Historv: IVEX, LLC is requesting a Zoning Map
Amendment to change the use district from R-2 (Low-
Medium Density Residential) to C-3 (Specialty Retail)
on property located at 4616 Colorado Street SE. The
property is designated C- TC on the 2020
Comprehensive Land Use Plan Map.
On February 2, 2004, the City Council approved a
resolution amending the 2020 Comprehensive Land
Use Plan Map to designate the subject property C- TC
(Town Center Commercial). The Metropolitan Council
deemed the amendment consistent with the regional
plan on February 18, 2004.
On March 8, 2004, the Planning Commission held a
public hearing on this item, and unanimously
recommended approval of the rezoning request. The
Commission supported the change because it is
consistent with the land use designation on the 2020
Comprehensive Land Use Plan Map. A copy of the
meeting minutes is attached.
Current Circumstances: A single family dwelling,
constructed in 1920, occupies the site. The property is
currently zoned R-2 (Low-Medium Density Residential).
A single family dwelling is a permitted use in the R-2
use district. The property abuts both CSAH 21 and

Colorado Street. However, access is provided only via
Colorado Street. The following are the physical
characteristics of the subject property.
Total Site Area: The parcel is 9,616 square feet (.22
acres) in area.
T opooraphv: The property is flat with little elevation
change, except for the elevation change along CSAH
21 to the north.
VeQetation: The site contains minimal vegetation.
Wetlands: There are no wetlands located on the site.
Access: Current access is provided from Colorado
Street.
Adiacent Zonino and Land Use Plan desionations: The
following table details adjacent zoning and
comprehensive plan designations:

Issues: The applicant is proposing to remove the
existing dwelling and construct an office building on the
site. In order to permit the commercial use, the zoning
map must be amended to be consistent with the C- TC
land use designation on the 2020 Comprehensive Land
Use Plan Map. Thus the applicant is requesting the
property be rezoned from R-2 to C-3. The C-3 use
district is consistent with the C-TC comprehensive plan
land use designation.
"The purpose of the 'C-3' Specialty Use Business Use
District is to provide for a variety of commercial and
residential uses within . the framework of a traditional
downtown area." Permitted uses in the C-3 use district
include retail, offices, services, hotels/motels, and
showrooms.

Zonina Ordinance Amendment Findinas
Section 1108.600 of the Zoning Ordinance identifies the
following policies for amendments to the Official Zoning
Map:
· The area, as presently zoned, is inconsistent with
the policies and goals of the Comprehensive Plan, or
the land was originally zoned erroneously due to a
technical or administrative error, or
· The area for which rezoning is requested has
changed or is changing to such a degree that it is in the
public interest to rezone so as to encourage
redevelopment of the area, or
· The permitted uses allowed within the proposed Use
District will be appropriate on the subject property and
compatible with adjacent properties and the
neighborhood.
The current R-2 zoning of the property is inconsistent
with the C- TC land use designation on the 2020
Comprehensive Land Use Plan Map. The proposed C-
3 zoning is the only zoning use district consistent with
the C- TC designation. Accordingly the requested
zoning map amendment will carry out the goals,
objectives, and policies set forth in the comprehensive
plan.
CONCLUSION:
In conclusion, the applicant is requesting a Zoning Map
Amendment to allow the property to be rezoned from R-
2 to C-3. The proposed use district is consistent with the
2020 Comprehensive Land Use Plan Map. Based upon
the findings set forth in this report, the Planning
Commission recommends.approval.
ALTERNATIVES:
The City Council has two alternatives:
1. Adopt an ordinance approving the rezoning as
requested.
2. Defer consideration of this item and provide staff
with specific direction.

AN ORDINANCE AMENDING SECTION 1101.700 OF PRIOR LAKE CITY
CODE AND THE OFFICIAL ZONING MAP FOR THE CITY OF PRIOR LAKE

The City Council of the City of Prior Lake does hereby ordain:
1. The Prior Lake Zoning Map, referred to in Prior Lake City Code Section
1101.700, is hereby amended to change the zoning classification of the
following legally described property to C-3 (Specialty Retail).
LEGAL DESCRIPTION:
Lots 13 and 14 and the West 12 feet of Lot 12, Block 13, ADJUDICATED
AND REVISED PLAT OF LOTS 1 THROUGH 16, BLOCK 13, AND LOTS 1
THROUGH 13, BLOCK 15, OF THE VILLAGE OF PRIOR LAKE, Scott
County, Minnesota.
This ordinance shall become effective from and after its passage and publication.
Passed by the City Council of the City of Prior Lake this 5th day of April, 2004.

Proposed Amendment to the Zoning Map
Back2round
IVEX, a locally owned and operated business specializing in real estate investment,
management, and mortgage services, is interested in building a multi-purpose office
building in the downtown Prior Lake area. Specifically, the location of interest is a
property currently owned by IVEX located at 4616 Colorado Street in Prior Lake with a
legal description of LOTS 13 AND 14 AND THE WEST 12 FEET OF LOT 12, BLOCK
13, ADJUDICATED AND REVISED PLAT OF LOTS 1 THROUGH 16, BLOCK 13,
AND LOTS 1 THROUGH 13, BLOCK 15, OF THE VILLAGE OF PRIOR LAKE,
SCOTT COUNTY, MN. In support of this development project, IVEX would remove
the structure currently located on the property.
IVEX feels this in an excellent location for a multi-purpose office building, creating a
win-win scenario for all parties, for the following reasons:
· The location supports the City Council's initiative to enhance Prior Lake
downtown redevelopment activities.
· The location supports the 2020 Vision and Strategic Plan's desire to extend
downtown towards the lake.
· The proximity of the location to CR21 and potential intersection at Arcadia makes
the site both very visible and accessible.
· Development at this location brings new development to the south side of C21
which is important as we work together as a city to ensure that CR21 doesn't
divide downtown Prior Lake.
· The municipal City parking lot across the street (in addition to any potential on-
site parking) provides more than adequate parking availability.
Request
On February 2nd, 2004 the Prior Lake City Council approved a resolution amending the
2020 Comprehensive Plan Land Use Map to the C-TC designation for this property.
In support of this exciting development initiative, IVEX is requesting the City Council
approve an amendment to the Zoning Map to change the zoning for the property located
at 4616 Colorado Street, Prior Lake, MN from R-2 to C-3.

file in the office of the City Planning Department.

Comments from the Public:
Steve Sammis, of !VEX, LLC, stated IVEX was a locally owned company specializing in
real estate and mortgage services. They are looking forward to moving to the downtown
area and building a multi-purpose office building at 4616 Colorado Street.
The public hearing was closed.
Comments from the Commissioners:
Ringstad:
· The current zoning designation is inconsistent with the Comprehensive Use Plan.
The proposed zoning change is correct.
· Fully support the zone change.
Lemke:
· Agreed with Ringstad - The actual zoning must be brought in line with the
Comprehensive Plan.
· Support change.
Perez:
· Support the amendment. The use is consistent with the adjacent properties and
Comp Plan.
Stamson:
· Looked at this before. This is one of the steps in the process. We talked about
expanding the downtown and this makes sense.
· Support.
MOTION BY RINGSTAD, SECOND BY PEREZ, RECOMMENDING APPROVAL
OF A ZONING ORDINANCE AMENDMENT TO CHANGE THE ZONING OF THE
SUBJECT PROPERTY FROM THE R-2 TO C-3.
Vote taken indicated ayes by all. MOTION CARRIED.
This item will go before the City Council on April 5, 2004.
