HomeMy WebLinkAbout8B - Water Tower Final Plat AGENDA #: PREPARED BY: SUBJECT: DATE: INTRODUCTION: DISCUSSION: STAFF AGENDA REPORT 8B JANE KANSIER, PLANNING COORDINATOR; CONSIDER APPROVAL OF RESOLUTION 96-XX APPROVING THE FINAL PLAT FOR "CREST WATER TOWER ADDITION" DECEMBER 16,1996 The purpose of this agenda item is to consider adoption of Resolution 96-XX approving the final plat for Crest Water Tower Addition. The final plat was reviewed in accordance with Sections 6-5-1 and 6-7-1 through 6-7-17 of the Subdivision Ordinance. The proposed final plat consists of one lot. This lot was originally platted as Outlot "A" and a portion of Outlot liB" I Sand Pointe 3rd Addition, in 1983. This site is the present location of a City water tower. The purpose of this final plat is to facilitate the construction of a communications antenna equipment building on the Crest Water Tower site. The City has received a request to locate an antenna on the water tower and to construct an accessory equipment building on the site. Since building permits cannot be issued on outlots, the City is platting the property to allow the construction of this building. The principal requirements for final plat approval usually include a signed developer's agreement with surety for the installation of utilities and streets and the satisfactory completion of all preliminary plat conditions. However, this plat does not require any public improvements, and the property is City-owned. In addition, parkland dedication requirements were satisfied when the development was originally platted. Staff has reviewed the final plat and finds it to be in substantial compliance with the requirements of the Subdivision Ordinance. ALTERNATIVES: 1. Approve Resolution 96-XX 2. Deny Resolution 96-XX 3. Defer consideration of this item for specific reasons. RECOMMENDATION: Alternative 1 ACTION REQUIRED: Motion and second to adopt Resolution 96-XX, approving this final plat. Reduced Copy of Final 1 1:\96subdiv\final\cresttow\towerfp.doc Page 2 RESOLUTION 96-XX RESOLUTION APPROVING THE FINAL PLAT OF "CREST WATER TOWER ADDITION" AND SETTING CONDITIONS TO BE MET PRIOR TO RELEASE OF THE FINAL PLAT MOTION BY: SECOND BY: WHEREAS: the City Council reviewed the final plat of "Crest Water Tower Addition" at its meeting on December 16, 1996, and WHEREAS: the City Council has found that the fmal plat of "Crest Water Tower Addition" is in substantial compliance with the provisions of 6-5-1 and 6-7-1 through 6-7-17 of the City Subdivision Ordinance; and WHEREAS: The City Council has determined the street collector fee, should be waived. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it should and hereby does approve the fmal plat of "Crest Water Tower Addition"; and, BE IT FURTHER RESOLVED that the following conditions must be met, prior to release of, and recording of said plat: 1. A current title opinion or commitment of title insurance be submitted acceptable to the City Attorney. 2. Reductions of the entire final plat be submitted, to the following scales: 1" = 800'; 1" = 200'; and one reduction at no scale which fits onto an 81/2" x 11" sheet of paper. 3. Four mylar sets of the final plat with all required signatures be submitted. 4. The final plat and all pertinent documents must be filed with Scott County within 60 days from the date of fmal plat approval. Failure to record the documents by February 16, 1997, will render the final plat null and void. Passed and adopted this 16th day of December, 1996.
