Prior Lake, Minnesota 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: April 19, 2004 AGENDA No.: 108 PREPARED BY: Bud Osmundson, Director of Public Works AGENDA ITEM: CONSIDER APPROVAL OF RESOLUTION REGARDING THE PRIOR LAKE SPRING LAKE WATERSHED DISTRICT PROPOSED OUTLET CHANNEL IMPROVEMENTS THAT: (1) RECOGNIZES THE PLSLWD AS THE RESPONSIBLE GOVERNMENTAL UNIT (RGU) FOR THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW), AND (2) APPROVE PAYMENT OF $5560 FOR THE EAW AS PART OF THE OUTLET CHANNEL IMPROVEMENT PROJECT. DISCUSSION: Historv: As you are aware, the PLSL WD has been planning improvements to the Prior Lake outlet channel for a number of years. These proposed improvements utilize environmental friendly designs in many p laces and more generally accepted designs i n 0 thers to improve the flow 0 f water through the channel and to eliminate erosion of the channel banks. The next step in the improvement process is to proceed with an Environmental Assessment Worksheet (EAW). The purpose of this agenda item is for the City Council to consider a resolution which would recognize the Prior Lake Spring Lake Watershed District as the Responsible Government Unit for the EAW and approve a payment to the District in the amount of $5,560 as the City's share of the cost of the EAW. Current Circumstances: The outlet channel has been in use since 1 983. I t requires substantial maintenance and reconstruction due to its use over the last 20 years. The estimated construction cost of the channel improvements is $3.5 million. The adopted 2004 - 2008 Capital I mprovement Plan has identified approximately $300,000 in capital expenditures by the City as our share of these improvements. The outlet channel construction and operation is guided by a Joint Powers Agreement (JPA) between the City, the City of Shakopee, and the PLSLWD. The PLSLWD has requested (letter attached) that the City formally recognize the District as the Responsible Governmental Unit or RGU for the EAW necessary for the channel improvement project. Since the District is the owner and operator of the channel, it only makes sense that they perform the work associated with, and be responsible for the EAW. www.cityofpriorlake.com X:\OSMUNDSON\STORM WATER s~pt!St~i ~~~~S RGU AND PAY EAW.DOC Since the EAW is a necessary part of the channel improvement project, it is also appropriate that the City participate in its cost. The District has an estimate of the cost for the preparation of the EAW from its consulting engineer (Wenk and Associates) in the amount of $25,500. The City of Shakopee had previously prepared the EA W for the northern half of the outlet channel at a cost of $30,138. The total cost of the EAW for the entire length of the channel is/will be $55,638. Per the J PA, the City's share of the cost is 100/0, or $5,560, which is the amount requested by the District. PLSLWD Administrator Shannon Lotthammer will be at the meeting to answer any questions the City Council may have regarding these issues. ISSUES: The issues before the City Council are whether or not to designate the District as the RGU for the channel improvement project and to pay the District the $5560. Staff recommends that the City Council act in a positive manner to both requests. The District has the expertise and is responsible for the outlet channel so it makes sense that the District be the RGU. It also makes sense that the City fund its share of the cost of the outlet channel improvements per the JPA. The JPA will be revisited and revised in the coming months. ALTERNATIVES: (1) Approve a Resolution that: (1) Recognizes the Prior Lake Spring Lake Watershed District as the Responsible Governmental Unit for the Environmental Assessment Worksheet for the proposed Outlet Channel Improvement project and (2) approves payment 0 f $ 5,560 as the City's share of the cost of the EAW.
