Prior Lake, MN 55372-1714 RESOLUTION 04-38 RESOLUTION REQUESTING A VARIANCE FROM MUNICIPAL STATE AID STANDARDS FOR MAIN AVENUE, CITY PROJECT #04-01 WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, MOTION BY: PETERSEN SECOND BY: ZIESKA the Prior Lake City Council intends to let a construction project located on Main Avenue, from County State Aid Highway 21 (Eagle Creek Avenue) to approximately 850 feet north of Dakota Street, in the City of Prior Lake, Minnesota, which will entail street light replacement, curb and gutter improvements, sidewalk reconstruction and storm sewer improvements, making the area more pedestrian-friendly; and this portion of Main Avenue has an existing right-of-way width of 80 feet, which is also the approximate distance between buildings from one side of the road to the other; and the Average Daily Traffic (ADT) for this portion of Main Avenue is more than 3,000 vehicles per day, and striped 45 degree diagonal parking is currently allowed on both sides of the portion of Main Avenue, which is 58 feet wide from C.SA.H. 21 to 200 feet north of Dakota Street with variable width sidewalks; and the Prior Lake City Council proposes to reconstruct this portion of Main Avenue in the City of Prior Lake, Minnesota as a 58 foot wide roadway with 45 degree diagonal parking allowed on both sides of the roadway, and construct a minimum eight and a half foot wide sidewalk along this portion of Main Avenue, and allow planting of some trees in this part of Prior Lake's Downtown Area, and Minnesota Rules for State Aid Operations 8820.9961 require a minimum 14 foot width between the traffic lane and 20 foot parking stall depth when 45 degree diagonal parking is allowed on both sides of a roadway with current ADT over 3,000 vehicles per day; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The City Council does hereby request a variance to Minnesota Rules for State Aid Operations 8820.9961, so as to allow the reconstruction of Main Avenue as a 58 foot wide roadway from face to face of curb with 45 degree diagonal parking on both sides of the roadway between C.S.A.H. 21 and Dakota Street and to allow the reconstruction of Main Avenue as a 29 foot wide roadway from center of road to face of curb with 45 degree diagonal parking on one side of the roadway between Dakota Street and approximately 200 feet north of Dakota Street in Downtown Prior Lake, Minnesota, in lieu of the required 90 foot wide roadway and 45 foot wide roadway respectively. 3. That construction plans for this portion of Main Avenue in the Downtown Area of Prior Lake, Minnesota be submitted for approval by the State Aid for Local Transportation Office which include a Diagonal Parking Plan in the form of a cooperative agreement between the local R:\RESOLUTI\ENG&PW RES\2004\04-38.doc www.cityofpriorlake.com Phone 952.447.4230 / Fax 952.447.4245 road authority and the Commissioner of Transportation, which meets all other applicable standards required for approval by the State Aid for Local Transportation office. 4. That the City of Prior Lake, Scott County, Minnesota hereby indemnifies, saves, and holds harmless the State and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the granting of the variance. The City further agrees to defend at its sole cost and expense any action or proceeding begun asserting any claim of whatever character arising as a result of the granting of the variance. Nothing herein shall increase the liability of the City beyond the statutory limitation of MINN STAT 9 466 04, Subd. 1. 5. That the City of Prior Lake, Scott County, Minnesota hereby indemnifies, saves, and holds harmless Scott County and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the granting of the variarce. The City further agrees to defend at its sole cost and expense any action or proceeding begun asserting any claim of whatever character arising as a result of the granting of the variance. Nothing herein shall increase the liability of the City beyond the statutory limitation of MINN STAT 9 466 04, Subd. 1.
