EVENS, ENGINEERING TECHNICIAN IV CONSIDER APPROVAL OF RESOLUTION 94-33, AWARDING BID FOR PROJECT 94-13 (SALE OF EXCESS TOPSOIL FROM THE WATERFRONT PASSAGE BUSINESS PARK) JUNE 20,1994 INTRODUCTION: The purpose of this Agenda item is to accept or reject the bids received and to enter into a contract for the removal of the topsoil per Project 94-13. Resolution 94-33 has been prepared for Council action on the Award of Bid. BACKGROUND: On May 2, 1994, the City Council approved Resolution 94-20 ordering advertisement for bids for the sale of the topsoil in accordance with Section 1-12-1-4 (B)2 of the City Code. A bid opening was held on June 13, 1994, at 10:00 A. M. Prior Lake City Hall. DISCUSSION: The City desires to remove the excess topsoil from the site this year due to the sale of the lot for Becker Arena Ice Products, and potential future lot sales. In order to do so. staff must folio"" Ordinance 1-12-1-4 (B)2 which states the City Manager may authorize sealed bids or the receipt of at least two (2) quotations without advertising for bids if the estimated value of the item is between $500.00 and $2,000.00. The estimated value of the two stockpiles that need to be removed this year is approximately $1,500.00. It will be the intention of staff to solicit at least two quotes for the sale of this item. Previously staff estimated that the value of this item would be over $2,000.00, thus the competitive bid route was selected. Due to the November 7, 1994 time constraint and the time of year. several bidders selected not to submit a bid thus, the low bid amounts were received. Staff received two (2) bids prior to the June 13, 1994 10:00 A.M. dead line. A bid from Tim's Lawn & Landscaping was received at 9:52 A.M.. At approximately 9:59 A.M. Tim Guimond from Tim's Lawn and Landscaping acknowledged that he had made a mistake in his bid and was contemplating withdrawing his bid. Per staffs conversations with Mr. Guimond, he indicated that his intentions were to submit a Bid for $0.15 per cubic yard not $1.05 per cubic yard. This in turn would mean his bid amount should have been $1,440.00 not $10,080.00. Attached to this Agenda Report is a copy of a letter from Tim Guimond stating that his bid was is error, and he cannot honor his bid. ALTERNATIVES: The following is a list of the alternatives: I. Approve Resolution 94-33 awarding the contract for Project 94-13 to Tim's Lawn and Landscaping noting the letter submitted by Tim Guimond that he will be unable to enter into a contract with the City at this price which in turn he would forfeit his check for 5% of the bid amount. 2. Do not approve Resolution 94-33 for specific reasons. 3. Reject all bids and direct staff to obtain a minimum of two (2) quotes for the sale of the topsoil. RECOMMENDATION: Staffs recommendation is Alternative No.3. FINANCIAL IMPACT: The revenues generated from the sale of topsoil this will be credited back to the Waterfront Passage Business Park Construction Fund to help offset the construction cost of the project. ACTION REQUIRED: jeag7d.ENG I IT RESOLUTION 94-33 RESOLUTION REJECTING BID FOR PROJECT NO. 94-13, SALE OF EXCESS TOPSOIL FROM THE WATERFRONT PASSAGE BUSINESS PARK MOTION BY: SECONDED BY: WHEREAS, pursuant to an advertisement for bids for the Sale of Excess Topsoil from the Waterfront Passage Business Park located in Prior Lake, Minnesota; bids were received, opened, and tabulated according to the law. and the following bids were received complying with the advertisement: CONTRACTOR BID 1. Tim's Lawn and Landscaping $10.080.00 2. Ryan Contracting. Inc. $ 100.00 AND WHEREAS, it appears that Tim's Lawn and Landscaping of Shakopee. Minnesota is the highest responsible bidder. AND WHEREAS, Tim Guimond of Tim's Lawn and Landscaping has confinned in writing that his bid was in error and cannot be honored. AND WHEREAS, Ryan Contracting Inc.'s bid is too far below an acceptable amount. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that; 1. All bids are hereby rejected. 2. The City Manager is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids. 3.
