MARCH 4, 1996 CONSENT AGENDA #: PREPARED BY: SUBJECT: INTRODUCTION: The purpose of this item is to consider approval of Ordinance 96-09 amending the Zoning Ordinance and City Code to establish driveway width standards for commercial, industrial and institutional land uses. BACKGROUND: See attached Planning Report dated February 12, 1996 for reference to background material. DISCUSSION: The Zoning Ordinance does not currently contain a standard for driveway width for commercial, industrial and institutional land uses. The only driveway width standard identified in the Zoning Ordinance pertains to residential uses where driveway width is limited to 24 feet. Due to the influx of commercial/industrial building activity, staff has identified a need to amend the Zoning Ordinance to incorporate driveway standards designed for properties other than residential. There is a need to provide wider driveways in order to accommodate truck traffic and emergency vehicles, The proposed Ordinance incorporates 36 foot driveway width standard for land uses other than residential. In addition to Ordinance 96-09, the attached "Commercial and Industrial Concrete Entrances" plate is incorporated into the Engineering Design Guideline Manual, adopted by the City Council on February 5, 1996. ISSUES: The Planning Commission held a public hearing on February 12, 1996 and recommends the City Council adopt Ordinance 96-29 as written. The City Council of the City of Prior Lake does hereby ordain: Title 5-5-5(D) of Prior Lake City Code and Section 6.5D. of Prior Lake Zoning Ordinance 83-6 are hereby amended to read as follows: D. All offstreet parking areas shall have access from driveways rather than from public streets. 1. F or residential uses, said driveway access shall not exceed twenty-four (24) feet in width measured at the curb or edge of the street in the case where no curb exists. 2. For all other uses, said driveway access shall not exceed thirty-six (36) feet in width measured at the street right of way line. This ordinance shall become effective from and after its passage and publication. Passed by the City Council of the City of Prior Lake this 4th day of March, 1996. COMMERCIAL AND INDUSTRIAL CONCRETE ENTRANCES PLANNING COMMISSION MINUTES February 12, 1996 The February 12, 1996, Planning Commission Meeting was called to order by Chairman Kuykendall at 7:01p.m. Those present were Commissioners Criego, Kuykendall, Loftus and V onhof, Planning Director Don Rye, Assistant Planner Deb Garross, Associate Planner Michael Leek and Recording Secretary Connie Carlson. ROLL CALL: Criego Wuellner V onhof Loftus Kuykendall Present Present Present Absent Present REVIEW MINUTES OF PREVIOUS MEETING: MOTION BY VONHOF, SECOND BY WUELLNER TO APPROVE THE JANUARY 22, 1996 MINUTES. V ote taken signified ayes by V onhof, Wuellner, Criego and Kuykendall. MOTION CARRIED. Commissioner Loftus arrived at 7:05 p.m. PUBLIC HEARINGS: 1. PUBLIC HEARING TO CONSIDER AN AMENDMENT TO THE ZONING ORDINA1~CE REGARDING DRIVEWAY WIDTH. The public hearing was opened and a sign-up sheet was circulated to the public in attendance. Assistant Planner Deb Garross presented the information in the Planning Report dated February 12,1996. Staff recommends the Planning Commission make a motion to City Council to adopt the proposed amendment as written or with changes. Comments by Commissioners: Criego: . Question: What do other communities have for widths for commerical driveways? Garross replied this standard is typical and has been used by the City of Prior Lake, especially out in the Office Park. Staff felt this issue had to be clarified in the MN021296 DOC PAGEl Ordinance. It is a width that is workable as far as fire and safety access as well being able to maneuver large trucks. . Question: In a residential area where you may have a commerical conditional use permit, how does that apply? Garross explained this amendment is written for the specific uses and not tied to the zoning district itself. Wuellner: . Question: Is there a limit to the number of driveways commercial or residential property can have? Garross explained it was not. V onhof: . Question: All the other provisions that provide for driveways, like setbacks would still apply? Garross replied "Yes". Loftus: . Garross explained this issue has been around for the year or two and should have been addressed earlier in the Zoning Ordinance. It came about recently because of the commerical development and new buildings and will be used quite often. Kuykendall: . Comment on minimum slope of one half percent. . Traffic concern especially County Road 42 - Scott County standards would apply? . Rye said Scott County will not allow direct commericaVindustrial traffic on to County Road 42 at all. . Concern for a far wide right turn - if they have to swing out to make the comer. The alternative is to have a one-way directional slope (one-way in, one-way out). . Possibly at another time the City should research one way entrances. . Supports staffs recommendation and act positively. DEB GARROSS, ASSISTANT CITY PLANNER _X_ YES _NO-N/A FEBRUARY 12, 1996 PRESENTER: PUBLIC HEARING: DATE: INTRODUCTION: The purpose of this item is to consider an amendment to Prior Lake Zoning Ordinance 83-6 to add driveway width standards for all properties. BACKGROUND: Section 6.5D. states: "All offstreet parking areas shall have access from driveways rather than from public streets. Said driveway access shall be limited to twenty four (24) feet in width at the public street line." The provision is part of the "General Regulations" section of the Zoning Ordinance. The driveway width limitation of twenty-four feet is appropriate for residential driveways however does not provide adequate width for commercial, industrial and institutional type uses. This provision was not a concern in the past due to the limited amount of commercial/industrial development. However, with the advent of the Business Office Park and other non-residential development, it is necessary to amend Section 6.5D to provide adequate driveway width for uses other than residential. DISCUSSION: The proposal is to amend the Zoning Ordinance to rewrite Section 6.5D as indicated on the attached draft Ordinance. The proposed regulations identify residential driveways shall not exceed twenty-four feet. A separate provision specifies the maximum driveway width shall not exceed thirty-six feet in width. In addition to the Zoning Ordinance amendment, the Prior Lake Engineering Design Guideline Manual will include the attached illustration page indicating the "Typical entrance for Commercial and Industrial Properties." Recommend the City Council approve the amendment with changes directed by the Planning Commission. RECOMMENDATION: Alternative # 1 or 2, based upon discussion by the Planning Commission. ACTION REQillRED: A motion to recommend the City Council adopt the proposed amendment as written or with changes directed by the Planning Commission.
