1. ASSUMPTIONS
A. Holy Cross will grant easements for street as prepared by Scott County and the
City of Prior Lake
-75 feet CSAH 42
-75 feet Pike Lake Trail
B. Frontage and area charges based upon easements being provided.
2. City will extend sanitary sewer across CSAH 42 and extend the length of the property
along Pike Lake Trail and provide a sewer service stub to the property line.
The City understands that the church desires cO&upletion of the building by September 1,
1993. The City will make reasonable efforts to have the sewer available at that time. In
the event that the sewer is not available at that time, the City will not be liable for delays
caused.
3. Sanitary sewer, watennain and paving improvements will be adjacent to the property
along CSAH 42 & Pike Lake Trail in the future. Assessments and/or charges will be
based upon the rates and policies at that time.

6. To facilitate cash flow for the church in lieu of collecting the amount owed to the City up
front, the church will pay $4,000.00 prior to issuance of a building permit and the balance
by July 19, 1993. In the event that payment is not made by July 19, 1993, the City will
stop further building inspections and will not issue a Certificate of Occupancy.
7. City Staff will present this for Council approval at the June 21, 1993 Council Meeting.
The church will agree to this in writing prior to placing it on the Council Agenda.

THE CONSTITUTION OF HOLY CROSS lUTHERAN CHURCH
PRIOR LAKE, MINNESOTA
PREAMBLE
God requires that a Christian congregation shall conform to His divine Word in
doctrine and practice (ps. 119:105; Matt. 28:18-20; Gal. 1 :6-8; 2 Tim. 4:1-5; 2 Tim. 3:16-
17) and that all things be done decently and in order (1 Cor. 14:40; Col. 2:5).
Therefore we, the members of Holy Cross Evangelical Lutheran Church. accept and
(subscribe to the following Constitution and By-laws. in accordance with which all
spiritual and material affairs of our congregation shall be governed.
ARTICLE I - NAME
The name of this congregation shall be: Holy Cross Evangelical Lutheran Church of
the Unaltered Augsburg Confession, located at Prior Lake, Minnesota.
ARTICLE II - PURPOSE
IIhe purpose of this congregation shall be to serve the triune God through its members.
to seek the honor and glory of God, to carry out His will, to manifest the unity of our
faith in Jesus Christ as God and Savior. to spread the kingdom of God. to minister unto
its members. and to foster Christian fellowship and love, by the preaching of the Word
of God. by the administration of the Sacraments, and by the religious instruction of its
members. according to the confessional standard of the Evangelical Lutheran Church
(Article III).
ARTICLE 111- DOCTRINAL STANDARD
A. This congregation acknowledges and accepts all the canonical books of the Old
Testament and the New Testament as the inspired and revealed inerrant Word of
God, and submits to them as the only infallible authority in all matters of faith and
life.
B. This congregation acknowledges and accepts all the confessional writings of the
Evangelical Lutheran Church. contained in the Book of Concord of the year 1580.
as true and genuine expositions of the doctrines of the Bible. These confessional
writings are the three Ecumenical Creeds (Apostles', Nicene, and Athanasian). the
Unaltered Augsburg Confession. the Apology of the Augsburg Confession. the
Smalcald Articles, Luther's Large and Small Catechisms,. and the Formula of
Concord.

They shall see to it that all services are conducted in such a manner as to avoid
needless disturbance and to foster an attitude conducive to worship among those in
attendance and in accordance with Article III and IX of the Constitution.

The Board of Trustees shall consist of three members.
It shall be the duty of the trustees to administer all property belonging to the
congregation; to make contracts; accept grants and bequests; sign documents; appear
in court; in short, to transact all the business of the congregation assigned to them by
the Voters' Assembly.
On making emergency repairs and purchases, the trustees may spend an amount up
to $1,000.00 without direct authorization from the congregation.
The Board of Trustees shall serve as auditors. The Trustees shall hire all salaried lay
employees of the congregation.

The Board shall consist of three members. The Sunday School Superintendent and
Pastor shall be advisory members of the Board of Education.
The Board shall foster spiritual growth in the life of the members.
They shall seek to strengthen the Christian home and help equip parents, children,
and young people for Christian family living.
They shall encourage the congregation in setting up agencies and organizations to
help the parish best perform its educational task for each specific age level; namely,
y$unday School (from nursery through Bible classes), Pre-School, Christian Day
School, and Midweek School. To this end the members of the Board of Education
should visit the Sunday School classes to observe the congregation's programs in
action.
They shall assist in the selection of an adequate teaching staff for the education
organizations; have a representative attend teachers' meetings at least quarterly;
develop a teacher training and leadership education program.
They shall Review and appraise all educational needs in the parish, and plan for
improvements on the basis of such regular appraisals. 1<..
(The board shall appoint a Sunday School Superintendent who shall work with the
pastor, who has supervision of the Sunday School as an area of his responsibility. In
