AGENDA #: PREPARED BY: SUBJECT: 7A JEFF EVENS, ENGINEERING TECHNICIAN IV CONSIDER APPROV AL OF THE FOLLOWING RESOLUTIONS: 96-23 DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT ROLL FOR PROJECT 94-02 NORTHWOOD ROAD STREET IMPROVEMENT 96-24 ESTABLISHING THE DATE OF THE ASSESSMENT HEARING FOR PROJECT 94-02 NORTHWOOD ROAD STREET IMPROVEMENT DATE: MARCH 4, 1996 INTRODUCTION: The purpose of this agenda item is to declare the cost to be assessed, approve the preparation of the assessment roll and set the special assessment hearing date for Project 94-02 Northwood Road improvements. BACKGROUND: At the January 16, 1996 Council Meeting, a Public Hearing was held and the council approved plans and ordered advertisement for bids for Project 94-02, Northwood Road. Bids were received and opened on February 20, 1996. The results of the bids have been tabulated and a contract amount has been determined. The low bidder is Valley Paving, Inc. of Shakopee, MN in the amount of $880,525.38 and their bid was slightly below the engineers estimate. The total project cost includes right of way acquisition costs which are estimated at $100,000.00. The right of way is included in the other project costs which amount to $376,974.62. This brings the Total Project cost to $1,257,500.00. At the February 5, 1996 meeting, council approved a revision to the Assessment Policy. The revision changed the percentage that the City assesses the benefiting properties. The policy was changed from assessing 60% of the total project cost against the benefiting properties to 40%. This means the City portion also changes from 162~@>~~~qsreek Ave. S.E.. Prior Lake. Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER Sanitary sewer and water lines will be extended across Northwood Road to serve the Dunn property and the project cost of extending the lines is $35,943.49 and will be paid from the Trunk Sewer and Water Fund. When the property develops, the Trunk fund will be reimbursed. The project cost for the sidewalks and the upgrading the roadway from 7 ton to 9 ton was subtracted out of the total project cost to calculate the assessment rate. The project cost of these two items is $96,645.51. The extra costs to construct Northwood Road to a 9 ton design is not assessed because a typical residential street project is designed to meet a 7 ton standard. Per the City Assessment policy the sidewalk portion of this project can not be included in the assessments to the property owners. DISCUSSION: Attached is Resolution 96-23 declaring costs to be assessed and ordering preparation of the proposed assessment roll and Resolution 96-24 setting the hearing date for Northwood Road for the April 1, 1996 Council Meeting. AL TERNA TIVES: The alternatives are as follows: 1. Approve Resolutions 96-23 and 96-24 declaring the cost to be assessed, ordering the preparation of the proposed assessment roll for Northwood Road improvements and setting April 1, 1996 for the Assessment Hearing. 2. Deny the Resolutions for a specific reason 3. Table this item for a specific reason. RECOMMENDATION: The recommendation is Alternatives No. 1 approvIng both resolutions. FINANCIAL IMPACT: The project costs will be recouped from the Trunk Reserve Fund, State Aid Funds, Collec r Street Fund and Assessments. ACTION REQUIRED: AGDELCST.DOC ............---.r RESOLUTION 96-23 RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT FOR PROJECT 94-02 NORTHWOOD ROAD STREET IMPROVEMENTS MOTION BY: SECONDED BY: WHEREAS, an Engineer's Estimate has been prepared and costs have been determined for the improvements of Project 94-02 and the estimated contract price for such improvements is $880,525.38, and the estimated expenses incurred or to be incurred in the making of such improvement amount to $376,974.62 so that the total cost of the improvement will be $1,257,500.00. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The portion of the cost of such improvement is to be paid by the Trunk Reserve, State Aid Funds, and Collector Street Fund is hereby declared to be $899,029.52, and the portion of the cost to be assessed against benefited property owners is declared to be $358,470.48. The following is a summary of the funding amounts for the project: FUND AMOUNT Municipal State Aid $700,000.00 Trunk Reserve $35,943.49 Street Collector $163,086.03 Assessments $358,470.48 Total Project Cost $1,257,500.00 2. Assessments shall be payable on an equal principal installment method extending over a period of 10 years. The first installment shall be the annual principal plus interest calculated from the public hearing date to the end of this year plus twelve months of the next year and shall bear interest at the rate of a minimum of 8% per annum from the date of the adoption of the assessment resolution. 3. The City Manager, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection. 4. The City Manager shall upon the completion of such proposed assessment, notify the Council thereof. Passed and adopted this 4th day of March, 1996. A hearing shall be held on the 1st day of April, 1996 in City Council Chambers at 7:30 P.M. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given the opportunity to be heard with reference to such assessment. 2. The City Manager is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Finance Director, except that no interest will be charged if the entire assessment is paid within 30 days from the adoption of the assessment. He may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid, excepting the installment portion appearing upon the current year's property tax statement.
