CONSIDER RESOLUTION 96-05 ORDERING IMPROVEMENTS AND PREPARATION OF PLANS ON NORTHWOOD ROAD (pROJECT 94-02) 2. CONSIDER RESOLUTION 96-06, APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS ON NORTHWOOD ROAD (pROJECT 94-02) DATE: JANUARY 16, 1996 INTRODUCTION: The purpose of this Agenda item IS to conduct a Public Hearing for Northwood Road improvement project, order the improvement, preparation of plans, and authorize the advertisement for bids. BACKGROUND: Project 94-02, Northwood Road, was previously approved by the City Council on April 4, 1994. The plans were authorized to be prepared and were subsequently completed. On April 3, 1995, the Council deferred the construction of Northwood Road to 1996 to afford the staff an adequate opportunity to obtain necessary right- of-way, and complete construction early in the construction season to avoid bad weather. As a result the contract for construction was not awarded within one year of the Public Hearing to conform with Minnesota Statutes, Chapter 429. Therefore a new Public. Hearing is being conducted. Even though plans were previously authorized and prepared, new authorizations are required. Resolution 96-05 has been modified to allow construction to occur within 2 years of ordering the improvement even though the city will construct Northwood Road in 1996. DISCUSSION: An Informational Meeting was conducted on Tuesday, January 9, 1996, to update the property owners on the status of the project. Seven property owners attended the meeting and all questions were 16200~reek Ave. S.E., Prior Lake. Minnesota 553i72-1714 / Ph. The plans have incorporated previous suggestions that property owners have made: · The northern portion of Northwood Road was widened to accommodate parking on one side of the street. This area has limited space on some lots for off street parking. · A sidewalk was added the length of the project to address pedestrian traffic and safety. · A storm sewer relocated from the Myrvold and Grebner lot line to DNR Northern Rearing Pond. This increased the project cost but eliminates the acquisition of an easement and the discharge of storm water runoff into the lake. This design provides better water quality to Prior Lake. · Added additional water quality ponds for storm sewers to protect water quality on Prior Lake. · Limited amount of area contractor can work within to provide better access during construction. ISSUES: One issue which was raised by staff during the Informational Meeting which was not previously addressed is the outlet elevation of the water in the wetland on the west side of North wood Road in the area of Center Road. Someone over the years has built a dam in front of the culvert which provides for an outlet to the wetland. The dam has backed up water and artificially raised the wetland. Wetland vegetation has been established at this new level. Staff will be requesting property owners to provide drainage easements for the area which the wetland now covers or install the new storm sewer at the same elevation as the existing structure. Staff is concerned about raising the outlet structure without easements and incurring liability. The DNR will also be contacted concerning this. Property owners adjacent to this pond were not present at the meeting and will be contacted individually. MSA Consulting Engineers have increased their engineer's estimate from $919,950.00 to $1,313,000.00. The increase is due to different factors. The plan changes have increased the cost, such as street widening, sidewalk addition, additional water quality ponds and trunk sewer and water services to the Dunn parcel. The cost of the water quality ponds adjacent to the Dunn parcel and associated storm sewer will be recouped when the Dunn parcel develops, through storm water trunk charges. The sewer and water trunk cost will also be recouped through trunk sewer and water charges as part of the development fees. Staff believes the AGPBHEAROOC 2 $1,313,000 estimate is a conservative figure that may be as much as $100,000 high. Additional restrictions on the contractor for maintaining traffic are being added to avoid the Ridgemont Avenue scenario. MSA's original estimate appears to have been $100,000 low. Based upon the plan changes, MSA Consulting Engineers has requested the authorized design fee to be increased from $52,000 to not to exceed $67,000. Based upon the plan modification the increase in fees is justified. The assessments are proposed to remain the same as the rates given at the previous Assessment Hearing: $54.47 per front foot. The balance of the costs will be paid from the Municipal State Aid Fund and Street Collector Fund. The project, based upon the current cost estimate, is being assessed to each property owner at 43% of the project cost instead of the current policy of 60% property owner, 40% city. Northwood Road is a collector street and as such the cost to provide 9 ton capacity and sidewalks are not being assessed to the property owners but paid through Municipal State Aid and Collector Street fees. The Council will be discussing the Assessment Policy at the Council Workshop on January 19, 1996. In the event the Council changes the Assessment Policy at the Workshop, and the result is to lower the assessment rate, the change can be reflected at the Assessment Hearing. The Assessment Hearing will take place after bids are received on February 20, 1996. In other words, the Council can approve both resolutions this evening so that work can proceed on this project. Assessment issues would be addressed at the Assessment Hearing. ALTERNATIVES: The alternatives are as follows: 1. Adopt Resolution 96-05 ordering the improvements and preparation of plans for project 94-02. Adopt Resolution 96-06 accepting plans and advertisement for bids. 2. Table this item for a specific reason. 3. Deny Resolution 96-05 and/or 96-06. RECOMMENDATION: Alternative No.1. This project has been a high City Council priority in previous years and continues to be a high priority for completion. The Council directed that bids be taken in February. To accomplish this, both resolutions need to be approved. If there are assessment issues despite the fact that property owners in this AGPBHEAROOC 3 FINANCIAL IMP ACT: ACTION REQUIRED: AGPBHEAROOC area will pay only 43% of project costs, they should be addressed at the upcoming Assessment Hearing. The cost of this project will be recovered through special assessments, trunk reserve, Collector Street and Municipal State Aid funds. Make a motion and second to approve Resolutions 96-05 & 96-06 and to authorize a fee incrSflSe to MSA Consulting Engineers to $67,000 for design. 4 RESOLUTION 96-05 RESOLUTION ORDERING IMPROVEMENTS AND PREPARATION OF PLANS ON NORTHWOOD ROAD (PROJECT 94-02) MOTION BY: SECONDED BY: WHEREAS: City Project 94-02 is a high priority for city completion and was ordered in April of 1994 following the prescribed Public Hearing; and WHEREAS: deferral occurred primarily to allow time for right-of-way acquisition; and WHEREAS: the project has not been substantially changed from that proposed in 1994; and WHEREAS: pursuant to Resolution 95-125 which the City Council adopted on December 18, 1995, calling for a Public Hearing to be held on the Northwood Road (Project 94-02) by construction of sanitary sewer, watermain, storm sewer, grading, aggregate base, concrete curb and gutter, bituminous surfacing, concrete walk and appurtenant work; and WHEREAS: Ten days mailed notice and two weeks published notice of the hearing was given, and the hearing called to order on the 16th day of January, 1996, at which all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS: A contract shall be let for all or part of the work, or order all or part of the work done by day labor no later than two years after the adoption of this resolution ordering such improvement. 16200>fim.glK:Creek Ave. S.E.. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. Such plans and specifications, a copy of which is attached hereto and made a part of hereof, are hereby approved. 2. The City Manager shall prepare and cause to be inserted in the official paper and in the Construction Bulletin an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall be published not less than 21 days prior to bid opening, shall specify the work to be done, shall state that bids will be opened, and that all bids will be received by the City until 10:00 A.M. on February 20, 1996, at City Hall, 16200 Eagle Creek Avenue, at which time they will be publicly opened at City Hall by the City Engineer. 162~~Creek Ave. S.E..
