INTRODUCTION:
Frank Muelken as legal representative for Margaret and Bill
Hannen has requested on their behalf an extension of time to
connect their property (15745 Ridgemont Ave. SE) to municipal
sewer and water utilities.
BACKGROUND:
The Hannen parcel was recently served with sewer and water
utilities by Project 95-01 as part of the overall Ridgemont Avenue
improvements in 1995. The assessment hearing was conducted and
the assessment roll adopted on October 2, 1995. Utilities were
available at that point in time for property owners to make
connection.
DISCUSSION:
Prior Lake City Code 9-4-3 and 9-5-4 (Connection to City's
System:) states "At such time as a Municipal water/sewer system
becomes available and within a one-year period, property served by
a private water/sewer system shall make a direct connection to the
public water and sewer system." Normally the one year period
commences with the date of assessment hearing at which time the
City Council approves the assessment roll. This date being October
2, 1995, the formal connection deadline would be October 2, 1996.
The B:annens are elderly residents who presently have their
property on the market for sale. As indicated within Mr. Muelken's
letter, the property will most likely be purchased on the basis of
subdividing the property for development purposes. There is the
possibility that the house may not remain in its present location,
therefore there is a hookup location uncertainty.

The City Council has on numerous past occasions granted one year
time extensions to property owners to connect to the municipal
system for virtually all forms of reasons ranging from financial
hardships to seasonal exemptions of cabins to storage arguments to
senior citizen age considerations. In the past the Council has been
very receptive to the initial issuance of an extension. Typically the
extension is for a one year time period. Subsequent requests usually
must be accompanied by exceptional circumstance preventing a

ALTERNATIVES:
property owner from immediate connection. Compliance has been
enforced by legal action on the part of the City. However, this is a
last resort response as hookup typically occurs on a voluntary basis
and such excessive legal expenses can be avoided.
The Council has the following alternatives:
1. Grant a one (1) year deferment for the purpose of connecting
the residential home located at 15745 Ridgemont Avenue to
municipal utilities no later than 10/2/97.
2. Deny the extension request as submitted.
RECOMMENDATION: Staff would recommend Alternative #1.
MOTION REQUIRED: Motion and second to grant a one (1) year deferment for the
purpose of connecting the residential home located at 15745
Ridgemont Avenue to municipal utilities no later than 10/2/97.

The property is currently on the market for sale and
due to the total size of the parcel, it will likely be
