb and gutter and storm sewer system.
Due to topography not all the ditches will be able to be removed.
It is proposed to install water quality ponds were practical to treat
storm water prior to discharging to the lake.
The Council should receive and consider the impact from affected
property owners of the proposed improvements. Based on the
input received at the hearing and all other relevant factors, the
Council can discuss if the project merits approval at this time.
The Feasibility Study presented to Council on January 3, 1994 had
an estimated total project cost of $919,950.00. The Project
Assessment per ordinance for street overlay/reconstruction projects
is 60% of the project cost which is $550,230.00. The remaining
40% of the project cost is normally recovered by the City's ad
valorem tax levy, however, it is proposed to use MSA funds to pay
the City's portion of the project. The project will be assessed by
the front footage method as per ordinance and the estimated
assessment rate is $54.47 per assessable front foot.

Resolution 94-15 is attached which orders the improvement and
the preparation of plans. Approval of Resolution 94-15 is in order
if the project is to proceed. The preparation of plans will need to
be done by the City's engineering consultant. The preparation of
plans cost is estimated not to exceed $52,000.00 which is
approximately 10% of the construction cost of the project. If
Resolution 94-15 is approved, Council should authorize MSA
Consulting Engineers to prepare the plans at a cost not to exceed
$52,000.00.
The alternatives are as follows:
Adopt Resolution 94-15 ordering the improvement and
preparation of plans for Project 94-02. Approve a motion
authorizing MSA Consulting Engineers to prepare the plans
and specifications for the improvement project.
Deny approval of Resolution 94-15, and abandon Project
94-02 at this time.
3. Table this item for a specific reason.
The recommendation is to adopt Resolution 94-15 approving the
project. Action on the Resolution depends on public input and
should be withheld until after the Public Hearing and comments
have been received by the property owners.
The Cost of the project will be recovered through special
assessments, trunk reserve and Municipal State Aid funds.
The action required will be to make a motion to approve or deny
Resolution 94-15. If Resolution 94-15 is approved, a motion
authorizing MSA Consulting Engineers is required for the
preparation of plans for the improvement project.

concrete curb and gutter, bituminous surfacing, walk, and appurtenant work;
WHEREAS:
Ten days mailed notice and two weeks published notice of the hearing was given,
and the hearing called to order on the 4th day of April, 1994 at which all persons
desiring to be heard were given an opportunity to be heard thereon: and
NOW, THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, MINNESOTA,that:
1. Such improvement is hereby ordered as proposed in the Council
Resolution 94-07 adopted the 18th day of January, 1994.
The City Engineer and the city's engineering consultant, MSA
Consulting Engineers, is hereby designated as the Engineer for this
improvement. He shall prepare plans and specifications for the making
of this improvement.
