RECONSTRUCTION FOR 2004 IMPROVEMENT
PROJECT (CITY PROJECT #04-11)

Proposed street reconstruction improvements to Rutledge Street,
Red Oaks Road, Breezy Point Road, Adrian Circle, Bianca Circle,
Stefan Circle and Lakeview Circle (Proj ect #04-11) are included in
the approved 2004 Capital Improvement Program. Resolution 04-
11 ordering preparation of plans and specifications for the proj ect
was approved by the City Council on January 20, 2004.
A Public Informational Meetings was held on January 13, 2004 to
provide affected property owners an opportunity to discuss the
project. A Public Hearing was conducted on January 20, 2004. A
second open house meeting was held on March 3,2004. City staff
was in attendance to answer questions from the public. All of
these meetings were well attended.
Current Circumstances
This project includes storm sewer, sanitary sewer, water main,
concrete curb and gutter, aggregate base, bituminous surfacing, and
appurtenant work. The engineer's construction cost estimate is
$2,970,000. Indirect costs are estimated at 26%, and include
engineering (17%), administration (5%), and financing (4%) for a
total estimated project cost of $3,460,000. The construction of this
proj ect is proposed to be funded through assessments, tax levy, and
Trunk Reserve funds, Water Quality Funds, Capital Park Fund, and
Sewer and Water Funds.

Issues
Issues raised at the informational meetings included:
1. Access during construction is a major concern for the
residents in this neighborhood.
Response: We share resident concerns and have therefore
put together an access, egress and communication program
which we shared at the last neighborhood meeting. We will
review that program with the City Council on March 15th.
2. Certain residents oppose the proposed sidewalk on
Rutledge Street from the park entrance to W atzl' s Point.
Response: Rutledge Street collects traffic for almost 100
homes. Lakefront Park has its own network of trails and
sidewalks. The proposed sidewalk makes an important
connection on the park's north perimeter. We believe the
sidewalk is warranted.
3. A resident was concerned about the 26% indirect costs
attributed to the proj ect.
Response: Without these administrative fees, all taxpayers
would be called upon to pay for the staff time for a proj ect
benefiting a small segment of the community. By ch~ing
the 26% indirect costs, the benefiting properties pay for the
staff time required to administrator the proj ect.
Administrative costs for virtually every city street
reconstruction have been paid for in this fashion.
4. Other individual design issues have been discussed and
resolved.
Response: A wide variety of issues have been resolved
through individual conversations and neighborhood
meetings.
The following table is a breakdown of the estimated project costs:

The estimated assessment rate for this proj ect based on the
Feasibility Report is $8,278 per unit.
Plan modifications may reduce the proj ect cost for certain elements
of design.
Conclusion
The staff will provide a brief summary of the plans and
specifications.
The staff recommends the City Council approve the proj ect plans
and specifications and authorize advertisement for bids for the
2004 Improvement Project #04-11, Rutledge Street, Red Oaks
Road, Breezy Point Road, Adrian Circle, Bianca Circle, Stefan
Circle and Lakeview Circle. The actual amount of the special
assessments will be based upon actual project costs. When the
City advertises for bids, there is always a provision in the bid
documents specifying the City Council reserves the right to reject
all bids. The City Council has in the past, rejected bids on projects
where the bids exceeded the Engineer's estimate or were otherwise
unfavorable for the City.
FINANCIAL IMPACT:
The total cost of this year's projects are estimated to be $3,460,000
and will be recovered through special assessments, Sewer &
Water, Water Quality, Capital Park, and Trunk Reserve funds in
addition to tax levy. The table below outlines the project costs
based on the engineer's estimate.

The alternatives are as follows:
1. Adopt a resolution approving plans and specifications for
Project #04-11, 2004 Improvement Project, including Rutledge
Street, Red Oaks Road, Breezy Point Road, Adrian Circle,
Bianca Circle, Stefan Circle, and Lakeview Circle and
authorizing advertisement for bids.
2. Deny this item for a specific reason and provide staff with
direction.
3. Defer this item until some future date.
Motion and second adopting a resolution approving plans and
specifications for Proj ect #04-11, 2004 Improvement Proj ect,
including Rutledge Street, Red Oaks Road, Breezy Point Road,
Adrian Circle, Bianca Circle, Stefan Circle, and Lakeview Circle

A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS
AND AUTHORIZING THE ADVERTISEMENT FOR BIDS
FOR 2004 IMPROVEMENT PROJECT #04-11
FOR THE CITY OF PRIOR LAKE, MINNESOTA

WHEREAS, pursuant to Resolution 04-11, adopted on January 20,2004, the City Engineer
has prepared plans and specifications for the street reconstruction
improvements to Rutledge Street, Red Oaks Road, Breezy Point Road, Adrian
Circle, Bianca Circle, Stefan Circle and Lakeview Circle (City Project #04-11).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA that
1. The recital set forth above is incorporated herein.
2. Such plans and specifications, a copy of which is attached hereto and incorporated by
reference herein, are hereby approved.
3. The City Manager shall prepare and cause to be inserted in the official paper and in the
Construction Bulletin an advertisement for bids for the making of the improvement
pursuant to the attached plans and specifications. The advertisement shall be published
not less than 21 days prior to bid opening, shall specify the work to be done, and shall
state that the bids will be received by the City Manager until 11 :00 a.m. on Friday, April
15th, 2004, at which time the bids will be publicly opened at City Hall at 16200 Eagle
Creek Avenue SE by the City Engineer. No bids will be considered unless sealed and
filed with the City Manager and accompanied by a cash deposit, cashier's check, bid
bond, or certified check payable to the City of Prior Lake in the amount of five (5) percent
of the amount of such bid.
4. The City reserves the right to reject any and all bids for any reason as determined solely
by the City Council.

NOTICE IS HEREBY GIVEN that sealed proposals will be received by the City Council of the
City of Prior Lake, Minnesota at the Prior Lake City Hall, located at 16200 Eagle Creek Avenue
S.E., Prior Lake, MN 55372 until 11:00 a.m. local time, on the 15th day of April, 2003, and
will be publicly opened at said time and place by two or more designated officers or agents of the
City of Prior Lake, said proposals for the furnishing of all labor and materials for the
construction, complete in place of the following:

The Bids must be submitted on the bid forms provided in accordance with contract documents,
plans, and specifications: as prepared by the City of Prior Lake Engineering Department, 16200
Eagle Creek Avenue S.E., Prior Lake, MN 55372. Contract documents, plans, and specifications
may be obtained from Prior Lake Engineering Department by calling (952) 447-9830. Copies
may be obtained upon deposit of Seventy five dollars ($75.00) non-refundable deposit per set.
No bids will be considered unless sealed and filed with the City Manager of Prior Lake and
accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City
of Prior Lake, for five (5%) percent of the amount bid to be forfeited as liquidated damages in the
event that the bid be accepted and bidder shall fail to enter promptly into a written contract and
furnish the required bond.
