INTRODUCTION:
Jennifer Ann Lambert of 4575 W. 139th St. Savage, MN
55378, is applying for a business and personal services license,
as is permitted on the City of Prior Lake application, to engage
in a massage therapy business. The business will be located at
Kaylyn's Coffee Shop and Tanning Salon in Priordale Mall.
Kaylyn's is in the B-3 zoning district. The City Code was
recently amended, at Ms. Lambert's request, to permit massage
therapy or therapeutic massage as a permitted accessory use in
specific zoning districts including the B-3 zoning district.
BACKGROUND:
The City Code Section 3-5-2 (A) and (B) requires two licenses,
a business license and a personal services license to be issued
by the City Council in order for an individual to operate a
massage business to perform massage services within the City.
City Code section 3-5 defines the contents of license
applications, qualifications and conditions of licensure for both
business and personal service licenses. As a prerequisite to
approval of the license Ms. Lambert will also need to meet the
building criteria required in Section 3-5-10 (Construction and
Maintenance of Premises), in the City's Ordinances.
Ms. Lambert originally requested that the City Council waive
her first year license fee of $250.00 recognizing that she has
paid a fee of $350.00 to have the zoning ordinance revised to
allow massage therapy in the B-3 district. Council voted to
deny the fee waiver request concerning Ms. Lambert's massage
therapy and business license fees.
DISCUSSION:
As required by Section 3-5-6 of the city ordinance, the City
Council conducted a public hearing on July 1, 1996 with no
objections from the public.
Ms. Lambert is applying for both a personal services license

and business license to engage in massage therapy. The Prior
Lake Police Department has investigated Ms. Lambert pursuant
to the information required on the application and fmds that
Ms. Lambert satisfies the criteria and recommends approval of
the licenses. Ms. Lambert has paid the investigation fee of
$100.00 and the Massage Therapy personal license fee of
$100.00. The License office is awaiting the business license
fee of$250.00 Ms. Lambert may not engage in massage therapy
at the location stated on her application unless the business is
also licensed.
ALTERNATIVES:
Staff recommends the following alternatives~
1. Approve the Massage Therapy license request contingent
upon Ms. Lambert meeting the Construction and
Maintenance code 3-5-10 provision of the City's Ordinance
concerning Massage Therapy and payment of the $250.00
business license fee.
2. Deny the Massage Therapy license request.
RECOMMENDATION:
Staff recommends the council follow alternative # 1. The
Building Department will follow-up with a premise inspection
at a later date to ensure that Ms. Lambert is in compliance with
all necessary building modifications.
