RESOLUTION 92-34 APPROVING THE MEMORANDUM
OF UNDERSTANDING BETWEEN THE METROPOLITAN COUNCIL
AND THE CITY OF PRIOR LAKE

WHEREAS, the city of Prior Lake
Assessment Worksheet (EAW)
guidelines established by
Board (EQB); and
WHEREAS, on September 30, 1992 after reviewing all of the agency
comments, the Prior Lake City Council adopted Findings
making a Negative Declaration on "The wilds's" EAW; and
submitted an Environmental
for "The wilds" per the
the Environmental Quality
WHEREAS, the Metropolitan Council is requesting additional
information regarding Prior Lake's Negative Declaration
and requesting the City enter a Memorandum of
Understanding on the EAW; and
WHEREAS, the Minnesota Pollution Control Agency (MCPA) in its
comment letter, dated September 24, 1992, stated that
"...the staff does not believe the project has the
potential for adverse environmental impacts and,
therefore, does not recommend the preparation of an
Environmental Impact Statement (EIS)."; and
WHEREAS, the Minnesota Department of Transportation in its
comment letter, dated 16 September, 1992, stated that
"taken alone, the golf course development will not have
a significant impact on the current traffic situation";
and,
WHEREAS, the Minnesota Department of Natural Resources in its
comment letter, dated August 31, 1992, stated that "The
golf course appears to have been designed to avoid most
wetland impacts. Grading and filling appears to be at a
minimum given the size of the site. No shoreland or
flood plain issues are apparent...from a natural
resources perspective, it appears this project does not
require an Environmental Impact statement (EIS)"; and,
WHEREAS, the U.S. Army Corps of Engineers in its comment letter,
dated September 14, 1992, stated that "the work proposed
at the location stated is not within the regulatory
jurisdiction of the Corps of Engineers, if no dredged or
fill material will be placed in the water of the United
States, including wetlands."; and

WHEREAS, the City of Prior Lake takes a strong position that,
based on the comments from all agencies that the
Negative Declaration was appropriate and consistent with
the Environmental Quality Board's guidelines; and
WHEREAS, the city of Prior Lake is entering into this Memorandum
of Understanding with the Metropolitan Council in an
effort to maintain a positive working relationship; and
WHEREAS, The Memorandum of Understanding in no way suggests that
the Cit~ acted inappropriately in the Negative
Declaratlon, but acted in the spirit of resolving the
issue amicably.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND
PRIOR LAKE, MINNESOTA, that the Memorandum of
hereby approved.
BE IT FURTHER BE RESOLVED, that this Resolution be
contemporaneously with the minutes of the October
Council meeting.
