CONSIDER REFUND OF APPLICATION FEES FOR WENSMANN
REALTY.

The purpose of this item is to consider the refund of subdivision, rezoning
and minor comprehensive plan amendment fees for Wensmann Realty.
The specific fees are as follows:
1. $206.00 rezoning application fee.
2. $200.00 subdivision application fee.
3. $500.00 comprehensive plan application fee.
Total $906.00

The applicant submitted the plat of "Fremont Acres" to the City in April,
1994. The proposal was a six lot, single family subdivision on
approximately 2 acres of land located southwest of the intersection of
County Road 82 and Fremont Avenue. Following the staff DRC review
meeting, the Developer withdrew the applications. Staff contacted the
Developer and suggested that a letter be submitted to the City Council
requesting refund of unused portions of the application fees.
The Development Review Committee held a meeting with the Developer
on April 21, 1994. The DRC reviewed preliminary comments related to
the various applications and results of the Technical Evaluation Panel
review of the proposed wetland mitigation plan. Following the meeting,
Developer, Herb Wensmann, instructed staff that he wished to withdraw
the applications at this time. Mr. Wensmann owns the 2 acre site and has
a contract for the adjacent approximately 40 acres to the west. However,
the 40 acres is not located within the Urban Service Area and therefore
cannot be developed at this time. It was the consensus of the DRC and
the Developer that it would be best to wait to develop the 2 acre site until
the entire property is brought within the Urban Service Area.
Staff conducted a preliminary review of the applications only. No
notifications or staff reports to the Planning Commission and/or City
Council were prepared or mailed out to the publiC nor government
jurisdictions. The applications have been withdrawn by the applicant and
no further work will be conducted.

Approve the $906.00 refund of application fees as requested.
Approve partial refund of the application fees.

3. Deny the request for refund of application fees.
Alternative #2. Staff did review the preliminary plat and worked with the
TEP to review the wetland mitigation plan. The recommendation is to
refund $706.00 which is the amount associated with the comprehensive
plan amendment and rezoning application. The $200.00 subdivision
application fee would not be refunded due to the staff time involved with
review of the preliminary plat and wetland mitigation plans.
A motion as part of the consent agenda to approve refund of $706.00
dollars to Wensmann Ity. /1
