MICHAEL LEEK, ASSOCIATE PLANNER 1995 VARIANCE SUMMARY MARCH 4,1996 INTRODUCTION: The purpose of this item is to consider the summary of variance activity during 1995. A copy of the summary and report to the Planning Commission are attached to this report. ANAL YSIS: At its meeting of Monday, February 26, 1996, the Planning Commission voted to accept the report and transmit it to the City Council with the recommendation that City Staff be directed to study ordinance changes which would potentially reduce the level of variance activity. Specific discussion at the Planning Commission centered on permitting 5' side yard setback, since side yard setback variances were the most frequently requested variance. In addition, since a large number requests involved the construction of decks on lakeshore lots, perhaps the setback exception for decks should/could be broadened. ALTERNATIVES: 1. The City Council could accept the report without directing further action. 2. The City Council could accept the report and direct further study of zoning ordinance revisions. MICHAEL LEEK, ASSOCIATE PLANNER _ YES --1L NO-N/A FEBRUARY 26, 1996 INTRODUCTION: The purpose of this item is to provide the Planning Commission with information regarding 1995's variance activity. It is hoped that this information will give the Commission information which will be useful in evaluating new variance requests, and also in evaluating the possible need for changes in the City's zoning ordinance. DISCUSSION: During 1995 the Planning Commission reviewed 43 requests for variance. The nature of the individual requests and their disposition are contained in the the attached table. Of the 43 requests heard, 32 (74.40/0) were approved (4 of those with modifications from the original requests), 8 (18.60/0) were denied, and 3 were withdrawn. The most common request was for a variance from the side yard setback requirement on one or both sides of the property. Side yard setback variances were requested in 19 (44.20/0) of the variance cases. The second most common request was for a variance from the lakeshore setback requirement, with 12 (27.9%) lakeshore setback variances requested. Following closely behind were requests for variance from the impervious surface, with 11 (25.60/0) variances requested. The nature of the requests for variance is probably very familiar to the Commission, and similar to previous years. In light of the presumption in the Zoning Ordinance that "lots of record" are buildable it would make sense to make the process of developing such lots less cumbersome than it is at present. The nature of the requests also suggests that the Commission and City Council consider amending the Zoning Ordinance (including the shore land provisions) to more efficiently accomodate development of lots in the shoreland district. 16200 12aM~(MQ)P~6).E.. In 1995, such a provision might have eliminated 13 requested individual variances. As another example, the City could adopt the 50' lakeshore setback found in the MnDNR's regulations. In 1995, such a change might have eliminated 3 requested individual variances. ALTERNATIVES: 1. Accept the report and direct that it be transmitted to the City Council for information. 2. Accept the report, direct that the report be transmitted to the City Council for information, and direct further study of possible ordinance revisions in response to the report.
