The property is located at 15543 Ridgemont Avenue, north of Hope Street and south of Condons Street. Historv The Planning Commission held a public hearing to consider the registered land survey request on September 3, 2013. At that meeting, the Planning Commission recommended approval (draft minutes attached). Current Circumstances The applicant is proposing to subdivide one single family residential parcel into three single family residential parcels via a registered land survey. The following paragraphs outline the physical characteristics of the existing site, the Comprehensive Plan and zoning designations, and a description of some of the specifics of the site. PHYSICAL SITE CHARACTERISTICS: Total Site Area: The total site area consists of 1.2 acres. The current properties contain one single family home. Wetlands: No wetlands are located on the properties. Access: Access to the property is currently from Ridgemont Avenue. 2030 Comprehensive Plan: The property is Urban Low Density Residential (R- LD) on the 2030 Comprehensive Plan Land Use Map. Zoninq: The property is located within the R-1 Zoning District (Low Density Residential). The R-1 district is consistent with the proposed R-LD designation. This district permits a maximum density of 4.0 units per acre. Shoreland: The properties are located within the Shoreland District of Prior Lake and are subject to the City's Shoreland Ordinance. PROPOSED PLAN Lots: The proposed registered land survey consists of 3 lots for single family dwellings. Tract A is 17,512 square feet and contains the existing house, Tract B is 15,922 square feet, and Tract C is 18,821 square feet. The minimum required Phone 952.447.9800 / Fax 952.447.4245 / www.cityofpriorlake.com lot width for a corner lot is 14,400 square feet and 12,000 square feet for the other lots. Streets: The proposed lots have frontage on existing Ridgemont Avenue and Condons Street. No new streets are proposed. Sanitarv Sewer/Water Utilities: Lateral sanitary sewer and water utilities are in place for all of the residential properties. Conclusion All proposed single family lots within the registered land survey will meet the City lot area and width requirements for the R-1 Zoning District. Separate utility services are in place for the three proposed properties. The applicants will be required to pay a Park Dedication Fee for each of the newly created residential properties (Tract B and Tract C) prior to the release of the registered land survey for recording purposes. ISSUES: The proposed registered land survey will comply with all relevant ordinance provisions and City standards, provided all the conditions of approval are met. Therefore, city staff and the Planning Commission recommend approval of registered land survey subject to the following conditions: 1. The registered land survey shall be recorded at Scott County within 60 days of approval by the City Council. Failure to record the documents by November 22, 2013 will render the registered land survey null and void. 2. The applicant shall provide proof of installation of all subdivision monumentation within one (1) year from the date of recording the registered land survey, or prior to issuance of a building permit, whichever occurs first. 3. The applicant shall obtain any applicable required permits from all applicable governmental agencies. 4. The applicant shall pay a Park Dedication Fee for each of the newly created residential properties (Tract B and Tract C) prior to the release of the registered land survey for recording purposes. 5. The applicant shall place elevations on the survey for future drainage considerations. FINANCIAL IMPACT: There is no budget impact as a result of this action. ALTERNATIVES: 1. Adopt a resolution approving the Registered Land Survey, subject to the listed conditions, finding that it is consistent with the intent and purpose of the Zoning and Subdivision Ordinances and the Comprehensive Plan. 2. Deny the Registered Land Survey request on the basis that it is inconsistent with the purpose and intent of the Zoning and Subdivision Ordinances and/or the Comprehensive Plan. In this case, the Council should direct staff to prepare a resolution with findings of fact to support the denial of the request. 3. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Call to Order: Chairman Phelan called the September 3, 2013 Planning Commission meeting to order at 6:07 p.m. Those present were Commissioners Jeff Phelan, Tom Roszak, Adam Blahnik and Perri Hite, Planner Jeff Matzke, Community & Economic Development Director Dan Rogness and Community Development Specialist Casey McCabe. 2. Staff recommended approval of the Registered Land Survey request as the pro��s����lots meet the City's standards of approval. Commissioner Comments/Questions: Hite asked if Tract B would be required to have its driveway connect to Ridgemont Avenue and if Tract C would be required to have its driveway connect to Condons Street. Planner Matzke responded Tract B is a corner lot and they will have the option to connect to Ridgemont Avenue or Condons Street. Tract C would connect to Condons Street. MOTION BY PHELAN, SECONDED BY BLAHNIK TO OPEN THE PUBLIC HEARING AT 6:14 P.M. VOTE: Ayes by Phelan, Hite, Blahnik and Roszak. The motioned carried. Public Comment Scott Andrus, 15520 Mitchell Circle SE is the owner of property directly east of Tract C. Mr. Andrus commented on an existing drainage issue and asked if there was a plan to address drainage to prevent water from draining onto his property. Mr. Andrus also stated that the Condon Street lake homes have limited driveway parking which results in many vehicles being parked on the street. Mr. Andrews asked the Planning Commission to consider the on-street parking demand created by additional driveways on Condons Street as they review future development plans along Condons Street. MOTION BY PHELAN, SECONDED BY ROSZAK TO CLOSE THE PUBLIC HEARING AT 6:17 P.M. VOTE: Ayes by Phelan, Hite, Blahnik and Roszak. The motioned carried. Commissioner Comments/Questions: Blahnik will be supporting the subdivision indicating that at this time the applicant is only subdividing the property. Potential drainage and parking issues will be addressed if and when the applicant proposes to develop the property. Roszak will be supporting the request. The lots conform to the requirements far a residential city lot. Mr. Roszak's support will be subject to the three conditions outlined in the staff report. Hite will be supporting the request subject to conditions stated by City staff regarding recordation at Scott County, the applicant paying the park dedication fee and the applicant placing elevations on the survey for future drainage considerations. Phelan will be supporting the request. The applicant will place elevations on the survey for future drainage consideration. At this point we are subdividing the property, when the City receives an application to build on this property the site drainage will be considered. The application is consistent with the 2030 Comprehensive Plan and it fits within all of the city's current zoning ordinances. MOTION BY PHELAN, SECONDED BY HITE TO RECOMMEND APPROVAL OF THE REGISTERED LAND SURVEY REQUEST. VOTE: Ayes by Phelan, Hite, Blahnik and Roszak. The motion carried.
