INTRODUCTION:
The purpose of this Agenda item is to authorize payment for
previously authorized easements acquisition for Project 94-02
Northwood Road.
BACKGROUND:
On December 19, 1994, the Council authorized preparation of
documents granting easements to the City for Project 94-02. All
easements have been prepared and presented to each effected
property owner.
On January 17, 1995, the Council approved Resolution 95-04
which authorized the acquisition of property for Project 94-02 by
Eminent Domain.
The property owners who signed the easements have not been paid.
The payments will be processed with the April 15, 1996 invoices.
DISCUSSION:
The authorized easements are required to construct the
improvements to Northwood Road in accordance with current City
and State Aid Standards. Attached is a tabulation of the property
owners who have executed easements for the proj ect along with the
amounts to be paid. The purpose of this Agenda is to apprise the
Council of the negotiated amounts to be paid.
The condemnation action is proceeding with the parcels that have
not signed the easements. It is anticipated that all parcels will sign
with the exception of one. Staff will continue pursuing easement
acquisition and remove those from the Eminent Domain
proceedings as easements are signed.

The Eminent Domain action requires the City to deposit with the
Court the appraised value of the easements prior to taking
posseSSIon.
Attached is a list of the parcels presently included in the Eminent
Domain action. The City will be required to deposit the appraised
value of the easements with Scott County District Court prior to
May 10, 1996. Payment will be included in invoices to be paid in
the future.
Easement acquisition for the remaining parcels may require
additional dollars from what is shown on the attached tabulation.
The Council previously authorized this action which was a pre
requisite for proceeding with the Northwood Road project. This
Agenda Report is intended to re- familiarize the Council with the
reason and magnitude of these expenditures.
The alternatives are as follows:
1. Approve a motion authorizing the payment of easements
for Project 94-02 and authorize the required amount be
deposited to the Court for the Condemnation Hearings.
2. Table this item until May 6, 1996 for a specific reason.
(Requires removal from Consent Agenda.)
The recommendation is Alternative No.1.
The costs for these easements has been added into the cost for
Project 94-02, and will be recouped from State Aid Funds and
through Special Assessments.
