SUBJECT: CONSIDER APPROVAL OF 1996 FEE SCHEDULE

INTRODUCTION:
The purpose for this agenda item is to consider Council approval of the
1996 City of Prior Lake Fee Schedule. The City's SAC and WAC fees
plus the park support fee are the only building permit related fees
proposed to be increased other than the MWCC's SAC charge. Attached
for Council information is a table illustrating how our development related
fees compare overall with the average contained in the most recent
available Association of Metropolitan Municipalities Municipal License
and Permit Survey (1995 edition). Also included is a survey of developing
communities on park fees which staff conducted.
DISCUSSION:
Outlined below are those development related fees and their recommended
amounts for 1996. Each represent dedicated funds separate from the
General Fund and outside the scope of the 1996 Operating Budget
revenues:

If these proposed charges were implemented they would increase the
single family building permit fee for a $100,000 house from
approximately $5354 to $5704 (excluding the retainer amount of $1500
that is normally refunded). This represents an increase of 6.5% which is
virtually the same as the City's 6.2% operating budget increase for 1996.
This is consistent with the Council position that the cost for community
development be borne, to the extent possible, by new residents.
Attached is the proposed 1996 Fee Schedule which lists all license fees
and service charges. Fees identified to increase or which represent new
fees are indicated in bold alongside their present amount. In addition to
the above list, the remaining fee changes and new fee charges are
identified in the list below:

Building Official Gary Staber has recommended the conversion of our
plumbing and mechanical permit charges from a per fixture method to a
flat fee basis. This would streamline the calculation process and promote
efficiency in the issuance of such permits. The proposed figures are based
upon an average of the plumbing and heating permits issued over the past
year so overall revenue would not change very much. There will be some
shifting of the cost distribution to permits with fewer fixtures.
The Planning Department has determined through the use of surveys and
calls that our fees as recommended with respect to zoning and subdivision
issues are very comparable with other cities. The new fees are for those
reviews that are fairly time consuming. Staff feels it is appropriate to
reimburse such costs and is consistent with the Council perspective that
costs associated with development be recovered.
Since the majority of the larger increases affect the building permit cost, a
letter was sent to contractors, which do business in the community,
informing them that these proposed changes would be discussed by the
Council on January 2nd.
The City SAC and WAC charges along with the MWCC SAC charge are
implemented by ordinance within the Prior Lake City Code. Therefore it is
necessary to approve an ordinance amendment to effect their respective
increases. Such ordinance has been prepared for your review as the next
scheduled item on this agenda which also includes the new 1996 water and
sewer rates.
ALTERNATIVES:
The following alternatives are available to the City Council:
1. Adopt the 1996 Fee Schedule as part of the consent agenda if
no one in the audience desires to comment on the proposed
fees.
2. Approve the 1996 Fee Schedule subject to any specific
Council amendments, after removing the item from the
consent agenda for further discussion.
3. Delay action on the Fee Schedule if additional information is
required by the Council.
RECOMMENDATION: Staff would recommend that the City Council approve either Alternate #1
or #2 with respect to the proposed 1996 Fee Schedule at this time so that
the above referenced changes may be applied effective on January 1, 1996.
The exception are those fees changed by ordinance which shall become
effective following date of publication (118/96).
