This letter is submitted by the Minnesota Pollution Control Agency (MPCA) under authority of
Section 401 of the Clean Water Act (33 USC 1251 et seq.) and Minn. Stat. chs. 115 and 116.
The applicant proposes a project to be eligible for a nationwide permit as referenced above. The
project involves a proposal to reconstruct Mushtown Road and install storm sewer located in
N 1/2 Section 11, T 114 N, R 22 W, Scott County, Minnesota. The project will fill 0.16 acres of
wetland. Compensatory wetland mitigation will include a debit of wetland credit through the
Board of Water and Soil Resources (BWSR) Road Repair Mitigation Bank.

The MPCA certifies the referenced project since the project's individual and cumulative impacts
do not appear to be significant as defined by present water quality standards provided the
following two conditions are complied with:
1. Replacement of lost wetland functions and designated uses due to unavoidable wetland
impacts is necessary to satisfy Minn. R. 7050.0186, subp 6. The proposal to use a debit of
wetland credit through the Board of Water and Soil Resources (BWSR) Road Repair
Mitigation Bank may be acceptable; however, the applicant must fITst evaluate the
possibilities to replace important site-specific wetland functions by providing compensatory
wetland mitigation as a project specific mitigation with priority preference to being onsite
and in kind. If these opportunities do not exist, the use of the B WSR Mitigation Bank in
accordance with Minn. R. 8420 acceptable.
2. Best Management Practices (BMPs) to control erosion during construction must be
incorporated into all projects. Projects that will disturb five (5) or more acres of land are
required to apply to the MPCA for coverage under a General National Pollutant Discharge
Elimination System Pc.J.,U.l.it (NPDES) specifically requiring BMPs to control erosion during
construction, and a storm water management plan to manage pollutants in storm water runoff
from the site that will occur after construction is complete. The pc,uuit requires that these
BMPs be prepared for the project and incorporated into the plans and specifications prior to
the start of construction.

The Prior Lake-Spring Lake Watershed District (pLSL WD) has recently visited the project sites and identified an
area(s) where the projects are not in conformance with the PLSLWD's permit and District rules. Specific
concem(s) to be addressed from our inspection are as follows:
· 98.08: Provide silt fence west ofDnluth near DS16 (ditch to wetland) and along grading boundaIy east of
Duluth across from Priorwood Avenue. .
· 97.18: Site green and complete - forward certificate of completion to District office.
· 97.16: Construct outlet skimmer weir at Windstar Development wetland per stipulation to approved
plans. .
The District a}Jp~eciates your prompt attention to the above concem(s) and would like to see them addressed by
August 13, 1998. Soon thereafter, the District will again be visiting the project site to determine progress made.

discharged. This project involves paving an existing gravel road with pavement to City

Dear Mr. Leichty:
We have reviewed information about a project proposed by the
City of ~rior Lake to excavate, fill, and grade 0.16 acre of an
isolated wetland basin to facilitate the placement of a storm
sewer in conjunction with the reconstruction of Mushtown Road.
The project site is in the N 1/2 of section II, T. 114 N.,
R. 22 W., of Scott County, Minnesota.
The work is eligible for authorization under the Department
of the Army nationwide permits referenced by the numbers below,
provided the enclosed conditions are followed. However, because
the Corps considers Clean Water Act section 401 water quality
certification for these nationwide permits to have been denied by
the Minnesota Pollution Control Agency (MPCA), you must obtain a
section 401 certification from the MPCA to validate the
nationwide permits for the project. You may consider your
project authorized by the nationwide permits when you obtain a
section 401 certification or waiver from HPCA.

Upgrade of approximately 4,600 linear feet from two lane gravel to two lane curb and gutter with
sidewalk and associated storm sewer.
At their meeting on August 12, 1997, the Board of Managers considered the application for the above Project,
recommendations of District staff, testimony and other information presented at the meeting, and the following
exhibits submitted by the Permittee:
1) Permit Application dated July 21, 1997, received July 24, 1997.
2) Construction Plan: Storm Sewer and Street Improvement (Sheets 1-13 of 13) prepared by Howard R.
Green Company, dated July 2, 1997, received August July 24, 1997.
3) Wetland Report prepared by Howard R. Green Company, dated July 1997, received July 24, 1997.
4) Storm Sewer Calculations prepared by Howard R. Green Company, dated May 11, 1997 and August 5,
1997, received July 24,1997 and August 6, 1997, respectively.
5) Supplement to Watershed Permit Application prepared by Howard R. Green Company, undated,
received July 24, 1997.
6) Alternatives analysis letter prepared by Howard R. Green Company, dated and received August 11, 1997.

The Board found the above Project to conform with the District's Overall Plan and Rules, and ordered that this
Permit be issued, effective on the date shown below, SUBJECT TO THE GENERAL TERMS AND
CONDITIONS ON PAGE 2 AND THE SPECIAL CONDITIONS LISTED BELOW:
Plans to include:
1) addition of sump manholes at STMH 3 and STMH 9.
2) ~ddition of outlet skimmer at Wetland A (within the Windstar Residential Development).

PERMIT
GENERAL TERMS AND CONDITIONS OF PERMIT
1. All provisions of the Minnesota Watershed Act, Overall Plan and Rules of the District, and the General Conditions of the Permit Application,
are by reference made part of this Permit.
2. By acceptance of this Permit, Permittee acknowledges and agrees to perform and be bound by aU General and Special Terms and Conditions
of the issuance of this Permit.
3. The Permittee shall obtain all necessary permits and approvals from any other governmental entities with jurisdiction over the Project,
including, but not limited to, the U.S. Army Corps of Engineers, Board of Water and Soil Resources, MN Department of Natural Resources,
MN Pollution Control Agency, county, city and township zoning.
4. The Permittee shall construct the Project in accordance with the conditions of the Permit, applicable laws, ordinances and regulations of other
governmental entities with jurisdiction over the Project, and the plans and specifications outlined under the exhibits on page 1 of the Permit.
5. The Permittee shall not modify the Project or the Plans without the prior approval of the District.
6. Permittee will indemnify, defend and hold the District harmless from any claims for injury or damage resulting directly or indirectly from the
Project.
7. Before starting work on the Project, Permittee shall: (a) obtain and file with the District copies of any permits required by other govemmCi"bl
entities or agencies; (b) if required by the District (see Special Conditions), deposit with the District a financial security for an amount and on
terms and conditions acceptable to the Board; and c) notify the District of the date it intends to begin work, so that the work may be viewed
in progress.
8. It is the responsibility of the Permittee to provide all measures necessary to \AII.{Clin sediment on the site during construction. This may require
the use of erosion control measures not outlined on the erosion control plan. If this requirement is not met, the Permittee may be ordered to
provide additional erosion control measures if deemed n.. - -\' .sary by the District Inspector.
9. The Permittee grants to the District, and its agents, employees, officers and contractors, a license to enter the Project to perform any
inspections or work authorized by the Permit or any applicable law. The license shall expire after acceptance of the work by the District and
issuance of a Certificate of Completion.
10. A Certificate of Completion (PLSLWD Form 6) shall be filed with the District within 10 days after completion of the Project so that a final
inspection can be made to assure compliance with this Permit.
11. If the Project is not completed before the Permit expiration date, Permittee must apply for renewal of this Permit. If work on the Project is
under way, a time extension may be granted by the Board for good cause. Written request for a time extension is to be filed by the Permittee
at least 30 days prior to the expiration date. Work is not t" ",.. ,;tted without a valid Permit. If the Permit expires prior to the granting of an
extension, the guidelines established for a new permit application must be followed.
12. A transfer of this Permit without plan changes may be administratively approved upon receipt of a Permit Application fee and financial security
from the transferee. Any outstanding fees under the initial Permit must be paid in full before issuance of the transfer. Transfers with ptan
changes must follow the guidelines established for a new permit application.
13. Failure to ........ply with this Permit may result in one or more of the enfu.""ment actions specified in District Rule H.
14. If Permittee fails to comply with this Permit, the District may, at its option, perform any work necessary or incidental to cure the default.
Permittee shall promptly upon...;.:....and reimburse the District for any expense so incurred by the District, provided that the Permittee shall first
be given at least 48 hours written notice by certified mail, return receipt requested, of the work in default and the requirements to cure default.
In the event of an emergency, as determined by the District, the 48 hour notice requirement to Perm:U:.:. may be waived, and the Permittee
shall reimburse the District for any..:.:..,.. ':'i.sa so incurred in the same manner as if mailed notice has been given.
15. The District may draw against the security after any default by the Permittee in performance under this Permit, or if the Permittee fails to
replace any security prior to 30 days of its expiration, or if any of the work or other obligations of the Permittee under this Permit have not
been Completed at least 30 days prior to the expiration date specified on Page 1 of the Permit. All pr u ",.:..:."':s obtained from a draw on the
security shall be used to cure the defaults of the Permittee in performance of the Permit.
16. All notices required to be given shall be sent to the address specified on Page 1 of this Permit.
17. Permittee shall reimburse the District upon demand for cost or expense incurred by it to enforce this Permit, including court vu..,.l..,. and
reasonable engineering and attorney's fees.

B. Nationwide Permit:
12. utility Line Discharges. Discharges of dredged or fill
material associated with excavation, backfill or bedding for
utility lines, including outfall and intake structures, provided
there is no change in preco~struction contours. A 'utility line'
is defined as any pipe or pipeline for the transportation of any
gaseous, liquid, liquefiable, or slurry substance, for any
purpose, and any cable, line, or wire for the transmission for
any purpose of electrical energy, telephone and telegraph
messages, and radio and television communication. The term
'utility line' does not include activities which drain a water of
the United states, such as drainage tile; however, it does apply
to pipes conveying drainage from another area. This NWP
authorizes mechanized landclearing necessary for the installation
of utility lines, including overhead utility lines, provided the
cleared area is kept to the minimum necessary and preconstruct ion
contours are maintained. However, access roads, temporary or
permanent, or foundations associated with overhead utility lines
are not authorized by this NWP. Material resulting from trench
excavation may be temporarily sidecast (up to three months) into
waters of the United states, provided that the material is not
placed in such a manner that it is dispersed by currents or other
forces. The DE may extend the period of temporary side-casting
not to exceed a total of 180 days, where appropriate. The area of
waters of the United states that is disturbed must be limited to
the minimum necessary to construct the utility line. In wetlands,
the top 6" to 12" of the trench should generally be backfilled
with topsoil from the trench. Excess material must be removed to
upland areas immediately upon completion of construction. Any
exposed slopes and stream banks must be stabilized i~ediately
upon completion of the utility line. (See 33 CFR part 322).
Notification: The permittee must notify the district engineer in
accordance with the 'Notification' general condition, if any of
the following criteria are met:
(a) Mechanized landclearing in a forested wetland;
(b) A Section 10 permit is required for the utility line;
(c) The utility line in waters of the united States exceeds
500 feet; or,
(d) The utility line is placed within a jurisdictional area
(i.e., a water of the United states), and it runs parallel to a
streambed that is within that jurisdictional area. (Sections 10
and 404)

provided that the activity meets all of the following criteria:
a. The discharge does not cause the loss of more than 3 acres
of waters of the united states nor cause the loss of waters of
the United S~ates for a distance greater than 500 linear feet of
the stream bed;
b. For discharges causing the loss of greater than 1/3 acre
of waters of the United states, the permittee notifies the
District Engineer in accordance with the 'Notification' general
condition;
c. For discharges causing a loss of 1/3 acre or less of
waters of the united states the permittee must submit a report
within 30 days of completion of the work, containing the
information listed below;
d. For discharges in special aquatic sites, including
wetlands, the notification must also include a delineation of
affected special aquatic sites, including wetlands (Also see 33
CFR 330.1(e)); and
e. The discharge, including all attendant features, both
temporary and permanent, is part of a single and complete
project. Note, this NWP will expire on December 13, 1998.
For the purposes of this NWP, the acreage of loss of waters
of the United states includes the filled area plus waters of the
United states that are adversely affected by flooding, excavation
or drainage as a result of the project. The 3 acre and 1/3 acre
limits of NWP 26 are absolute, and cannot be increased by any
mitigation plan offered by the applicant or required by the
District Engineer. Whenever any other NWP is used in conjunction
with this NWP, the total acreage of impacts to waters of the
United states of all NWPs combined, can not exceed 3 acres.
Subdivisions: For any real estate subdivision created or
subdivided after October 5, 1984, a notification pursuant to
subsection (b) of this NWP is required for any discharge which
would cause the aggregate total loss of waters of the United
states for the entire subdivision to exceed 1/3 acre. Any
discharge in any real estate subdivision which would cause the
aggregate total loss of waters of the United states in the
subdivision to exceed 3 acres is not authorized by this NWP;
unless the District Engineer exempts a particular subdivision or
parcel by making a written determination that: (1) The individual
and cumulative adverse environmental effects would be minimal and
the property owner had, after October 5, 1984, but prior to
February 11, 1997, committed substantial resources in reliance on
NWP 26 with regard to a subdivision, in circumstances where it
would be inequitable to frustrate the property owner's
investment-backed expectations, or (2) that the individual and
cumulative adverse environmental effects would be minimal, high
quality wetlands would not be adversely affected, and there would
be an overall bp~efit to the aquatic enviro"ment. Once the
exemption is es Dlished for a subdivision. ;ubsequent lot
development by individual property owners may proceed using NWP
26. For purposes of NWP 26, the term 'real estate subdivision'
shall be interpreted to include circumstances wAere a landowner
or developer divides a tract of land into smaller parcels for the
purpose of selling, conveying, transferring, leasing, or
developing said parcels. This would include the entire area of a
residential, commercial or other real estate subdivision,
including all parcels and parts thereof.
Report: For discharges causing the loss of 1/3 acre or less
of waters of the United states the permittee must submit a report
within 30 days of completion of the work, containing the
following information:
(a) Name, address, and telephone number of the permittee;
(b) Location of the work;
(c) Description of the work; and,
(d) Type and acreage (or square feet) of the loss of waters
of the United states (e.g., 1/10 acre of marsh and 50 square feet
of a stream.) (Section 404)
Conditions Prescribed by corps Regulation:
Refer to the attachments for the conditions that are
applicable to all of the nationwide permits.
Nationwide Permit General Conditions
The following general conditions must be: followed .in order for any autho. ~tion by a NWP to be valid:
1. Navigation: No activity may cause mo~ than a miniTTl~1 adverse effect on navigation.
. 2 r l v~er Maintenance: Any' structure or fill authorized shall be properly maintained., including maintenance to ensure
public safety.
3. Erosion and Siltation Controls: App..........:ate __....~on and siltation controls must be used and maintaincdin dfective
operating condition during construction. and all exposed soil and other fills. as well as any work below the ordinary high
water mark or high tide line, must be pw.....ancnt1y stabilized at the earliest practicable date.
4. Aquatic Life Movements: No activity may substantially disrupt the movement of those species of aquatic life
indigenous to the waterbody. including those species which I1vlU~Y migrate through the Q.I.~ tmlcss the activity's
primary purpose is to impound water.
5. Equipment Heavy equipment worlcing in wetlands must be placed on mats. or other me~>;...) must be taken to
minimi7e soil disn1rbance.

been added by the Division Engineer (see 33 CFR 330.4(e)) and with any C3Se specific conditions added by the Corps

7. Wild and 3cenic Rivers: No activity may occur in a componenc of the National Wild and Scenic River System~ or

9 . Water Quality Certification: In certain states, an individual Section 40 1 water quality c--rtification must be obtained
or waived (see 33 LrK 3J0.4(c)).
10. Coastal Zone Management In certain states, an individual state coastal zone management consistency CODCt..,uW6CC
must be obtained or waived (see Section 330.4(d)).

Dear Mr. Almer:
This letter is intended to clarify . several issues which have been discussed on the above-
referenced project. It is the City of Prior Lake's intention to meet the water quality standards.
The City reviewed the possibility of constructing new NURP ponding for the Mushtown Road
project, early in the project development stage. This review focused on the amount of
impervious surface that would result from the project. It was noted that the Board of Water and
, . Soil Resources (BWSR) has a guideline for construCting NURP ponds whenever the impervious
surface exceeds 1.0 acres.
In reviewing the Mushtown Road project, it was noted that the project drains two directions from
the high point at station 24+00. It was determined that:
1. 1.03 acres of impervious surface drains northwesterly, which is being routed into
Wetland A near the Windstar Development.
2. 0.66 acres of impervious surface drains southeasterly, which is being routed into
Wetland D near the Woodridge Estates Development.
3. Approximately 100 LF of Mushtown Road will drain southeasterly according to pre-
existing drainage patterns. The northerly half of the street will ultimately drain to
Wetland A via existing overland flow patterns, and the southerly half of the street will
continue to drain easterly according to the existing drainage patterns. This drainage
quantity is insignificant enough that no adverse water quality should occur.

Options were reviewed regarding Area No. 1 drainage as follows:
1. Construct a new NURP pond, on the southerly side of Mushtown Road at station 10+00
within the township. This would require. a pond site as well as additional storm sewer
beneath Mushtown Road to provide an outlet from this proposed NURP pond to Wetland
A.

2. Provide a sump manhole at STMH 3 to collect settlements within the storm sewer
system prior to discharging to Wetland A.
The City reviewed both options carefully in making its decisions. Option A was determined to
be unfeasible due to the cost of construction, land acquisition, additional storms sewer cost, and
the site located in the township would require additional reviews. Option A was ruled out
because of the viability of Option B.
Option 8 was selected by the City to meet the water quality standards for many reasons, such
as:
· The existing wetland/ponding. area was being affected by the Windstar Development
which would degrade the wetlands to some degree.
· An outlet from Wetland A was being installed through the Windstar Development
which would ultimately discharge into the City Regional NURP pond. (see attached
plan).
· . A sump manhole could be constructed at STMH 3 to collect sediment.
It is my understanding that the Watershed will agree to utilize Option B if the following
improvements are included with the Mushtown project:
1. Install a sump at STMH #4, and
2. Install a skimmer at the outlet of Wetland A (see attached plan).
The City will process a change order to this project which will incorporate these requests from
the Watershed District.
O~tions for Drainage Area No. Z
Area 2 does not exceed the BWSR guidelines on NURP requirements. It was determined by
the City that utilizing Wetland D would exceed, BWSR guidelines by providing water quality
benefits. Please note that the Woodridge Estates storm sewer system discharges some storm
water to this wetland as well. In addition, a sump was provided at STMH 10 to collect sediment
before discharge.
It is my understanding that the Watershed District has requested the addition of a sump at
STMH 9. This will be included in the proposed change order that is being processed by the
City.
O~tions for Drainage Area No. 3
This drainage area is approximately 100 LF of paved surface at this time. It is not feasible, nor
warranted, to install any permanent water quality improvements at this time. Please note that
the north half of this street segment will drain through existing overland drainage patterns
toward Wetland D and the south half will continue to drain southeasterly via the existing grass
ditches. These overland drainage patterns will provide some water quality benefits by
encouraging sediments to settle in the vegetation.

Whenever Mushtown Road is improved, In the future, toward the southeast, the NURP and
water quality standards will need to be reviewed and incorporated by the CitylTownship in
charge of the future improvements.

I. Public Drainage Systems

C. No bridges or culverts will be installed as part of this project. A storm sewer
system will be constructed as part of this project. Refer to construction plans
for details on proposal storm sewer system
D. The Wetland Report indicates that wetlands Band D will be affected by
placement of fill over a total of 6,093 SF (O.14AC). This impact will occur on
the existing public right-af-way. The City has applied for a national wetland
permit from the Corps of Engineers, which is currently under review by Mr.
Gary Elfman. Preliminary discussions have been favorable to the issuing of
the permit.
In addition, it is the City position, as L.GU of the 1991 Wetland Act and
subsequent modifications, that this project is eligible for wetland mitigations
through the program being administered by the Board of Soil and Water
Resources (BSWR). The City will be contacting BSWR to enroll this project
in the program. This will provide mitigation of the wetland losses as required
by BSWR.
E. The discharges from the proposed Mushtown Improvement Project will be
subjected to water quality treatment. This treatment will occur with the
placement of a sump manhole prior to all discharges to the ponds and/or
wetland areas. In addition, the ponds! wetlands will further treat the storm
water runoff prior to discharge into the City's storm sewer trunk system.
Minor runoff that is not collected by the storm sewer system is being
discharged into existing vegetated swales which will provide some water
quality treatment.
II. STORMWATER MANAGEMENT PLAN
All drainage improvements on the Mushtown Road project are in compliance with the
City of Prior Lake's comprehensive storm drainage plan.
1.) Tributary and on-site drainage areas are shown in the attached hydraulic
analysis.
2.) See attached hydraulic analysis
3.) Delineations are shown in the attached report
4.) The storm sewer improvements planned for the Mushtown Road Project drain
into existing wetlands or ponds in accordance with the City's comprehensive
storm drainage plan. The City has had outlet structures incorporated into these
drainage features within the new developments that have been recently
constructed. The new developments were constructed in accordance with the
City comprehensive storm drainage plan. Reconstructing Mushtown Road as an
urban section road should reduce the runoff to the township portions of the
drainage area. Minor portions of Mushtown Road will continue to drain according
to the pre-existing drainage patterns.
5.) There are no flood plain losses anticipated on the Mushtown Road Project. The
wetland losses should have minimal impact on flood storage.
6.) The pond outlet structures were previously installed by others, in accordance
with the City of Prior Lakes comprehensive plan. Please contact Mr. Lani Leichty
at the City if outlet details are required.

The Dep&lu~ent of Natural Resources (DNR) is in receipt of your project notification for the Mushtown Road
Reconstruction project. The project will affect wetland(s) located in the north one half of Section 11, T114N,
R22W in Scott County. Based on our review of the notification fouu, data and maps of the area, we have
detwuillled that the wetland(s) are not under DNR protected waters pI;.U~~t jurisdiction and therefore the project
dQes nQ1 require a DNR p,,~u~t.
If construction involves dewatering in excess of 10,000 gallons per day or one million gallons per year, the
contractor will need to obtain a DNR Appropriation P"lU~t. You are advised that it typically takes 60 days to
process the p....u.uit application.
This letter is only a notification on the need for a DNR p....uuit for your proposed project. You should be aware

MUSHTOWN ROAD - CITY OF PRIOR LAKE
Dear Mr. Elftmann:
Enclosed please find a wetland report for the Mushtown Road project in the City of Prior
Lake. The project includes reconstruction of an existing street from a gravel surface to
pavement and curb and gutter. Storm sewer will also be constructed with this project. A
location map of the proposed project is included in the report.
Impacted wetlands will be mitigated to meet the Wetland Conservation Act requirements by
the wetland replacement provisions in the revised WCA. The reviewed WCA allows for
replacement by the Board of Water and Soil Resources for road reconstruction projects.
Total proposed wetland impact of this project is 6,903 square feet. Therefore, we understand
the project is eligible for Nationwide Permit 26, allowing for fill of up to 1/3 of an acre.
Construction of the project is proposed to begin this summer. Please review the enclosed
materials and let us know if you have any questions.
