APPLICATION FOR KNOB HILL.

The purpose of this item is to consider an application for minor
Comprehensive Plan Amendment, Rezoning and Preliminary Plat for
Gold Nugget Development Inc. The specific requests are outlined in
detail on the attached DRC Report dated June 16, 1994. The actions
requested are as follows:
Adopt Resolution 94-44 amending the Year 2000
Comprehensive Plan Land Use Map to change approximately 40
acres of Medium Density to Low Density Land Use.
Adopt Resolution 94-45 amending the Year 2000
Comprehensive Plan Transportation Plan Map to designate Pike
Lake Trail, south of County Road 42 as a Collector Street.

Approve Ordinance 94-11 rezoning approximately 30 acres of
C-1, Conservation District to R-l, Suburban Residential.
Adopt Resolution 94-46 approving the preliminary plat and
variances for the subdivision of "Knob Hill."
The Planning Commission held the public hearings on the
aforementioned applications on June 16 and July 7, 1994. The public
hearings were attended by approximately thirteen residents, Pat Lynch of
the DNR and the applicant. A number of items related to the preliminary
plat were discussed however, there did not appear to be any objection
related to the proposed Comprehensive Plan Amendments nor Rezoning
petition.
The Planning Commission recommended approval of the Comprehensive
Plan Amendments, Rezoning, Preliminary Plat and variances as per
attached Resolutions 94-02PC, 94-03PC, 94-04PC, and Ordinance 94-11.
There are 33 items recommended as conditions for preliminary plat
approval. The developer agreed to incorporate a majority of the items
into the plat design at the Planning Commission public hearing. Attached
find a letter from Wayne Tauer addressing how the plat will conform to the
conditions listed.

ISSUES:
Items 1 - 4 are variances requested for the plat which were approved by
the Planning Commission. The rationale for granting the variances was
that they are a result of road design recommendations of the City of Prior
Lake and not caused by the applicant. One variance requested is a 40'
lot width variance for proposed Lot 7, Block 7. The lot is extremely large
consisting of 39,925 square feet and of irregular shape. Pat Lynch of the
DNR had no objection to the width variance at the front setback line
because of the extraordinary large lot area proposed.
Item 5 is a condition specifying that approval of the preliminary plat
should be subject to approval of the requested minor Comprehensive
Plan amendments.
Items 6 and 7 will be met via a revised landscape plan which will be
required at the time of final plat.
Item 8 has been addressed by the developer who has proposed to revise
the grading and storm water plans to mitigate grading of steep slopes and
tree loss.
Items 9 and 10 will be met prior to final plat approval.
Item 11 will be required prior to final plat.
Item 12 has been met. The development plan indicates that the existing
Chatonka Beach easement will remain outside of all proposed lots.
Items 13 through 18 are Park considerations where the developer has
agreed to provide trail, sidewalk and park land as requested by Park
Director, Bill Mangan.
Items 19 through 33 are conditions required by the Engineering
Department. The developer has agreed to work with the City Engineer to
provide the plan changes, easements and details requested.
Item 34 was added after the Planning Commission meeting. This item
relates to the Wetland Technical Evaluation Panel and Staff
recommendation to approve the wetland replacement plan for the plat of
Knob Hill subject to submittal of a letter of credit and filing of the
appropriate deed documents with Scott County.
The major issues raised by residents pertain to the preliminary plat
grading plan, street access and the existing Chatonka Beach easement.
The developer has proposed to change the grading plan in the areas with
steep slopes adjacent to Outlot A and within Block I to lessen the impact
to wetlands, mitigate tree loss and reduce the extent of grading.
The developer is willing to work with John Andren to construct Street "P"
in a location desired in order to provide current and future access to the
adjacent parcel. The ultimate location will be subject to approval of the
City Engineer. The existing Chatonka Beach easement is proposed to be
retained in its current location. The plat indicates that the easement is
located outside of all proposed lots therefore, there should be no
encumbrance on a future property owner to clear title. In addition, City
Attorney Glenn Kessel has requested that a title opinion be provided by
the applicant indicating the purpose and persons having an interest in the
easement. The title opinion is not typically required until final plat.

will provide the City with the necessary information to resolve potential
issues related to the easement. The City Attorney feels comfortable
approving the preliminary plat subject to submittal of a title opinion for the
Chatonka Beach easement.
Approve Resolutions 94-44, and 94-45 amending the Year 2000
Comprehensive Land Use and Transportation Plans, subject to
approval of the Metropolitan Council. Approve Ordinance 94-11
rezoning 30 acres of C-1, Conservation District to R-l, Urban
Residential, subject to Metropolitan Council approval of the
Comprehensive Plan Land Use Plan amendment. Approve
Resolution 94-46 approving the Preliminary Plat of Knob Hill.
Continue one or more of the applications for specific reasons or
information requested by the City Council.
Deny the applications based upon specific findings of fact.
The recommendation from the Planning Commission is to approve the
Comprehensive Plan amendments, Rezoning and Preliminary Plat as per
attached Resolutions 94-44, 94-45, 94-46 and Ordinance 94-11.

The followi~q is a narrative responding to the conditions of approval of the
July 7. 199,1 Planning Commission approval of Knob Hill Preliminary Plat. If
this narrat:[ve does not specifically answer the questions raised, it provides
direction f,)r locating the answers required in previously prepared and presented
documents.

It has been suggested by the City Engineer that some capacity exist in a
pond p~-eviously constructed on the Andren property to the east. If this

PLANNING:
A revised landscape plan should be submitted indicating the location of clear view triangles and the

The landscape plan be revised to indicate which trees the respective property owners are responsible to

The developer provide alternatives to mitigate tree loss and grading of steep slope areas.
That all necessary permits and approvals from other local, state and federal government agencies be
obtained by the Developer which are required due to the development.
That the all lots meet the Subdivision Ordinance 6-6-4:(F) which states 100% of the minimum lot size
requirement within a Residential Zoning District be outside the 100 year flood elevation of a wetland or
detention pond. Lots in questions are the following:

The developer provide a title opinion or other information subject to approval of the City Attorney,
indicating the purpose of the Chatonka Beach easement and persons having an interest in the easement.
The plat indicate the location of the easement outside of any proposed lots to protect future owners from
an encumbrance on their property or the need to clear title.
PARKS:
13. That portion of Outlot B that surrounds the wetland immediately south of Street F be removed from the
park land dedication. The area is a wetland, is not accessible to residents, has no street exposure, and
should be incorporated into the adjacent lots.
14. The developer submit an alternate plan for Blocks I and 9 indicating an east/west trail connecting the
proposed park in Outlot A, via the natural/wetland area, to the east property line of the plat. The intent of
the trail would be to provide an east/west link from the development to North Shore Oaks park via a
linear park system.
15. The developer and City provide a plan showing a sidewalk and/or trail system along the entire length of
Pike Lake Trail the objective being to provide both with separation from the road surface. The areas
where topography prohibits installation of both sidewalk and bike trail shall be identified on the plan.
16. A north/south sidewalk be located within the plat on Street N. In the event that Street P is relocated to
intersect with Street M, the sidewalk should be relocated to Street M and an additional sidewalk installed
along Street P. The north/south section of Chatonka Beach Trail right-of-way should be retained for
public trail purposes. The sidewalk and trail locations to be subject to approval of the Parks Director.
17. A sidewalk be installed by the developer on either side of Street G running from north to south.
18. The Park access point between Lot 8, Block 11, and Lot 1, Block 12, should have an 8' trail segment
installed from Street E to the back of the lots. That trail segment should be installed prior to the
construction of houses on these two lots and at the same time that the streets are being paved. The trail
link will be the responsibility of the City to reimburse the developer.
ENGINEERING:

Appropriate drainage and utility easements and wetland conservation easements be provided acceptable
to the City Engineer.

An acceptable phasing and traffic access plan be provided acceptable to the City Engineer. A plan that
adequately addresses the maintenance of access to existing residents throughout the construction of
improvements for each phase, and how utilities will be provided for each phase.

An agreement being reached with the property owners east of Street "P" on the location of a driveway
access. The plan shall be presented to the adjacent property owner to the east and be subject to approval
of the City Engineer.

Pike Lake Trail being built to State Aid Standards within the Knob Hill plat and contingent upon City
obtaining right of way and slope easements from adjacent property owners.
A plan for providing utility extensions and street improvements be acceptable to the City Engineer for
Pike Lake Trail from CSAH 42 to the plat north line. Pike Lake Trail is a gravel road and this does not
provide an acceptable access.
A Stormwater Management Plan be provided acceptable to the City Engineer and in particular, addressing
drainage flows leaving the site.
A wetland replacement plan be approved by the City of Prior Lake for the Wetland Conservation Act.
The earliest date in which the City can act on the replacement plan is July 13, 1994.

The wetland mitigation plan should provide an alternative which combines the two water quality ponds to
determine if the extent of tree loss and grading can be reduced within Block 1.

The developer should review the storm water quality pond in Block 5, in conjunction with the existing
pond on the east end of Chatonka Beach Trail to determine proper sizing. The review should be subject
to approval of the City Engineer.
The fact and findings inter-office memorandum from Jeff Evens, and Lani Leichty be resolved acceptable
to the City Engineer.
Grading, utility, lighting, and street plan needs to be provided acceptable to the City Engineer.
The grading plan be revised to eliminate grading of the steep slope areas within Outlot A.
The developer provide alternatives to mitigate tree loss and grading of steep slope areas.
The preliminary plat be submitted to the Minnesota Valley Transit Authority and School District 719
specifically to evaluate the need for bus tum out areas. Recommendations from the Transit Authority and
School District shall be incorporated into the final plat, subject to approval of the City Engineer.
That Street "N" right of way connects with Beach Street right of way. The developer has to show the
connection with a detailed survey acceptable to the City Engineer.
The technical evaluation panel and City staff have reviewed and recommend approval of the wetland
replacement plan for the Knob Hill subject to the following conditions:

A $3,000.00 letter of credit from the applicant be submitted to ensure mitigation is successful.
All deed recording forms be recorded before the project commences or shortly thereafter.

The applicant requests the City Council to consider the following:
Preliminary Plat approval to subdivide the subject site into 173 single
family lots.
Rezone approximately 30 acres of C-1, Conservation District zoned land
to R-1, Suburban Residential.
Amendments to the Prior Lake Year 2000 Comprehensive Plan,
including an amendment to the Transportation Plan to include Pike Lake
Trail as a collector street, and an amendment to the Land Use Plan to
change approximately 45 acres of land designated as Medium Density
Residential to Low Density Residential land use.
