FEASIBILITY REPORT FOR 1995 CAPITAL IMPROVEMENT
PROGRAM

INTRODUCTION:
This Agenda item is for the City Council to authorize a Feasibility
Report for the 1995 Capital Improvement projects by adopting
Resolution 94-43. Funding of these projects will be primarily
through 429 Assessment Bonds. In order to fund projects through
429 bonds, all projects to be funded must be listed throughout the
entire public improvement process starting with the Feasibility
Reports. Projects can be deleted but not added in the process.
This Agenda item also recommends that MSA, Consulting
Engineers, Inc. prepm'e the Feasibility Report.
BACKGROUND:
This Agenda item was discussed at the July 18, 1994 Council
Meeting in which the Council adopted the 1995 Capital
Improvement Program with modifications. Those modifications
were to transfer the Lake Front Park Paving project to 1996 and
move the Memorial Park restroom renovation to 1995.
Staff has included the 1995 Capital Improvement Program (CIP)
for Council adoption. The 1995 CIP projects being included in
Resolution 94-43 am as follows:

Most of the projects are funded through Chapter 429 Assessment
Bonds. Chapter 429 Assessment Bonds can be leveraged to fund
other similar projects as long as twenty percent (20%) of the bond
issue is assessed. The primary projects proposed to be assessed are:

Any project which the City ultimately funds through the 429
Assessment Bond must be incorporated into the Preparation of
Feasibility Report on 1995 Improvement Projects.
Because of the 429 process, the City can eliminate projects, but
cannot add projects to those listed in the aforementioned report
except by amending the feasibility report.
To proceed with the feasibility report, Staff has requested and
received a cost estimate from MSA Consulting Engineers, Inc. on
preparing the feasibility report for the 1995 CIP projects:

The total cost to prepare the Feasibility Report for the five (5)
projects mentioned previously is estimated to be $32,340.00 and
includes surveying. The total estimated cost of the five (5) projects
is $1,905,000.00. It is the City's responsibility to pay for soil
borings which are necessary for the report. The estimated cost for
the soil boring work is $7,500.00. Feasibility report preparation
DISCUSSION:
this Agenda Report and Resolution 94-43.
Staff is requesting to proceed with the 1995 City projects in order
for those projects to be completed in a timely fashion. It is Staff's
intent to present the Feasibility Report to Council later this year.
Due to the amount of public and private projects proceeding at this
time, Staff will need to utilize a consultant to prepare the vast
majority of the Feasibility Report.
Funding of the Feasibility Report work by the City's consultant
will be from the City's Construction Fund.
The Construction Fund will be reimbursed if the projects are
approved and bonds issued. Staff feels sufficient funds exist in the
Construction Fund to cover this expenditure.
In order to construct the programmed CIP projects in 1995, Staff
believes the 429 Process with the preparation of the Feasibility
Report should start now. Resolution 94-43 has been prepared for
authorizing the Feasibility Report on the 1995 improvement
projects.
Resolution 94-43 contains all potential projects for the 1995
construction year which are dependent on 429 bond financing.

The alternatives are as follows:
Approve Resolution No. 94-43 authorizing Staff to prepare
a report on 1995 Improvement Projects and authorize
MSA, Consulting Engineers, Inc. to prepare the Feasibility
Report.
2. Table this item for a specific reason.
3. Deny Resolution No. 94-43.
Recommendation is for Council to approve Resolution 94-43 to
allow Staff to begin the process for implementing the 1995 CIP
projects.
Preparation of the Report will be done by the City's Engineers
consultant and cost will be paid from the City's Construction Fund.

Improvement Projects. Motion to authorize MSA Consulting

and to assess the benefitted property for all or a portion of the cost of the improvement, pursuant
to Minnesota Statutes, Chapter 429.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that the proposed improvements be referred to the City Engineer for study and
that he is instructed to report to the Council with all convenient speed advising the Council in a
preliminary way as to whether the proposed improvements are feasible and as to whether they
should best be made as proposed or in connection with other improvements, and the estimated
costs for the improvements as recommended.
