IMPROVEMENTS AND AUTHORIZE MSA CONSULTING
ENGINEERS TO PERFORM CONSTRUCTION
ENGINEERING SERVICES.

INTRODUCTION:
The purpose of this Agenda item is to award bids received and
enter into a contract for project 94-02 Northwood Road
Improvements. Resolution 96-37 has been prepared for Council
action on the award of bid. Also this Agenda item is for Council to
consider authorizing MSA Consulting Engineers to perform the
construction engineering services on this project.
BACKGROUND:
At the January 16, 1996 Council Meeting, a Public Hearing was
held and the council approved plans and ordered advertisement for
bids for Project 94-02, Northwood Road. Bids were received and
opened on February 20, 1996. The results of the bids have been
tabulated and a contract amount has been determined. The low
bidder is Valley Paving, Inc. of Shakopee, MN in the amount of
$880,525.38. Their bid was slightly below the engineers estimate
of $937,000. Valley Paving, Inc. successfully completed the Prior
South project.
DISCUSSION:
Eminent domain proceeding is being used to obtain the one
remaining easement which has not been acquired. The hearing to
establish public need was held on April 23, 1996, which
established the quick take possession date of May 10, 1996.
Valley Paving, Inc. will start work as soon as the contracts are
executed. The pre-construction conference is scheduled for 10:00
a.m. on May 7, 1996 and it is anticipated that work will begin on
May 7, 1996 after this meeting in concluded. Work will take place
only in those areas where right-of-way has been acquired.
Residents will be notified when they are affected.

Staff has negotiated with MSA Consulting Engineers to perform
construction services for this project. Their fee is not to exceed
$85,500.
ALTERNATIVES:
The alternatives are as follows:
1. Approve Resolution 96-37 accepting bids and awarding the
contract for Project 94-02, to the lowest responsible bidder,
Valley Paving, Inc. for the Base Bid amount. Approve a
motion authorizing MSA Consulting Engineers to perform
construction services for this project at a cost not to exceed
$85,500.00. This represents 9.70/0 of the bid amount.
MnDOT guidelines for Municipal State Aid projects is 10%
for normal projects and 12% for complex projects.
2. Do not approve Resolution 96-37 for specific reasons.
3. Table this item for specific reasons.
RECOMMENDATION: The recommendation is to award the bid to Valley Paving Inc. for
the base bid amount of $880,525.38.
FINANCIAL IMP ACT: Project 94-02 will be paid through Special Assessments, Municipal
State Aids Funds, Collector Street Funds, and Trunk. Reserve
Funds.
ACTION REQUIRED:. Two separate actions are required:
1. A motion to approve or deny Resolution 96-37.
2. A motion to authorize MSA Consulting Engineers to
perform construe, on services on Project 94-01 at a cost not

WHEREAS, pursuant to an advertisement for bids for the street reconstruction improvement
projects on Northwood Road, Project 94-02:
by the construction of grading, storm sewer, sanitary sewer, watermain, aggregate
base, concrete curb and gutter, bituminous surfacing, sidewalks, and appurtenant
work; bids were received, opened, and tabulated according to the law, and the
following bids were received complying with the advertisement:

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOT A, that
1. The Mayor and City Manager are hereby authorized to enter into a contract
with Vallev Paving. Inc. of Shakopee. Minnesota in the name of the City of
Prior Lake for the street reconstruction improvement proj eel 94-02
Northwood Road, by the construction of grading, storm sewer, sanitary
sewer, watermain, aggregate base, concrete curb and gutter, bituminous

surfacing, sidewalks and appurtenant; according to the plans and
specifications therefore approval by the City Council and on file in the
office of the City Manager.
2. The City Manager is hereby authorized and directed to return forthwith to
all bidders the deposits made with their bids, except that the deposits of the
successful bidder and the next two lowest bidders shall be retained until a
contract has been signed.
