IMPROVEMENT PROJECTS AND CONSIDER
APPROVAL OF RESOLUTION 96-48

INTRODUCTION:
The purpose of this Agenda item is to conduct a Public Hearing on
the 1996 improvement projects.
A series of steps need to occur to implement the 1996
Improvement Projects. Five Agenda items attempt to address each
of the five steps.
1. Approve Resolution ordering all 1996 Improvements as
indicated in the Feasibility Report. The Council has previously
accepted the Feasibility Report and ordered improvements to
Northwood Road (Area 1). Resolution 96-48 will include all 4
areas identified in the Feasibility Report to meet the Public
Notification Requirements.
2. Approve Resolution adopting the assessments for Northwood
Road street improvements.
3. Approve Resolution awarding bid for Northwood Road and
authorize construction engineer services.
4. Approval of Resolution authorizing issuance of bonds for 1996
projects.
5. Approve Resolution requesting advanced encumbrance of
MSA Funds for 1997.
BACKGROUND:
At the April 1, 1996, City Council meeting, Council accepted the
Feasibility Study for the 1996 projects. In the adopted Resolution
96-39, there were four project areas listed to be considered for the
report and they were as follows:

1. Northwood Road from CSAH 12 to Island View Road. The
construction will include sanitary sewer and watermain, storm
sewer, grading, aggregate base, concrete curb and gutter,
bituminous surfacing, concrete walk and appurtenant work.
2. Paving of Lakefront Community Park roads, trails and parking
lots by the construction of grading, storm sewer, aggregate
base, concrete curb and gutter, bituminous surfacing, and
appurtenant work. This allocation was made in accordance
with our earlier discussions about annually setting aside funds
for park improvement purposes.
3. CSAH 21 from CSAH 82 to CSAH 42 by the construction of
grading, storm sewer, utility crossings, concrete curb and
gutter, bituminous surfacing, sidewalk, and appurtenant work.
4. The sealcoating of bituminous paved streets throughout the
City.
Resolution 96-39 also called for a Public Hearing to be held on
May 6, 1996 for the 1996 Improvement Projects.
DISCUSSION:
On December 18, 1995, the Council accepted the Feasibility Study
and called for a Public Hearing on the 1996 projects. The
Resolution approved on December 18, 1995, was flawed because
the second part of the Resolution which called for the Public
Hearing included Northwood Road but not the other three projects.
A new Resolution 96-48 needs to be approved which would
include Northwood Road, CSAH 21, Lakefront Park and
bituminous sealcoating. Staff apologizes for the inconvenience
this has caused.
A new Public Hearing is required on May 6, 1996, to include the
four project areas. Staff recommends that the following projects be
included in the 1996 construction program.

With the 429 special assessment projects, Public Hearings must be
conducted on the proposed improvements prior to implementing
the proj ect.
The 1996 improvement projects will be financed by assessments,
Municipal State Aid Funds, ad valorem tax levy, Street Collector
Fund, and the Trunk Reserve Fund.
The alternatives are as follows:
1. Conduct a Public Hearing, approve, and order improvements as
per Resolution 96-48.
2. Table this item for a specific reason.
3. Deny Resolution 96-48.

RESOLUTION CONDUCTING A PUBLIC HEARING ON
IMPROVEMENT OF 1996 PROJECTS

WHEREAS, pursuant to Resolution 95-119 of the City Council, adopted on December 4,1995,
a report prepared by the City's Engineering Department and the City's
Engineering Consultant (MSA Consulting Engineers, Inc.) with reference to the
following improvements and the generally described project areas:
1. Northwood Road from CSAH 12 to Island View Road by the construction of
grading, storm sewer, aggregate base, concrete curb and gutter, bituminous
surfacing, walk and appurtenant work; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOT A, that
1. Such improvement is hereby ordered as proposed in the Council Resolution 95-119
adopted December 4, 1995 for such streets and areas in accordance with the report
and the assessment of property as described in the report for all or a portion of the
cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated
total cost of the improvements of $1,834,000.00.
2. A Public Hearing shall be held on the following such proposed improvements on the
following date at the Fire Station No.1, with the address of 16776 Fish Point Road,
City of Prior Lake, Minnesota at the following time:
May 6, 1996 at 8:30 P.M.

WHEREAS, it is proposed to construct improvements within the following generally described
project area:
1. Northwood Road from CSAH 12 to Island View Road. The construction will include
sanitary sewer and watermain, storm sewer, grading. aggregate base, concrete curb and
gutter, bituminous surfacing, concrete walk and appurtenant work; and
2. Paving of Lakefront Community Park roads, trails and parking lots by the construction
of grading, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing,
and appurtenant work; and
3. CSAH 21 from CSAH 82 to CSAH 42 by the construction of grading, storm sewer,
utility crossings, concrete curb and gutter, bituminous surfacing, sidewalk, and
appurtenant work: and
4. The sealcoating of bituminous paved streets throughout the City.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that the proposed improvements be referred to the City Engineer for study and
that he is instructed to report to the Council with all convenient speed advising the Council in a
preliminary way as to whether the proposed improvements are feasible and as to whether they
should best be made as proposed or in connection with other improvements, and the estimated
costs for the improvements as recommended.

WHEREAS, Resolution 95-125 was originally approved on December 18, 1995 which
incorrectly identified the improvements project area for the public hearing; and
WHEREAS, pursuant to Resolution 95-119 of the City Council, adopted on December 4, 1995,
a report prepared by the City's Engineering Department and the City's
Engineering Consultant (MSA Consulting Engineers, Inc.) \-vith reference to the
following improvements and the generally described project areas:
1. Northwood Road from CSAH 12 to Island View Road by the construction of
grading, storm se\-ver, aggregate base, concrete curb and gutter, bituminous
surfacing, walk and appurtenant work; and
2. CSAH 21 from CSAH 82 to CSAH 42 by the construction of storm se\-ver,

portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429
at an estimated total cost of the improvements of $2,025,000.00.
2. A Public Hearing shall be held on the 1996 proposed improvements on the following
date at the Fire Station No.1, with the address of 16776 Fish Point Road, City of
Prior Lake, Minnesota at the following time: May 6, 1996- at 8:30 P.M.
