Prior Lake, MN 55372 Attn: Bernie Re: Ansul Fire Suppression System Dear Bernie: We will be installing an Ansul R102 UL300 liquid fire suppression system at Hollywood Bar & Grill in Prior Lake. There will be 1 -8' hood with 1 12" x 12" exhaust riser and 1 -14' hood with 2 - 12" x 12" exhaust risers pant - legged into one exhaust fan. It will be a 6- gallon system mounted on the left end of the hood. The remote pull station will be located at a point of egress at the exit door on the right end of the hood. We will be using micro switches on the fire suppression system to shut off the makeup air, and keep the exhaust fan running in the event of system discharge. There will be a gas valve installed on the left end of the hood to shut of the gas to the cooking equipment in the event of a discharge also. The 8' hood will be protected using 1 -IN in the plenum and 1 -1100 to protect the 12" x 12" exhaust duct. Under this hood there will be a stacked pizza oven and 2- deep fat fryers that will be protected using 2 -230 nozzles positioned anywhere along or within perimeter of cooking surface and aimed to the center of the cooking area, with nozzle height above top of flyer 27" — 47 ". We will also be protecting the duct and plenum from the 14' hood with the first 3- gallon tank. There will be total of 10 flow points on this 3- gallon tank. Under the 14' hood section there will be a 36" char broiler protected with 2 -1N nozzles with nozzles being positioned anywhere along or within the perimeter of the maximum coking area and shall be aimed at the center of the cooking surface, with a nozzle height 15" — 40" above top of cooking surface. The 36" 6 -burner range will be protected using 3 -1F nozzles located over front edge of burner grate and oriented so nozzle tip flats are parallel with burner grate front to rear centerline and shall be aimed at the center of the cooking surface with a nozzle height of 40" — 48" above cooking surface. There are 2 -36" flat top griddles protected with 1 -1N nozzle over each griddle with nozzle located along any side of griddle surface within 0 -2" of cooking surface edge. Nozzle must be aimed at midpoint of cooking surface with nozzle height of 35" — 40" above cooking surface. Total flow points will be 7 on the second 3- gallon tank. There will be two detectors in the 8' hood and four detectors in the 14' hood. We will use 500 - degree fusible links in the detectors. This system will be installed per NFPA 96, NFPA 17A and manufacturers specifications. Dear Mr. Thomas, The Hollywood Bar and Grill restaurants heat and grease producing appliances, kitchen hood with duct system, ventilation system and fire suppression system for the kitchen hood are in violation with the 2007 Minnesota State Building Code (MSBC). In December of 2006, the Prior Lake Building Dept. had discussed with Ken LeCoeg from Restaurant Ventilation that a permit was required for a new Type I kitchen hood, ventilation system, fire suppression and designed by a State of Minnesota registered Mechanical Engineer and had to meet all present applicable codes. Late in the month of May 2007, Building Inspection Department staff noticed that a kitchen hood was setting in rear parking lot of your establishment. City staff subsequently was notified that a new kitchen exhaust hood had been added in your restaurant kitchen without the required permits. On June 4, 2007, I met on site with yourself, Mr. LeCoeg, Mark Houston, (a Mechanical Engineer), and Paul Selle (property management for potential sales client) to inspect the installation. I observed the following deficiencies: 1). Kitchen hood with duct system the kitchen hood requires a permit. Mechanical permit # 07 -0889 was issued on September 11, 2007 for the Type -I hood and was paid and picked up by Mr. LeCoeg from Restaurant Ventilation, on October 3, 2007. Action required: repair, rehabilitate or remove. 2). Ventilation system for the kitchen hood requires a permit. Specifications were submitted with Mechanical permit # 07 -0889. Action required: repair, rehabilitate or remove. 3). Fire suppression system for the kitchen hood requires a permit. The City has adopted the 2007 Minnesota State Building Code (MSBC) which adopts the 2006 International Building Code (IBC). The building is in violation of the following code items: ➢ MSBC 1300.0120 PERMITS. An owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert, or replace any gas, mechanical, electric, plumbing system, or other equipment, the installation of which is regulated by the code; or cause any such work to be done, shall first make application to the building official and obtain the required permit. ➢ MSBC 1300.130 CONSTRUCTION DOCUMENTS. Subp. 9. Design professional in responsible charge. C. Work regulated by the code shall be installed according to the reviewed construction documents, and any changes made during the construction that are not in compliance with the approved construction documents shall be resubmitted for approval as an amended set of construction documents. ➢ MSBC 1300.0180 UNSAFE BUILDINGS OR STRUCTURES. The building official may order any building or portion of a building to be vacated if continued use is dangerous to life, health, or safety of the occupants. The order shall be in writing and state the reasons for the action. All unsafe buildings, structures, or appendages are public nuisances and must be abated by repair, rehabilitation, demolition, or removal according to Minnesota Statutes, sections 463.15 to 463.26. ➢ MSBC 1346.0109 SECTION 109 AUTHORITY TO ORDER DISCONNECTION OF ENERGY SOURCES. IMC Section 109 is amended to read as follows: 109 Authority to order disconnection of energy sources. The building official shall have the authority to order disconnection of energy sources supplied to a building, structure or mechanical system regulated by this code, when it is determined that the mechanical system or any portion of the system has become hazardous or unsafe. Written notice of an order to disconnect service and the causes of the order shall be given within 24 hours to the owner and occupant of the building, structure, or premises, provided, however, that in cases of immediate danger to life or property, the disconnection shall be made immediately without notice. Where energy sources are provided by a public utility, the building official shall immediately notify the serving utility in writing of the issuance of an order to disconnect. ➢ MSBC 1346.507.17.1: CAPTURE AND CONTAINMENT TEST. The performance of the exhaust system shall be verified by a capture and containment test. ➢ MSBC 1346.508: MAKEUP AIR. Makeup air shall be supplied during the operation of commercial kitchen exhaust systems that are provided for commercial food heat - processing appliances. The amount of makeup air supplied shall be approximately equal to the exhaust air. A minimum of 80 percent of the makeup air shall be supplied into the space where the exhaust hood is located. The makeup air shall not reduce the effectiveness of the exhaust system. Makeup air shall be provided by mechanical means and the exhaust and makeup air systems shall be electrically interlocked to insure that makeup air is provided whenever the exhaust systems is in operation. ➢ IBC 903 [F] section: 903.2.12.2 COMMERCIAL COOKING OPERATIONS. An automatic sprinkler system shall be installed in commercial kitchen exhaust hood and duct system where an automatic sprinkler system is used to comply with Section 904. ➢ IBC 904: ALTERNATIVE AUTOMATIC FIRE - EXTINGUISHING SYSTEMS [F] 904.2.1 Commercial hood and duct systems. Each required commercial kitchen exhaust hood and duct system required by the International Fire Code or the International Mechanical Code to have a Type I hood shall be protected with an approved automatic fire- extinguishing system installed in accordance with this code. ➢ IBC 904.2.1 COMMERCIAL HOOD SYSTEM SUPPRESION. Each required commercial kitchen exhaust hood and duct system required by the International Fire Code or the International Mechanical Code to have a Type I hood shall be protected with an approved automatic fire- extinguishing system installed in accordance with this code. ➢ IBC 904.4.1 INSPECTION. Prior to conducting final acceptance tests, the following items shall be inspected: 1. Hazard specification for consistency with design hazard. 2. Type, location and spacing of automatic- and manual- initiating devices. 3. Size, placement and position of nozzles or discharge orifices. 4. Location and identification of audible and visible alarm devices. 5. Identification of devices with proper designations. 6. Operating instructions. ➢ IBC 904.11 COMMERCIAL COOKING SYSTEMS. The automatic fire - extinguishing system for commercial cooking systems shall be of a type recognized for protection of commercial cooking equipment and exhaust systems of the type and arrangement protected. Pre - engineered automatic dry- chemical and wet - chemical extinguishing systems shall be tested in accordance with UL 300 and listed and labeled for the intended application. Other types of automatic fire - extinguishing systems shall be listed and labeled for specific use as protection for commercial cooking operations. The system shall be installed in accordance with this code, its listing and the manufacturer's installation instructions. Automatic fire- extinguishing systems of the following types shall be installed in accordance with the referenced standard indicated, as follows: 1. Carbon dioxide extinguishing systems, NFPA 12. 2. Automatic sprinkler systems, NFPA 13. 3. Foam -water sprinkler system or foam -water spray systems, NFPA 16. 4. Dry - chemical extinguishing systems, NFPA 17. 5. Wet - chemical extinguishing systems, NFPA 17A. ➢ IBC 904.11.1 MANUAL SYSTEM OPERATION. A manual actuation device shall be located at or near a means of egress from the cooking area a minimum of 10 feet (3048 mm) and a maximum of 20 feet (6096 mm) from the kitchen exhaust system. The manual actuation device shall be installed not more than 48 inches (1200 mm) or less than 42 inches (1067 mm) above the floor and shall clearly identify the hazard protected. The manual actuation shall require a maximum force of 40 pounds (178 N) and a maximum movement of 14 inches (356 mm) to actuate the fire suppression system. Exception: Automatic sprinkler systems shall not be required to be equipped with manual actuation means. ➢ IBC 904.11.2 SYSTEM INTERCONNECTION. The actuation of the fire suppression system shall automatically shut down the fuel or electrical power supply to the cooking equipment. The fuel and electrical supply reset shall be manual. ➢ IBC 904.11.4 SPECIAL PROVISIONS FOR AUTOMATIC SPRINKLER SYSTEMS. Automatic sprinkler systems protecting commercial -type cooking equipment shall be supplied from a separate, readily accessible, indicating -type control valve that is identified. ➢ IBC 904.11.4.1 LISTED SPRINKLERS. Sprinklers used for the protection of fryers shall be tested in accordance with UL 199E, listed for that application and installed in accordance with their listing. ➢ IFGC SECTION 402 GAS PIPE SIZING. 402.1 GENERAL CONSIDERATIONS. Piping systems shall be of such size and so installed as to provide a supply of gas sufficient to meet the maximum demand without undue loss of pressure between the point of delivery and the gas utilization equipment. ➢ IFGC SECTION 411 APPLIANCE CONNECTIONS. 411.1 Connecting appliances. Appliances shall be connected to the piping system by one of the following: 1. Rigid metallic pipe and fittings. 2. Semirigid metallic tubing and metallic fittings. Lengths shall not exceed 6' feet and shall be located in the same room as the appliance. Semirigid metallic tubing shall not enter a motor - operated appliance through an unprotected knockout opening. 3. Listed and labeled appliance connectors installed in accordance with the manufacturer's installation instructions located in the same room as the appliance. 4. Listed and labeled quick- disconnect devices used in conjunction with listed and labeled appliance connectors. 5. Listed and labeled convenience outlets used in conjunction with listed and labeled appliance connectors. 6. Listed and labeled appliance connectors complying with ANSI Z21.69 and listed for use with food service equipment having casters, or that is otherwise subject to movement for cleaning, and other large movable equipment. ➢ IFGC 411.1.1 PROTECTION FROM DAMAGE. Connectors and tubing shall be installed so as to be protected against physical damage. ➢ 2001 NFPA 96 VENTILATION AND FIRE PROTECTION FOR COMMERCIAL OPERATIONS. Section 10.10 Portable fire extinguishers; reference NFPA -10. ➢ IMC SECTION 509 FIRE SUPPRESSION SYSTEMS 509.1 WHERE REQUIRED. Commercial food heat - processing appliances required by section 507.2.1 to have a type -I hood shall be provided with an approved automatic fire suppression system complying with the IBC and the IFC. ➢ Also permit # 07 -0010 for sink alteration requires a final inspection. The City would like to solicit your cooperation in correcting the violations as noted above. The City of Prior Lake is requiring that you repair, rehabilitate or remove the heat and grease producing appliances, kitchen hood with duct system, ventilation system and fire suppression system for the kitchen hood by November 12, 2007. If compliance to this order is not completed, the City will request that your gas energy supplier, Center Point Energy disconnect the gas energy supply to your building as per MSBC 1346.0109 section 109 AUTHORITY TO ORDER DISCONNECTION OF ENERGY SOURCE.
