OF THE SECOND ADDITION TO RASPBERRY RIDGE AND
DEVELOPER'S AGREEMENT

The purpose of this item is to consider approval of Resolution 94-24
approving the final plat of The Second Addition to Raspberry Ridge.
The developer's agreement for installation of public improvements
is being prepared by Bruce Loney and Glenn Kessel and will be
attached to Council's weekly update packet. Bob Walsh, of Walsh
Development, has filed for final plat and developer's agreement
approval for The Second Addition to Raspberry Ridge. The final
plat is being filed in accordance with Sections 6-5-1 and 6-7-1
through 6-7-17 of the Subdivision Ordinance.
The principle requirements for final plat approval include a signed
developer's agreement with surety for the installation of utilities and
streets and the satisfactory completion of all preliminary plat
contingencies.
The preliminary plat of Raspberry Ridge was approved by the City
Council on May 15, 1986 for 91 single family lots. The 62 acre,
single family development was contemplated to be completed in
four phases. The first phase, Raspberry Ridge, containing 12 lots
was approved by the Council on May 4, 1987. The second phase,
the First Addition to Raspberry Ridge, containing 26 lots, was
approved by the Council on September 21, 1987. The third phase,
the final plat of The Second Addition to Raspberry Ridge contains
27, single family lots. The total number of lots platted within the
development to date is 65 out of 91 lots, or approximately 71 % of
the entire development.
Staff has reviewed the final plat and found it to be in substantial
compliance with the approved preliminary plat. The conditions
placed upon the preliminary plat have been satisfied or will be
accounted for in the developer's agreement and Resolution 94-24
approving the final plat. There are no park improvements
associated with this phase.

The developer's agreement is being prepared by Bruce Loney and
Glenn Kessel and specifies that the developer is responsible for
installation of all utilities, streets, and other improvements as
specified by the Subdivision Ordinance. Engineering staff will be
present at the meeting to review details of the developer's
agreement with the Council.
ALTERNATIVES:
1.
Adopt Resolution 94-24 approving the final plat of The
Second Addition to Raspberry Ridge and the attached
developer's agreement.
2. Table or continue this item for specific reasons as
determined by the City Council.

RESOLUTION 94-24
RESOLUTION OF THE PRIOR LAKE CITY COUNCIL SETTING FORTH CONDmONS TO BE MET
PRIOR TO RELEASE OF THE FINAL PLAT OF THE SECOND ADDmON TO RASPBERRY RIDGE.

WHEREAS. the City Council has approved the Final Plat of the Second Addition to Raspberry Ridge.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE,
MINNESOTA, that it should and hereby does require the following conditions to be met, prior to release of, and
recording of said plat:
1. A title opinion or commitment of title insurance be submitted acceptable to the City Attorney.
2. Payment of all fees including but not limited to: final plat fee of $ 135.00 dollars; and all other fees
associated with the developers agreement. See attached memo from Ralph Teschner dated March 24, 1994
for estimated fees.
3. The developer's agreement, as drafted by the City Engineer, shall be signed and fully executed prior to the
release of the final plat. All fees shall be paid prior to release of the final plat.
4. Four mylar sets of the final plat with all required signatures be submitted.
5. A complete set of construction plans and specifications for all public works facilities for subdivision be
submitted in accordance with the requirements of the "Public Works Design Manual."
6. Utility and drainage easements along with an erosion control plan and sewer/water plan be revised
acceptable to the City Engineer. All easements including those necessary on the plat be granted, acceptable
to the City Engineer.
7. A planting plan be submitted in accordance with Section 6-7-1 of the Subdivision Ordinance, and
consistent with the approved planting plan for the preliminary plat. See attached memo from Gina Mitchell
dated September 28, 1993 for detail changes required on the planting plan.
8. The final plat and all pertinent documents must be filed with Scott County within 60 days from the date of
final plat approval. Failure to record the documents by July 16, 1994, will render the final plat null and
void.

a) Payment of park support fees in accordance with City Policy at the time of building permit.
b) Building permits shall not be issued until a contract has been awarded for the construction of municipal
sewer and water. Occupancy permits will not be issued until sewer, water and storm sewers are accepted by
the City Engineer and the base course for this road is installed.
c) No building permits shall be issued until the Final Plat is filed and recorded with Scott County with the
exception of one permit which may be issued to the underlying legal description for the entire parcel.

d) The "City Copy" hardshell, containing all required signatures be returned to the Prior Lake Planning Office
prior to issuance of any building permits for the plat.
e) Homes built upon lots within the subdivision will be subject to the 30% impervious surface coverage ratio
of the Zoning Ordinance, if located within a S-D, Shoreland District.
f) All new construction will be subject to the driveway standards for slope, setback and hard surface, as per
Prior Lake Zoning Ordinance 83-6.

Raspberry Ridge 2nd Addition comprises a portion of Outlots B & D Raspberry Ridge. All
special assessments were redistributed on a unit basis when the original plat of Raspberry Ridge
was subdivided. The following ratio of Outlots B & D are included in Raspberry Ridge 2nd
Addition as per the preliminary plat:
Outlot B... 4/12 units
Outlot D ... 23/41 units
All past applicable deferred assessment amounts have been called and certified against the land.
The tax status of the property is delinquent for payable years 1988-93 and represent an amount of
$177.624.27. The balance of special assessments are detailed as follows:

The remaining balance of special assessments would be pro-rated (27/53) on a unit basis. The
unit assessment would be $2.060.07 per lot.
Since utilities are available to the property site, the cost for the extension of services internally
will be the responsibility of the developer. In addition to these improvement costs, and the above
referenced assessment balance the subdivision will be subject to the following City charges
outlined below:

16.8 cents/sq. ft.
$ 1250.00/acre
The application of these City charges would generate the following costs to the developer based
upon a net area of 9.23 acres of single family lots (402,105 square feet) as provided by the lot
area calculation sheet.
Storm Water Management Fee:
402,105 sf @ 16.8/sf = $67,553.64
Collector Street Fee:
9.23 acres @ $1250.00/ac = $11,537.50

These charges represent an approximate cost of $2900.00 per lot for the 27 proposed lots within
Raspberry Ridge 2nd Addition. Assuming the initial net lot area of the plat does not change, the
above referenced storm water, collector street and trunk water and sewer charges would be
determined and collected within the context of a .developer's agreement for the construction of
utility improvements.

RASPBERRY 2ND TREE PLANTING REQUffiEMENTS
After reviewing Raspberry Ridge 2nd Addition's submission for tree planting
requirements, the following deficiencies have been found:
1.) Lot 2, Block 1 - placement of tree designated "A" should be relocated to
the lot's front yard.
2.) Black Hills Spruce, Radiant Crab, and Spring Snow Crab are not listed
under the Street and Yard Planting Requirements, Tree Species
Permitted.
3.) Four trees are required on all corner lots, 2 boulevard and 2 front yard
trees for:
a. Lot 1, Block 2
b. Lot 4, Block 2
c. Lot 5, Block 3
d. Lot 1, Block 3
e. Lot 9, Block 2
