INTRODUCTION:
The purpose of this item is to consider the approval of the plans and
specifications for Project #94-01, Prior South street improvements. If
plans are approved by the Council. then adoption of Resolution 94-21 is
in order to authorize the Advertisement for Bids on the project.
BACKGROUND:
On March 21, 1994, the Council adopted Resolution #94:.13 ordering the
preparation of plans and specifications for Project #94-01, street
improvement project on Brunswick Avenue, Erin Circle, Dublin Road
and Lyons Avenue in the Prior South area. At the March 21, 1994
meeting, the Council authorized MSA Consulting Engineers to prepare
the plans and specifications. The plans have been prepared for Council
approval. If Council approves the plans, the next step would be to
authorize an advertisement for bids by approving Resolution #94-21.
City staff and MSA Consulting Engineers will be conducting an
informational meeting on the plans with the property owners on April 28,
1994 at 7:00 P.M. Results from this meeting will be presented at the
May 2, 1994 Council meeting.
This project is known as a street overlay or reconstruction project in
which existing bituminous street pavements will be improved with new
bituminous surfacing and concrete curb and gutter.
The Feasibility Study Costs Estimates for Project #94-01 was estimated
to be $584,200.00. Per City ordinance on street overlay/reconstruction
projects. 60% of the project cost is to be assessed to the benefitting
properties with the City paying for the remaining 40% of the project cost.
This project will reconstruct the following streets:
1. Brunswick Avenue from Franklin Trail to Lyons Avenue.
2. Dublin Road from Brunswick Avenue to Lyons Avenue.
3. Erin Circle from Dublin Road to end tenninus.
4. Lyons Avenue from Franklin Trail to Brunswick Avenue.
DISCUSSION:
The project will reconstruct the street pavement section by correcting the
unstable soil areas, adding additional drain tile, repairing storm sewers,
installing concrete curb and gutter, bituminous pavement and restoring
the yards and driveways.

During the public hearing, drainage problems were discussed on the
individual lots and the Council directed staff to investigate drainage
problems within the project area. A questionnaire was sent to the
residents and from the responses at the public hearing and
questionnaires, five areas were investigated. To correct the drainage
problems, additional grading and/or drain tile has been designed within
the drainage and utility easement area to facilitate drainage. To correct
individual lot areas, it is recommended that the corrective work be done
by the property owners.
The Engineers Estimate to construct the improvements is estimated to be
$423,076.00 which includes 5% contingency and with 30% indirect costs
to cover engineering, bonding, administrative and legal costs, the total
project cost to rebuild the streets is $550,000.00. Included with these
plans is an alternate bid item to dredge a sediment delta on Blind Lake
Trail. This work item would be paid for out of the City's Stonn Water
Utility Fund and is estimated to be $15,000.00 including indirect costs.
The total project cost would than be $565,000.00.
On the Council Agenda is the consideration of establishing an
assessment hearing and declaring a cost to be assessed. The assessment
hearing is proposed to be held on June 6, 1994. The bid opening for this
project, if Council approves the plans, would be scheduled for June 2,
1994 at 10:15 A.M. The bid opening results will be presented to Council
at the assessment hearing. If favorable bids are received, the Council can
lower the assessment rate accordingly. If bids are higher than the
Engineer's Estimate, the Council can elect not to do the project or absorb
the additional amount to the Ad Valorem Tax Levy.
RECOMMENDATION:
Approval of Resolution #94-21 would be appropriate subject to Council
direction.
ALTERNATIVES:
The alternatives are as follows:
1. Approve the Plans and Specifications and approve Resolution
#94-21 ordering an Advertisement for Bid with a bid opening for
June 2, 1994 at 10:15 A.M.
2. Table this item for a specific reason.
3. Deny the project at this time.
FINANCIAL IMPACT:
The cost of Project #94-01 will be recovered through Special
Assessments, Ad Valorem Tax Levy and Storm Water Utility Fund.

WHEREAS,
pursuant to Resolution 94-13 which the City Council approved on March
21, 1994, the City Engineer and the City's Engineering Consultant, MSA
Consulting Engineers, has prepared plans and specifications for the street
overlay/reconstruction improvement project on Brunswick Avenue, Erin
Circle, Dublin Road, and Lyons Avenue by the construction of grading,
storm sewer, aggregate base, concrete curb and gutter, bituminous
surfacing, and appurtenant work;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. Such plans and specifications, a copy of which is attached hereto and
made a part of hereof, are hereby approved.
2. The City Manager shall prepare and cause to be inserted in the official
paper and in the Construction Bulletin an advertisement for bids upon the
making of such improvement under such approved plans and
specifications. The advertisement shall be published not less than 21 days
prior to bid opening, shall specify the work to be done, shall state that bids
will be opened, and that all bids will be received by the City until 10:15
A.M. on June 2, 1994, at which time they will be publicly opened in the
Council Chambers of City Hall by the City Engineer.
No bids will be considered unless sealed and filed with the City Manager
and accompanied by a cash deposit, cashier's check, bid bond, or certified
check payable to the City of Prior Lake for five (5) percent of the amount
of such bid.
