HomeMy WebLinkAbout92-18 RESOLUTION 92-18 A RESOLUTION OF THE CITY OF PRIOR LAKE APPROVING DEVELOPMENT DISTRICT NO. 2 PURSUANT TO MINNESOTA STATUTES, CHAPTER 469 MOTIONED BY KEDROWSKI SECONDED BY SCOTT WHEREAS, it is desirable and in the public interest that the City of Prior Lake (hereinafter the City) undertake and carry out a development program, pursuant to Sections 469.124 to 469.134 of Minnesota Statutes, encompassing the area which is more particularly described on Exhibit A attached hereto and made a part hereof, (which area is herein called Development District No. 2 or the Development District); and WHEREAS, the City Council has reviewed "Development District No. 2, dated January 24, 1992" (herein called the Plan Booklet), which sets forth a development program for the Development District; and WHEREAS, the Board of Commissioners of Scott County, Minnesota, has been notified of the public hearing for the review of the Plan Booklet; and WHEREAS, the School Board of Independent School District No. 719 has been notified of the public hearing for the review of the Plan Booklet; and WHEREAS, the Cit~'s Planning Commission has been consulted with concernlng the formation of the Development District; and WHEREAS, the City Council has received and considered the comments of the Board of Commissioners of Scott County, the School Board of the Independent School District No. 719, and the City's Planning Commission respecting the contents of the Plan Booklet; and WHEREAS, the City Council on April 20, 1992 after having published a notice of public hearing in the official newspaper of the city, conducted a public hearing on the Plan Booklet and received public comments on the same. 4629 Dakota St. S.E., Prior Lake, Minnesota 55372 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPIDYER NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA, as follows: 1. It is hereb~ found that there is a need for the Project activities 1n Development District No.2. 2. It is hereby found that Development District No.2 is an area "already built up" within the meaning of section 469.124 of Minnesota Statutes for the following reasons: a. The vicinity of the Develo~ment District is urban. Existing land uses in the viclnity include residential and industrial. zoning in the vicinity corresponds to the land use pattern. b. City sanitary sewer, storm sewer and water lines are in the vicinity. A 1988 city engineering report determined that sanitary sewer and water could be extended to serve the area. c. The Development District abuts County Road 21. County Road 21 is proposed to be a major arterial linking Prior Lake to Interstate 35. d. The city's comprehensive plan has designated the Development District as a business/office/industrial park area. An amendment, under current consideration, to the city's zoning code will designate the Development District as an industrial area. 3. It is hereby found that the development program set forth in the Plan Booklet will carry out the objectives of Development District No. 2 by assisting the development of an industrial park thus creating employment opportunities, enhancing the tax base and improving the general economy of the area. 4. That the development program as set forth in the Plan Booklet, having been duly reviewed and considered, is hereby approved, and the area described in Exhibit A hereto is designated as a development district pursuant to Section 469.126, Subd. 1, of Minnesota Statutes. 5. That the City Council designates the City Manager to act as administrator of the Development District. 6. That the City Council, acting pursuant to Section 469.132 of Minnesota Statutes, declines to appoint an advisory board for the Development District. 7. That the City states the environmental controls to be applied in connection with the execution of the development program shall consist of the applicable ordinances of this City, and the applicable provisions of Minnesota Statutes. 8. That the City will provide for the relocation of all persons who would be displaced by the proposed Development District prior to displacement unless they desire otherwise. 9. That the Cit~ Manager is hereby directed to file a copy of this resolut1on and a copy of the Plan Booklet with the Minnesota Department of Revenue. BE IT FURTHER BE RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE MINNESOTA, that Resolution 92-18 will approve Development District 92-18 pursuant to Minnesota Statutes, Chapter 469.
