EAGLE CREEK VILLAS, PROJECT 96-37.

INTRODUCTION:
The purpose of this agenda item is to approve the wetland
replacement plan for Eagle Creek Villas, Project 96-37.
BACKGROUND:
This project consists of 20, 2-unit buildings on 13.5 acres of
land located between Five Hawks Avenue and Duluth Avenue
northwest of STH 13. The preliminary plat for this project was
approved by the City Council on May 20th, 1996. The owner is
requesting permission to fill 17,928 square feet of a type 1 and 2
wetland located on the project. A mitigation plan has been
prepared which mitigates the filled wetland at a 2: 1 ratio 0
Approximately 75% of the replacement wetland will occur on-
site and the other 25% will be withdrawn from the developers
wetland bank. See attached copy of the letter explaining the

DISCUSSION:
The reason for the wetland fill on this project is that the project
building area consists of an east/west corridor located between
wetland on the north and the property line on the southo In order
to build a roadway between Duluth Avenue and Five Hawks
elementary school through this parcel, and meet setback
requirements, a portion of the existing wetland will need to be
filledo A Technical Evaluation Panel (TEP) meeting, made up
of representatives of the Soil and Water Conservation District,
Board of Soil and Water Resources and the City, was held to
discuss this project. This meeting was held to see if sequencing
requirements had been met and to comment on the overall
mitigation plan. The TEP recommendation was to approve the
mitigation pIano The Watershed District issued a permit for this
project on May 21, 1996 and have also approved of the plan. A
notice of application has been mailed out to various public
agencies. The comment deadline date was June 11, 19960 No
comments were received regarding the wetland impacts on this

project. The wetland impacts were mentioned at both the
planning commission and at the council meeting for
preliminary plat approval. No comments were received
regarding the impacts, either positively or negatively, at either.
of these meetings. Once the LOU decision is made the project
can commence.
A water quality pond is being built as part of this project to meet
Nationwide Urban Runoff Program (NURP) requirementso The
City, anticipating the reconstruction of Duluth Avenue, required
the developer to enlarge the NURP pond to treat the additional
impervious area from Duluth A venueo This enlargement of the
NURP pond will encroach in the wetland filling 6,105 square
feet.
ALTERNATIVES:
The alternatives are as follows:

RECOMMENDATION: Alternative No.1: Approve the Wetland Replacement Plan for
Eagle Creek Villas.
FINANCIAL IMPACT: The cost associated with approving the Wetland Replacement
Plan will be for the City's portion of the wetland fill. This cost
will be $3,800.00, which will be paid for out of the storm sewer
trunk reserve fundo Payment will be made when the developers
agreement is executed. There is sufficient money in this
account to pay for this project cost.

RESOLUTION APPROVING THE
WETLAND REPLACEMENT PLAN
FOR EAGLE CREEK VILLAS
PROJECT NO. 96-37

WHEREAS, the Technical Evaluation Panel (TEP) reviewed the preliminary wetland
replacement plan for Eagle Creek Villas on Wednesday, May 15th, 1996, and
recommends approval of this project; and
WHEREAS, sequencing criteria has been met; and
WHEREAS, approximately 17,928 square feet of type 1 and 2 wetland will be filled and
replaced at a 2: 1 ratio (35,856 square feet) with the following: 11,592 square
feet of new wetland, 15,154 square feet of wetland created as part of a water
quality pond and the remaining 9,110 square feet will be drawn from the
developer's wetland bank consisting of type 3 wetland; and
WHEREAS, the City has enlarged the water quality pond on this project to account for
future runoff from Duluth Avenue. This increase will fill 6,105 square feet of
wetland, due to berm constructiono
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
that the Wetland Replacement Plan for Eagle Creek Villas be approvedo
