AGENDA REPORT Prior Lake, MN 55372-1714 MARCH 1,2004 7A SUE MCDERMOTT, CITY ENGINEER PUBL!C HEARING TO CONSIDER APPROVAL OF THREE RESOLUTIONS WITH RESPECT TO DOWNTOWN REDEVELOPMENT PROJECT: 1) ORDERING THE MAIN AVENUE AND DAKOTA STREET IMPROVEMENT PROJECT (CITY PROJECT #04-11), 2)APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS, AND 3) AUTHORIZING THE PLACEMENT OF NO PARKING SIGNS ON MAIN AVENUE. HISTORY On September 15, 2003, Council adopted Resolution 03-159 ordering the preparation of a feasibility report for the Main Avenue and Dakota Street Improvement Project (City Project #04-01) which is required to follow the Minnesota Statutes Chapter 429 process. The Minnesota Statutes Chapter 429 process is required because the City Council intends to specially assess a portion of the project. The recommendation of the feasibility report was to proceed with this project. On February 2, 2004, Council adopted Resolution 04- 21 accepting the feasibility report and calling for a public hearing on March 1, 2004 for the Main Avenue and Dakota Street project (commonly known as the downtown redevelopment project). Plans and specifications were also finalized following the approval of the feasibility report. CURRENT CIRCUMSTANCES The purpose of the Public Hearing is to determine if plans and specifications should be approved and if the project should be advertised to receive bids. The Public Hearing will cover the reconstruction of Main Avenue from CH 21 to Kop Parkway and Dakota Street from Erie Avenue to TH 13, including utility improvements, storm sewer, grading, aggregate base, concrete curb and gutter, surface improvements, street lighting and appurtenant work. Details of the project and proposed financing will be presented to the public at the hearing. Financing of the improvements is recommended as follows: t MSA $900,000 Enterprise $247,000 Assessments $486,000 429 Bonds $679,000 TIF Bonds $270,000 Pro.iect Total Cost $2,582,000 www.cityofpriorlake.com Phone 952.447.4230 / Fax 952.447.4245 The proposed assessment rate for Main Avenue and Dakota Street is $125.00/front foot. Less than 190/0 of the total project costs are proposed to be assessed. Actual costs of running a new water service into buildings will be assessed and is estimated to be $2, lOa/unit. The properties abutting the streets located in the project area are subject to assessment. Each of the affected property owners has been notified prior to the Public Hearing in accordance with the statute. ISSUES A Public Informational Meeting was held on February 18th, 2004 to provide the property owners an opportunity to discuss the project in an informal setting prior to the Public Hearing. Ten (10) property owners representing eight (8) properties attended the meetings. Staff presented the proposed improvements, project costs, estimated assessments and answered questions. In general, the need for the project was understood by the property owners. Staff has also met with nineteen business/property owners on an individual basis in January and February. Concerns that were brought up at the meetings are as follows: · Sidewalk on Main A venue - One business owner is opposed to the sidewalk along the east side of Main Avenue north of Viereck's. They felt this sidewalk would not be utilized. · Access during construction - Staff is proposing to construct one-half the street at a time in order to allow for two-way traffic during construction. Staff will work with individual owners to coordinate deliveries as well as access to individual lots. · . Bump-outs at the Main/Dakota intersection - Several business owners were concerned that semi's would not be able to maneuver through the intersection with the construction of the proposed bump-outs. The design engineer has verified that the intersection will accommodate a 62-foot long truck. · Parking during construction - This is a concern for all of the businesses. The plans include signage to direct traffic to the municipal lots. Staff will work with both the contractor and the Methodist Church in order to ,encourage parking at the church location. · Assessments - The City's assessment policy requires that corner properties that are zoned commercial are assessed the frontage on both streets. The policy is based upon the importance of visibility and access to commercial establishments as well as the additional special benefit accruing to such businesses. The owners of the corner businesses have a concern with that and don't feel their businesses will support the assessments. The City staff will be prepared to discuss each of these concerns at the hearing. If, in the Council's judgment, the issues should be addressed in the plans and specifications, direction could be given to staff. The purpose of this public hearing is to: 1) determine whether the project should move forward to the next step, 2) seek approval of plans and specifications and authorization to advertise for bids which will provide the actual project cost and, therefore, the assessments associated with these improvements. At the same time approval is sought to award the contract, the Council could decide not to continue with the project upon receipt of bids. A separate assessment hearing Mainpublichearing ALTERNATIVES: will be conducted following review of the proposed assessments by the City Council's Special Assessment Committee. The No Parking resolution (which is the third action requested) is required for State Aid approval and to allow the City to use Municipal State Aid (MSA) funds for this project. Allowing parking on Main Avenue north of Dakota would have required that the street be wider, which would expand the right of way, impact several properties and add cost to the project for land acquisition. CONCLUSION The project is feasible from an engineering and economic standpoint. There are three alternatives for the City Council to consider: 1. Conduct the Public Hearing and approve three resolutions (1) ordering the Main Avenue and Dakota Street Improvements (City Project #04-01), (2) approving plans and specifications and authorize advertisement for bids, and (3) authorizing the placement of no parking signs on Main Avenue. 2. Deny this item for a specific reason and provide staff with direction. 3. Table this item until some date in the future. RECOMMENDED MOTION: A motion and second t dopt the resolutions listed above. Prior Lake, MN 55372-1714 RESOLUTION 04-XX ORDERING THE MAIN AVENUE AND DAKOTA STREET IMPROVEMENT PROJECT CITY PROJECT #04-01 MOTION BY: SECOND BY: WHEREAS, the Prior Lake City Council on its own initiative has determined that it desires to complete the Main Avenue and Dakota Street Improvement Project; and WHEREAS, on February 2, 2004, the City Council adopted Resolution 04-21 accepting the Feasibility Report and calling for a Public Hearing to be held on the Main Avenue and Dakota Street Improvement Project which includes water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, street lights, and appurtenant work; and WHEREAS, prior to the adoption of this Resolution and pursuant to MS 429.031 Subd. 1 (e), plans and specifications have been prepared to provide helpful information to the City Council in determining the desirability and feasibility of the improvement; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 1 st day of March, 2004, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, since the project is initiated by the City Council it must be approved by 4/5ths vote in accordance with Minnesota Statutes 429.031 Subdivision 1 (f). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. Such plans and specifications, a copy of which is attached hereto and incorporated herein by this reference, are hereby approved. 3. The City Manager shall prepare and cause to be inserted in the official paper and in the Construction Bulletin an advertisement for bids for the making of the improvement pursuant to the attached plans and specifications. The advertisement shall be published not less than 21 days prior to bid opening, shall specify the work to be done, and shall state that the bids will be received by the City Manager until 10:00 a.m. on Tuesday, March 30, 2004, at which time the bids will be publicly opened at the Maintenance Center at 17073 Adelmann Street SE by the Public Works Director. No bids will be considered unless sealed and filed with the City Manager and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City of Prior Lake in the amount of five (5) percent of the amount of such bid. 4. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The City shall ban parking of motor vehicles on the west side of Main Avenue from Dakota Street to Trunk Highway 13 and on the east side of Main Avenue from 200 feet north of Dakota Street to Trunk Highway 13 at all times.
