RESURVEY OF BLOCK 1, CHATONKA BEACH

The Planning Department has received a request for approval
of a Registered Land Survey from Roy Stromme. The property
in question is located on the south side of Beach Street, just
south of the intersection of Chatonka Beach Trail and Beach
Street.
Mr. Stromme is in the process of registering his property via
the torrens system. He is requesting that the Council approve
this registered land survey.
The City treats an RLS as a final plat since it changes a
lengthy description to a specific RLS and tract number,
assigned by the Scott County Registrar of Titles. However, an
RLS is a subdivision or a plat that does not create any new
parcels; it is merely a pictorial representation of an existing
legal description.
The authority to require a Registered Land Survey lies with the
County Registrar of Titles. An RLS is often required in order to
provide a means of simplifying a complicated and lengthy
metes and bounds legal description. In these cases, it is often
better to substitute a drawing, or survey, and a simple tract
number for the lengthy description. There are no dedications
allowed in an RLS.
Section 6-8-1 of the Subdivision Ordinance outlines the City of
Prior Lake's requirements for an RLS. The section states that
"all registered land surveys shall be presented to the City

Council in the form of a final plat to be processed in
accordance with the standards set forth in this chapter for final
plats. Registered land surveys shall only show existing
property lines and easements and other existing features as
may be appropriate".
DISCUSSION:
This property is located along Beach Street and was originally
platted as Lots 1-4, Chatonka Beach, and Lots 7-13, Resurvey
of Block 1, Chatonka Beach. The original 11 lots have been
combined to create 5 parcels, each with a single family
dwelling.
In 1986, when the City rebuilt Beach Street, it was realigned to
the north. This created several small pieces of property. In
order to attach these pieces to the 5 parcels, a torrens action
was commenced, at which time the RLS was required.
ISSUES:
There are no real issues involved in this application. It is
important to remember that the RLS does not create any new
lots; its purpose is to simplify a legal description.
ALTERNATIVES:
1. Approve the RLS as requested.
2. Table or continue the request for specific information.

WHEREAS, the City Council reviewed this Registered Land Survey (RLS) on August
19, 1996, according to the procedures outlined in Section 6-8-1 of the
City of Prior Lake Zoning Ordinance;
WHEREAS, the City Council determined that the RLS does not create any new lots,
and is a pictorial representation of the metes and bounds description of
the three existing parcels;
NOW THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF PRIOR
LAKE, that it does hereby approve the Registered Land Survey submitted by Roy
Stromme as shown in the attached Exhibit A.
Passed and adopted this 19th day of August, 1996.

Dear Don:
Here is the Final Plat Application Form for the above Land
Registration and a check for $25.00.
This action became necessary after the city put in Beach
street in 1986. Prior to the construction of the new Beach
street, old Beach street was the private driveway shown on
Exhibit I. When new Beach street was built by the City, the City
wanted to eliminate the dog leg and straighten out the street.
This resulted in the street being moved further north as it
passed Lots 7-13 of the Resurvey of Block 1, Chatonka Beach,' and
Lots 1-4 of Chatonka Beach (the "South Lots").
After new Beach street was built, the southern boundaries
(and entire pieces) of the lots to the north of old Beach Street
(the "North Lots" are PL2-191, PL2-191D, PL2-191B, PL2-191A, and
179745) which had been at the north line of old Beach street,
were now to the south of new Beach Street.
After the construction of new Beach street, six small pieces
of the North Lots became located to the south of the new Beach
Street. See Exhibit II. The owners of these lots, Mary Gilbert,
Greg and Lori Engebos, and myself, after much discussion, agreed
that the separated pieces of the North Lots could be attached to
the north side of the South Lots, which we own, along with Mr.
and Mrs. Newstrom. Because there was no way to do this by deed
(we had no legal descriptions and could not create any), the
agreement was that we would solve the problem by a Torrens
action.
The Torrens action maintains the existing south, east and
west lines of the South Lots. Because the south line of New
Beach Street no longer is the north line of the South Lots, the
east and west lines of the South Lots are being extended and a

new north line for these lots is being established which is the
south line of new Beach street (see City of Prior Lake Road Plat
NO.1) .
That is the entire purpose of this Torrens action. By the
way, the whole problem could have been avoided if the City had
condemned a wider area for new Beach street.
