CONSIDER APPROVAL OF TIME EXTENSION FOR
PRELIMINARY PLAT APPROVAL OF NORTH
SHORE OAKS 5TH ADDITION

Mr. Gene Simpkins has submitted a request to extend the time
of preliminary plat approval for a piece of property which is
currently Outlot A, North Shore Oaks 5th Addition. This
property is part of the North Shore Oaks plat, which dates
back to the late 1970s. The preliminary plat of North Shore
Oaks 5th Addition was approved in 1987. This outlot, along
with a portion of an outlot west of Fisher Avenue, is the sole
remaining vacant land remaining in the 5th Addition.
The applicant wishes to proceed with a final plat for the
property but, because of ordinance provisions which have
changed since the preliminary plat was approved, the
applicant would have to modify the plat and in the process
would likely lose 2 lots.
Section 6-3-5 of the subdivision section of the Code provides
as follows;
For one year following preliminary plat approval and for 2
years following final plat approval, unless the subdivider and
the City agree otherwise, no amendment to the City of Prior
Lake's Comprehensive Plan or Subdivision ordinance shall
apply to or affect the use, development density, lot size, lot
layout, or dedication required or permitted by the approved

Dear Council Members,
I am the owner of Outlot A, North Shore Oaks 5th Addition along with my partners,
Douglas Farrell and Robert Farrell. A preliminary plat of the subject property had
been approved by the City of Prior Lake several years ago. The plat is comprised
of 13 single family lots. At this time we wish to move forward with final plat
approval of the project. City staff has informed us that the density requirements
have changed since this preliminary plat was approved. Lot sizes need to be larger
than previously required. City staff has also advised us that preliminary plats
approved within the last year are exempt from the new requirements and older plats
may not be subject to or affected by the new requirements if the City Council so
decides. Therefore, my partners and I are requesting a resolution by the City Council
to extend the period of time by which the subject plat is not affected by the new
subdivision regulations to such time that would allow final plat approval to move
ahead immediately.
This option has been expressly prOmulgated by City ordinances. There is reasonable
justification for this result. First of all, grading, design, engineering, and
surveying of the subject property has already occurred. To change in midstream
would raise the potential for significant additional expenses. Also, the lot
sizes approved in the preliminary plat conform to those lot sizes surrounding ~
Outlot A. Those lot sizes also, on average, conform very closely to the 12,000
square foot lots currently required. If the larger lot size is required, this will
be an 11 lot plat instead of 13, raising the individual lot prices substantially.
It appears that many higher priced lots are available in Prior Lake. A few cheaper
lots would give rise to Opportunities to more moderate income households.
In any event, my partners and I really appreciate your thoughtful consideration of
this ma t ter .
