Consider approval of Resolution 96-60 which: . Approves the plans and specifications for the improvements to CSAH 21 from Fish Point Road to the east city limits. . Approves the cooperative agreement with Scott County for improvements to CSAH 21. . Approves funding for landscaping 2.) Consider approval of Resolution 96-61 restricting parking on CSAH 21. BACKGROUND: The CSAH 21 plan is for a four lane urban roadway with an 8' bituminous bike trail on the South side. This bike trail will connect with an existing bike trail in Cleary Park. The project begins at Fish Point Road in Prior lake and continues 1300' east of CSAH 27 in Credit River Township to connect to the existing portion of CSAH 21 which connects to I 35 (See the attached map). The new street alignment for CSAH 21 will follow the old railroad right-of-way, therefore, the old CSAH 21 alignment can remain. The county intends to turn this road back to the city to be used as 16200 Eagle Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER a frontage road for the property owners along the north side of CSAH 21 from Adelman Street to County Road 87. This project includes the milling of the existing bituminous surface of old CSAH 21 from Adelman Street to County Road 87. The frontage road will be provided with a new surface by overlaying 3" of bituminous on the milled aggregate. The project also includes the reconfiguration of the County Road 87 intersection with CSAH 21. The northerly 600 feet of County Road 87 will be shifted to the east and constructed with a bituminous surface meeting 9 ton design standards. The cooperative agreement and the plans for upgrading CSAH 21 do not include the street lighting (although the original project funding included an allocation for street lighting). If the council chooses to add street lights along CSAH 21, the plans and the cooperative agreement will need to be revised. Staff has prepared a street lighting layout along CSAH 21 as shown on the attached street lighting map. The existing street lighting stops 200' east of Fish Point Road. The new street lighting layout provides for street lights at intervals of approximately 300' to illuminate the trail on the south side CSAH 21. This lighting will improve security for businesses along CSAH 21 as well as the new city maintenance building. The estimated cost for street lighting is $50,000. The Landscaping on previous CSAH 21 projects has been installed as part of the construction contract and paid through the cooperative agreement. Staff has reviewed this process and determined that a more cost effective approach is possible. By using the city's park department, plants could be purchased through the city's nursery. Design of the landscaping would be a cooperative effort between parks and engineering. Money saved by doing the work in-house could be used for additional lighting or to purchase landscaping equipment for the park's department. New equipment would provide a more efficient method for moving trees for this and future projects. Currently the trees are moved, one at a time, with a tree spade on a front end loader at low travel speeds. The proposal would be to purchase an additional tree 2 , . spade attachment for the skidster and a used pod trailer for moving the trees. This would allow six trees to be transported at one time. The cost of purchasing the equipment is estimated to be $18,000 and the estimated cost for plant materials would be $20,000. As part of the project, an entry monument would be designed and constructed at an estimated cost of $12,000. The total amount for landscaping is estimated to be $50,000. DISCUSSION: The detailed plans are available at the Public Works office for city council review. Staff will be making a presentation at the meeting. The City's share of the costs for the CSAH 21 cooperative aQreement are for storm sewer, curb and gutter, watermain and bike path. The cost breakdown for the cooperative agreement is as follows: Bike Path Storm Sewer Water Mill & Overlay frontage road Curb and Gutter 180/0 Engineering Total City's Share of Cost $21,623.00 $129,601.17 $5,249.17 $8562.50 $16,473.00 $32,671.59 $214,180.43 The storm sewer amount will be adjusted based on the MnDOT hydraulics engineer's cost split, which is based on State Aid rules. The amount of the cooperative agreement will be adjusted based upon actual bid amounts and final quantities. The project was bonded for in 1993. The county has not completed the project within the anticipated timeline. The city must make payment on the project within three years of the bonding. The three year period ends on July 8, 1996. Staff intends to submit future invoices in the amount of $250,000 to cover the city's share of the cooperative agreement. The county will 3 rebate the balance to the city when the project is completed. If the council approves the street lighting layout, then the cooperative agreement will need to be revised. If the Council approves of city in-house design and installation of the landscaping the $50,000 will need to be spent before July 8, 1996. In summary: . approval of funding for the construction cooperative agreement with Scott County for improvements on CSAH 21 is sought in the amount of $250,000, and . approval of funding for installation of street lights along CSAH 21 is sought in the amount of $50,000, and . approval of funding for in-house landscaping, including an entry monument on CSAH 21, is sought in the amount of $50,000, and . the total funding requested is $350,000. This project was bonded in 1993 for $405,000. The breakdown for bonding was as follows: Storm Sewer, Curb Lighting Sidewalk/Bikeway Landscaping Watermain Crossings Total $200,000 $100,000 $30,000 $60,000 $15,000 $405,000 The total encumbrance requested is $350,000. The balance of $55,000 would remain in the construction fund. The Cooperative Agreement for County Project S.A.P. 70-621-09, improvement of CSAH 21 is attached. The project cost is $2,289,849.96. The total City cost is estimated to be $204,076.68'. The total will be adjusted based on actual construction costs. 4 FUNDING: ALTERNATIVES: RECOMMENDATION: BUDGET IMPACT: ACTION REQUIRED: This project was funded in a 1993 bond issue. The Alternatives are as follows: 1. Approval of Resolutions 96-60 and 96-61 are required from the city for the county to implement the improvements to CSAH 21 2. Table this item for a specific reason. 3. Deny this Agenda item for a specific reason. The recommendation is for Alternative No. 1 The Project will be paid for from the 1993 bond issue. County Project No. SAP 70-621-09 City of Prior Lake County of Scott CONSTRUCTION COOPERATIVE AGREEMENT THIS AGREEMENT, made and entered into this _ day of , 19_, by and between the County of Scott, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the "County" and the City of Prior Lake, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the "City". WITNESSETH: WHEREAS, the County and the City have been negotiating to bring about the improvement of County State Aid Highway 21 from 2000' east of CSAH 39 to 1300' east of CSAH 27 (Engineer's Stations 139+02.77 to 246+00) as shown on the County Engineer's plans for SAP 70-621-09 which improvement contemplates and includes grading, aggregate base, plant-mixed bituminous surface, concrete curb and gutter, storm sewer, landscaping and other related improvements; and WHEREAS, a portion of the above described project lies within the corporate limits of the City, and WHEREAS, the County Engineer has heretofore prepared an engineer's estimate of quantities and unit prices of material and labor for the above described project and an estimate of the total cost for contract work in the sum of Two Million Two Hundred Eighty-nine Thousand Eight Hundred Forty-nine & 96/100 ($2,289,849.96). A copy of said estimate (marked Exhibit "A") is attached hereto and by this reference made a part hereof; and WHEREAS, it is contemplated that said work be carried out by the parties hereto under the provisions of M.S. Sec. 162.17, Subd. 1. NOW, THEREFORE, IT IS HEREBY AGREED: 1 County Project No. SAP 70-621-09 City of Prior Lake County of Scott The County or its agents will advertise for bids for the work and construction of the aforesaid Project No. SAP 70-621-09, receive and open bids pursuant to said advertisement and enter into a contract with the successful bidder at the unit prices specified in the bid of such bidder, according to law in such case provided for counties. The contract is in form and includes the plans and specifications prepared by the County or its agents, which said plans and specifications are by this reference made a part hereof. II The County shall administer the contract and inspect the construction of the contract work contemplated herewith. The City Engineer shall cooperate with the County Engineer and his staff at their request to the extent necessary, but shall have no other responsibility for the supervision of the work. III The City shall reimburse the County for its share in the construction cost of the contract work for said project and the total final contract construction cost shall be apportioned as set forth in the Division of Cost Summary in said Exhibit "A" attached hereto. It is further agreed that the Engineer's Estimate referred to in this agreement is an estimate of the construction cost for the contract work on said project and that the unit prices set forth in the contract with the successful bidder and the final quantities as measured by the Engineer shall govern in computing the total final contract construction cost for apportioning the cost of said project according to the provisions of this paragraph. IV In addition to payment of the City's proportionate share of the contract construction cost, the County and the City further agree to participate in the Preliminary Engineering, which includes all costs of planning, design and preparation of plans and specifications, in an amount of ten percent (100/0) of the 2 County Project No. SAP 70-621-09 City of Prior Lake County of Scott cost of construction. The County and City further agree to participate in the construction engineering: which includes the complete staking, inspection and supervision of the construction, in an amount of eight percent (80/0) of the final contract amount. Participation of engineering costs by the City shall be the same percentage as the total construction participation. The cost of the items in which the County shall participate shall be based on the unit prices in the contract and the final construction quantities as determined by the Project Engineer in charge. The County and the City shall participate in the cost of the storm sewer construction as shown in Exhibit "A" and per the Scott County Highway Department's "Policies for Cost Participation with Municipalities." v The City shall, based on the contract price, deposit with the Scott County Treasurer ninety percent (900/0) of the estimated City's share of the construction and engineering costs as partial payment within thirty (30) days after award of contract and execution of this Agreement, whichever is later. The remaining amount of the City's share of construction and engineering costs of this project shall be paid to the County upon completion of the project and submittal to the City of the County's final, itemized, statement of the project costs. In the event the partial payment exceeds the City's share of these final costs, such overpayment shall be returned to the City by the County. VI The County Engineer shall prepare monthly progress reports as provided in the specifications. A copy of these reports shall be furnished to the City upon request. 3 County Project No. SAP 70-621-09 City of Prior Lake C,ounty of Scott VII All records kept by the City and the County with respect to this project shall be subject to examination by the representatives of each party hereto. All data collected, created, received, maintained or disseminated for any purpose by the activities of the County or City pursuant to this Contract shall be governed by Minnesota Statutes Chapter 13, as amended, and the Minnesota Rules implementing such Act now in force or hereafter adopted. VIII The County reserves the right not to issue any permits for a period of five (5) years after completion of the project for any service cuts in the roadway surfacing of the County Highway included in this project for any installation of underground utilities which would be considered as new work; service cuts shall be allowed for the maintenance and repair of any existing underground utilities. IX The City shall, at its own expense, remove and replace all City owned signs that are within the construction limits of this project. X Upon completion of this project, the County, at its expense, shall place the necessary signs and the City, at its expense, shall provide the enforcement for the prohibition of on-street parking on that portion of CSAH 21 constructed under this project. No modification of the above parking restrictions shall be made without first obtaining a resolution from the County Board of Commissioners permitting said modification. 4 County Project No. SAP 70-621-09 City of Prior Lake County of Scott XI Neither the County, its officers, agents or employees, either in their individual or official capacity, shall be responsible or liable in any manner to the City for any claim, demand, action or cause of action of any kind or character arising out of, allegedly arising out of or by reason of the performance, negligent performance or nonperformance of the hereinbefore described maintenance, restoration, repair or replacement work by the City, or arising out of the negligence of any contractor under any contract let by the City for the performance of said work; and the City agrees to defend, save and keep said County, its officers, agents and employees harmless from all claims, demands, actions or causes of action arising out of negligent performance by the City, its officers, agents or employees. XII It is further agreed that neither the City, its officers, agents or employees, either in their individual or official capacity, shall be responsible or liable in any manner to the County for any claim, demand, action or cause of action of any kind or character arising out of, allegedly arising out of or by reason of the performance, negligent performance or nonperformance of the hereinbefore described maintenance, restoration, repair or replacement work by the County, or arising out of the negligence of any cOf!tractor under any contract let by the County for the performance of said work; and the County agrees to defend, save and keep said City, its officers, agents and employees harmless from all claims, demands, actions or causes of action arising out of negligent performance by the County, its officers, agents or employees. XIII It is further agreed that each party to this agreement shall not be responsible or liable to the other or to any other person whomsoever for any claims, damages, actions, or causes of actions of any kind or character arising out of, allegedly arising out of or by reason of the performance, negligent performance or nonperformance of any work or part hereof by the other as provided herein; and each 5 County Project No. SAP 70-621-09 City of Prior Lake County of Scott party further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising in connection with or by virtue of performance of its own work as provided herein. XIV It is furthe~ agreed that any and all employees of the City and all other persons engaged by the City in the performance of any work or services required or provided herein to be performed by the City shall not be considered employees, agents or independent contractors of the County, and that any and all claims that mayor might arise under the Worker's Compensation Act or the Unemployment Compensation Act of the State of Minnesota on behalf of said City employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said City employees while so engaged in any of the work or services provided to be rendered herein shall be the sole responsibility of the City shall in no way be the obligation or responsibility of the County.
