AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION ADOPTING THE COUNTY
HIGHWAY 42 STUDY LAND USE AND TRANSPORTION PLAN, AP-
PROVING AMENDMENTS TO THE 2030 COMPREHENSIVE PLAN
DISCUSSION: Introduction
The purpose of this item is to complete the formal review process of amend-
ing the city's 2030 Comprehensive Plan related to the County Highway 42
Study Land Use and Transportation Plan completed by WSB & Associates
for submission to the Metropolitan Council for approval. On September 9,
the City Council requested staff to further evaluate whether the five Mixed
Use districts could be simplified and/or combined. �
Histo
A 6-month development moratorium was approved by the City Council per
Ordinance 113-05 on March 16 through September 16 to allow further study
of approximately 1,100 acres along the County Highway 42 corridor in Prior
Lake. In April and May the staff prepared a RFP and selected an engineer
to assist in this study. WSB and the City held an open house for property
owners on Tuesday, June 4. A joint meeting was also held on June 17 to
allow the city's consultant to provide preliminary conclusions on this corridor
to the City Council, Planning Commission and EDA. A final presentation by
WSB was given to the City Council at a Work Session on July 22 before
submitting its final report to the city.
Current Circumstances
City staff outlined a process to complete the full review and approval process
to include the Planning Commission, City Council and Metropolitan Council::
August 12 ... City Council resolution directing the Planning Com-
mission to conduct a public hearing.
August 20 ... Letter sent notifying adjacent communities/jurisdic-
tions.
August 21 ... Legal notice sent to newspaper for public hearing.
Sept. 3... Planning Commission holds public hearing.
Sept. 9... City Council considers WSB Report and Comprehen-
sive Plan amendments; extends the moratorium
through December, but removed some parcels from
moratorium.
Oct. 28 ... City Council reconsiders WSB Report and Compre-
hensive Plan amendments with simplified Mixed Use
districts.
Oct. 31 ... Submit application to the Met Council (assuming all
adjacent community responses have been received).
Dec. 31 ... 60-day review period by the Met Council ends (unless
further extended).
City staff and its consultant discussed and debated changing the five pro-
posed Mixed Use districts to one (or some number less than five). For ex-
ample, one Mixed Use district would have a common land use percentage
division as follows: (1) low density residential = 40%; (2) medium density
residential = 25%; (3) high density residential = 5%; and (4) commercial =
30%. Because each of the five geographic areas comprising 590 acres is
unique in terms of ownership, location/access and land character, staff is
proposing that they still remain in the text of the report and Comprehensive
Plan. A good reason for retaining the five area descriptions would be the
`South Vierling" property of 66 acres at the southeast corner of County High-
ways 21 and 42. Rather than this key commercial area supporting 25% me-
dium density, 25% high density and 50% commercial as originally proposed,
this area would be guided for less commercial and more single family resi-
dential. Staff also believes that it received strong support from property
owners to achieve the land use percentages for each of the five distinct ar-
eas (i.e., Vierling's and SMSC). In order to simplify the proposed land use
districts as directed by the council, staff is proposing the following changes:
1. The "Mixed Use" label would be changed to "Planned Use" to differ-
entiate the County Highway 42 corridor from other more traditional
high density, transit oriented mixed use areas in the Twin Cities.
2. On the Comprehensive Plan Land Use Map, only one Planned Use
designation (and color) would be shown.
3. In the Comprehensive Plan, text would still identify the expected ap-
proximate land use percentages for each of the five areas. They
would no longer be identified as individual Mixed Use districts, but
rather, subareas under one Planned Use District.
4. When addressing implementation of the Planned Use areas, the city
should require that a concept or general development plan must be
provided by any developer for each of the five subareas in order to
assure that final build-out conforms to the land use percentages.
The developer could proceed to develop property using a Planned
Unit Development (preferred), or a standard zoning district; either
way, a concept or general development plan must first be approved
by the city.
The first attachment provides an overall summary of the proposed changes
to the 2030 Comprehensive Plan, including conclusions related to land
uses, zoning districts and transportation. Unlike the 2030 Plan, further
recognition is being given to land that is owned by SMSC and land that is in
some type of public or semi-public use. Those same recognitions will likely
carry forth to all of Prior Lake when the city begins the 2040 comprehensive
planning process.

The second attachment provides the final report by WSB & Associates,
which becomes the basis for proposing amendments to the 2030 Compre-
hensive Plan. The consultant's analysis demonstrates that a plan amend-
ment is warranted due to changes in the community since 2005, including
such things as the County Highway 21 connection to CSAH 42, the elimina-
tion of previously approved plans such as Summit Preserve, additional land
acquisitions by SMSC, and the need to re-examine input from property own-
ers and the public due to recent economic changes.
The third and fourth attachments identify specific amendments proposed in
the 2030 Comprehensive Plan. These relate to two sections in the Plan, in-
cluding:
• Chapter 3. Land Use Element
• Chapter 5. Transportation
Conclusion
Staff will review proposed changes at the council meeting. If the City Coun-
cil is now comfortable with these modifications, it should approve the
amendments and forward them to the Metropolitan Council for its review
and approval.
ISSUES: In order to submit any proposed Comprehensive Plan amendments to the
Met Council for consideration this year, a decision will be needed by the City
Council. Staff has attempted to simplify the previous five Mixed Use dis- !,
tricts into one common (Planned Use) district, while at the same time, pre- '
serving the uniqueness of each area.
FINANCIAL By reducing the overall amount of land use designated for Commercial and
IMPACT: Business Park, the city may receive less in future property taxes. On the other
hand, the property may develop more quickly if the re-guiding more accurately
reflects the short and long term market needs and city desires.
ALTERNATIVES: 1. Motion and a second to adopt the 2013 County Highway 42 Study Land
Use and Transportation Plan, approve amendments to the 2030 Com-
prehensive Plan for immediate submission to the Metropolitan Council.
2. Motion and a second to deny adopting the study, approving the amend- �
ments, and/or extending the moratorium.
3. Motion and second to table action and request staff to provide additional
information as directed by the Council.

A RESOLUTION ADOPTING THE COUNTY HIGHWAY 42 STUDY LAND USE AND TRANSPROTATION
PLAN, AMENDING THE 2030 COMPREHENSIVE PLAN, AND EXTENDING AN INTERIM ORDINANCE

WHEREAS, The City Council approved the selection of WSB & Associates ("WSB") per Resolution No. 13-
054 on April 22, 2013 to complete the County Highway 42 Stutly Area Plan; and
WHEREAS, WSB has completed the final report, County Highway 42 Study Land Use and Transportation
Plan (the "Plan"), and proposed 2030 Comprehensive Plan amendments for Prior Lake; and
WHEREAS, A Public Hearing was held by the Planning Commission on September 3, 2013, which
recommended adoption of the Plan and corresponding amendments to the 2030
Comprehensive Plan ; and
WHEREAS, The City Council extended an Interim Ordinance No. 113-05 to December 31, 2013 in order to
allow sufficient time for jurisdiction review and Metropolitan Council approval.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council of Prior Lake adopts the County Highway 42 Study Land Use and Transportation Plan
dated October 22, 2013.
3. The City Council of Prior Lake approves amendments to Chapters 3(Land Use Element) and 5
(Transportation) of the 2030 Comprehensive Plan and authorizes city staff to submit such amendments
to the Metropolitan Council.
