It is our intent to continue this aggressive growth as we move into the next century. As the population grows in Scott County, we must continue to move forward with our businesses. This cannot be done alone. We must partner with our government agencies to help with location and road issues. Currently we arc remodeling our store in Jordan and building a new, grounds up, CUB Foods Store in the City of Shakopee. We want to thank our local government agencies for all their past support during our growth adventures. Currently in the City of Prior Lake, we operate a 39,000 square feet County Market supermarket. Plans arc now being made to expand this business. In order to do this we need our government agencies; Scott County, City of Prior Lake, and the State of Minnesota to make some road improvements in our area. The most urgent issue is the need for a stoplight at the intersection of Minnesota State Highway 13 and Five Hawks Avenue in the City of Prior Lake. We understand this may require Scott County to re-route County Road 23 to align with this intersection. At the time that we built our County Market in Prior Lake in 1992, the City of Prior Lake and Scott County governments insisted that we upgrade the entrance and street that we built between our property and McDonald's to the standards of a county road. They told us that it was their intention to reroute County Road 23 in the near future. We built the road as requested and deeded the necessary land to McDonald's, rebuilt their entrances to county specifications and deeded the necessary land to the City of Prior Lake. We have been patiently waiting for the traffic light for six years. Due to the urgent need for expansion and development at our County Market in Prior Lake location, we are requesting that you please review this issue with your staff and other public interests promptly so we can continue to move forward with our expansion plans. It is our intentions to expand our business as well as create additional retail space on our property west of our current location at 4105 Highway 13 SE. When we were building our County Market in 1992, we expressed the immediate need to install a stoplight at the intersection of Five Hawks Avenue and the entrance to our new County Market Store and the McDonald's restaurant to prevent accidents due to the increase traffic. The conclusion at that time was to install the stoplights as soon as Scott County Road 23 was realigned to intersect with Highway 13 at Five Hawks Ave. That decision was reached six (6) years ago. Since that time we have not seen any movement to have this road work accomplished. In 1992 when we were building our County Market, the City of Prior Lake and Scott County governments insisted that we upgrade the entrance and street that we built between our property and McDonald's to the standards of a county road. Since we opened our County Market, making left-hand turns onto Highway 13 for our customers and those residents using Five Hawks Avenue is very trying for everyone. There have been a number of accidents at that intersection, but fortunately none have included fatalities. Due to the urgent need to expand our current business and add to the retail climate of this city, we feel this can only happen successfully if this stoplight at Highway 13 and Five Hawks A venue is installed. We want this project to move forward quickly. FrOIn our review we have the following comments that pertain to sheet two (2) of nine (9) in the plans: 1.) Can B618 curb and gutter along the radii for the nOltheast nOlthwest quadrants be utilized on a roadway which exceeds 40 mph? 2.) Show the length of radii particularly in the nOltheast northwest quadrants for the concrete curb and gutter. 3.) The southeast and southwest quadrants have bitmninous paved curb rmnp for the signals: all the other signals in town have a concrete ralllp installed by MnDOT. I believe we should be consistent and put concrete versus bitUlninous there. 4.) No specifications were received by the City of Prior Lake in regards to this project. The City is interested in installing the signal as soon as possible recognizing the fact that winter is soon approaching us. We would like to proceed with finalizing the plans, obtaining cooperative agreement approval and bidding the project during the coming winter months. We would also like to start consu'uction as soon as possible in the spling, and put the signal in operation as early as we possibly can. Minnesota 55372 SUBJECT: T.H. 13 AT FIVE HAWKS AVENUE REQUEST FOR CONTRACT SUPPLEMENT Dear Mr. Anderson: This letter is a follow-up to our earlier conversations with Bruce Loney of your department regarding the additional work that was required to be performed by Strgar-Roscoe-Fausch, Inc. to establish need and priority ranking of this project with Mn/DOT in order to obtain their timely participation in this project. We also discussed with Bruce adding a signal interconnect system along T. H. 13 to those signal plans for Five Hawks. The added work that was performed to answer Mn/DOT's concerns was beyond that normally associated with the approval of a Signal Justification Report. While the intersection as it stands today, technically meets signal warrants, they felt it would not be of sufficient priority to justify their participation at this time. We therefore were requested by Mn/DOT, through Bruce, to provide the information they required regarding possible alternative intersection controls and the traffic impacts of the re-alignment of Scott County 23 to intersect T. H. 13 at the Five Hawks intersection. Performing these tasks required traffic analysis1 communication with Mn/DOT and attendance of a meeting at Mn/DOT' s Waters Edge Office. In the meantime1we also completed the intersection signal plans and sent them to you for review. We then began working to add the interconnect system to the project However, in early May we had reached a point where this added work has caused the project budget to be exceeded. In May we had billed you only to the extent of the original contract amount of $6,000. We continued working in order to keep the plans moving toward the earliest possible construction, but the point has come where we must reach agreement with you on this added work and add that amount as a supplement to our original contract. Results of the program adjustment process are attached. The adjustments were made in accordance with the prograra adjustment criteria letter dated 11ay 28, 1993 and State Transportation Investnlent Goals transmitted by the Office of Highway Progralnming. There were representatives from two Cities and one County as well as Metro Division State Aid, Traffic Engineering and Planning that participated in this process. The recommendations are listed on three separate charts: 1. Projects recommended for inclusion in State Fiscal Year 1994 (July 1, 1993 to June 30, 1994) . 2. Projects recommended for post fiscal year 1994 (after July 1, 1994). These projects will need to compete for State Fiscal Year 1995 programming at a later date. 3. Projects recommended to be removed from the agreements program. Some of these should be dropped completely, some are projects which should be programmed in other funding categories or utilize other funds such as MSA, CSA, MSA or CSA off system, local funds, turnback funds, Federal ISTEA funds, etc. After exploring other funds sources, these projects could be reconsidered for inclusion in the agreements program in 3. later fiscal ye~r. Some ideas have been captured in the COlnments column and local agencies are encouraged to contact the MnDOT project Inanager for further assistance. The projects recommended for FY '94 total over $4r...1 in State Funds. It has been further recornmended that the State Funds listed be considered as caps for these projects and that State participation not exceed these amounts. This will be written into the agreernents as they are prepared. Please keep in 111ind that these are recolnmendations from the Metro Division and they have been submitted to the Office of Highway Programming for approval. Perhaps the most radical changes are in the area of project selection and programming. In working with the A TP, Metro has agreed to prepare a candidate list which fits within the (AM) program set aside for FY 1995. The list will be submitted to the A TP and considered with other programs in developing a regional TIP, then STIP, etc. In short, in this A TP, Mn/DOT is to manage the AM program, in review of and supporting the MPO planning framework and agreed upon funding framework. The FY 1995 set aside is $4.9M for Metro. $5.04M estimated projects are currently on the Metro list of candidates. (To be considered a candidate a resolution requesting participation must be received by Metro, and a layout staff approved (if necessary); also, some signs of current progress and interest in the project.) A IT ACHMENT I (AM) Candidate Selection Categories & Criteria The strategy is to divide the projects into four categories, then answer key questions about the projects that will determine which projects will be candidates in the FY 1995 A TP process, and which will not be considered in FY 1995. The categories which follow have been developed In accordance with the overall regional philosophy of "preserve-manage-expand" . The evaluation criteria are used to help rank candidates within categories. The four cateeories are as follows: A. Preservation Replacement or rehabilitation of eXIsting infrastructure in presently poor condition. (Preservation driven projects may include other elements as well, but the primary justification of the project is existing infrastructure in poor physical condition). Projects may include resurfacing, bridge deck replacement of extremely deteriorated bridges, sewer separation, participation in public utility replacement, etc. B. Management Management driven projects will focus on managing existing infrastructure, and prevention of deterioration of safety, mobility, or physical condition. Projects may include low slump overlays to extend bridge life, access management, traffic management, signal or lighting installations, park & ride facilities, etc. C. Expansion Expansion driven projects will focus on serving the needs of expanding areas, either in terms of geographic expansion or land use density intensification. These projects serve wide area, sub-regional, or regional expansion needs and are not limited area or site specific needs. D. Mitigation of needs caused by site development This is a subset of expansion, however, these projects are permit actions with no state cost sharing. Proposals of this-type typically serve the needs of specific sites or single developer (development) impacts. Sites are usually less than one square mile and typically less than 160 acres.
