PROPERTIES

INTRODUCTION:
The purpose of this agenda item is to consider the acquisition of one property that has been forfeited to
the State of Minnesota due to non - payment of property taxes and /or special assessments.
Minnesota State Statute 462.356 provides that all proposed real property acquisitions be reviewed by
the Planning Commission for consistency with the 2030 Comprehensive Land Use Plan.
DISCUSSION:
Minnesota State Statute 282.01 addresses the classification and sale of forfeited properties. Scott
County Taxation Department notified the City on August 6, 2013 of this parcel that had been forfeited
to the State of Minnesota due to non - payment of property taxes. (See Exhibit A)

On August 26, 2013, the City Council approved a resolution to hold this parcel from public auction for
further consideration.
City Staff received the costs associated with this parcel that was held from public auction if we ac-
quired it for a public purpose which includes right of way, park, wetland, storm water or similar pur-
pose. The costs are as follows:

The need for acquiring this parcels was confirmed with the Director of Inspections /City Engineer and
the Director of Public Works /Natural Resources. The City currently does not have easements over
this property but requires access to maintain the wetland for storm water management.
The Planning Commission's function is to review the proposed acquisitions to determine their compli-
ance with the Comprehensive Plan. Section 2.2 "Goals, Objectives and Policies" of the 2030 Compre-
hensive Land Use Plan provides guidance on "public and private land use, development, redevelopment
and preservation of all lands and waters within the City." The objectives stated under the "Environmen-
tal and Natural Resource Protection" goal specifically provide for the conservation and preservation of
the natural environment, lakes and surface water.
A map for this parcel being considered has been included with this agenda report (See Exhibit A).
ACTION REQUIRED:
Motion and second to recommend acquisition of the tax forfeited property as the Commission deter-
mines.

Enclosed is a classification listing of rwn- conservation land located in your dty. The parcel
described in the listing forfeited to the State of Mnnesota due to non - payment of property taxes.
As required under Minn. Stat. 282.01, we request that you approve the parcel for pudic sale or
sale to adjacent owners or request a conveyance to your dty for public use.
We require a edified copy of the City Council Resolution authorizing any action taken. If you
request a parcel be conveyed to your dty, you must also complete the form "Application by a
Governmental Subdvision for Conveyance of Tax - Forfeited Land" and mail it to my attention in
this office.
Special assessments that were levied before the forfeiture do not need to be certified to t is
office. They were cancelled at forfeiture and may be re- assessed by the City after the property
is sold. Spedal assessments that are levied after the forfeiture should be coifed to this office.
Please be advised that if the City Council fails to respond within sixty (60) days of the date of this
letter, the sale will be deemed to be approved.
