At your request, a site visit wet conducted on August 24. 1999 to evaluate the subject lakeshore
property for the proposed construction of . singl. family residence. A certificate of survey. dated
August 18. 1999 was provided by you prior to the investigation.

of the lake Indicated on the survey at 902.1 feet, and at the same setback as the structure it replaces.
Based upon information provided withIn the certificate of survey. the topographic feature "top of bluff',
as defined by city ordinance. varies from the 928 to the 929 contour. Our findings indicate that the
proposed setback is within general compliance with the bluff Impact zone requirements.
A hand auger boring .conducted within the house pad area indicated a very stiff granular lean clay at
depth. We would anticipate that the proposed residence and any apPlutenant stnJctures are will lie In
competent bearing sail having Jow erosion characteristics. Based upon the data provided to us. and
our visuai observations, we were able to establish that the soil and general topography is acceptable
for the proposed construction and consistent with adjacent residences.
It is our further opinion that the proposed construction, includIng future patio and landscaping
improvements will not compromise any slope by imposing loads or unstable conditions that may affect
the safety of structures or slop... Also, the proposed site development including landscaping has
minimal affect on existing drainlg. and will not obstruct, damage, or adversely effect existing sewer or
drainage facilities, will nat adversely affect the qualities of storm water runoff, will not adversely affect
downstream properties, wetlands. or bodies of water or result in erosion or sedimentaticn.
Sensitive watershed areas require provision for erosion control. positive surface drainage and site
restoration in compliance with established engineering practices and city codes.
The aforementioned observations and oplnlons represent our recommendations for construction,
baled upon current building plans provided by you the owner. and compliance with Prior Lake
city codes and zoning ordinances.

Dear Ms. Gorshe:
An inspection was made of your property at 4253 Grainwood Circle. It appears
the stairs and landing to your front door are in violation of City Code Subsection
1102.405 Dimensional Standards: side yard setback 10 feet minimum. As you
explained to me on February 29,2000, you revised your plans because the finish
grade elevations did not match the building plan elevations as originally
proposed in the building permit application.
It will be necessary for you to update your certificate of survey to include the plan
changes in order for the City to determine if there is a setback violation, and if so,
to correct the violation by altering the stairs and landing to meet City Code. The
2nd option would be for you to apply for a Variance to keep the present setback,
this would require approval of the Variance by the Planning Commission.

RE: Front Entry Encroachment at 4253 Grainwood Circle
Dear .Mary,
This letter confirms the Planning Department's position regarding your encroaching
entryway on your recently built house. The survey indicates the posts for your entryway
to be located at the minimum required 10-foot setback. However, the survey and build~g
plans you submitted did not adequately address the fact that your front door is located !
approximately 6 feet above grade, therefore a stairs and landing is necessary. The City
recognizes this oversight. In order to readily resolve the situation and in the spirit of
cooperation, the Planning Department has det~uuined the minimum amount of
encroachment possible, to meet the Building Code, will be p~u.uitted without a variance.
This results in a three-foot wide landing and stairs encroaching on the side yard setback.
Should you choose not to reduce the size of the landing to three feet in width, a variance
will be required. Please let me know if you have any questions.

1. Mary Gorshe has applied for a variance from the Zoning Ordinance in order to pcuuit
the construction of a single family dwelling on property located in the R -1 (Suburban
Residential) District and the SD (Shoreland Overlay) District at the following
location, to wit;
Lot 9, Grainwood Park, Scott County, MN.
2. The Board of Adjustment has' review~d the application for variance as contained in
Case #99-024 and held hearings' thereon on May 10, 1999. The Planning
Commission received testimony from the applicant and from the public. After the
public hearing, the Planning Commission directed staff to prepare this resolution.
3. The Board of Adjustment has considered the effect of the proposed variances upon
the health, safety, and welfare of the community, the existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, the effect on property
values in the surrounding area and the effect of the proposed variances on the
Comprehensive Plan.

4. Because of conditions on the subject prop~~ tj and on the surrounding property, it is
possible to use the subject property in such a way that the proposed variances will not
result in the impairment of an adequate supply of light and air to adjacent properties,
unreasonably increase congestion in the public streets, increase the danger of fire, and
danger to the public safety, unreasonably diminish or impair health, safety, comfort,
morals or in any other respect be contrary to the Zoning Ordinance and
Comprehensive Plan.
5. The special conditions applying to the subject prop~~tj are unique to such property,
and do not generally apply to other land in the district in which such land is located.
The unique circumstances applicable to this property include the substandard lot size
and platting of the property prior to the adoption of a Zoning Ordinance by the City.
6. A structure of a reasonable size cannot be built on this lot without such variances.
7. The front yard setback variance is less than existing conditions on the lot. The
existing front yard setback is approximately 10 feet. The proposed structure will be
setback 20 feet from the front property line.
8. The bluff setback variance is no closer than the existing structure setback. The DNR
does not object to a 20-foot top of bluff setback. This keeps the structure out of the
bluff impact zone.
9. The granting of the variances are necessary for the preservation and enjoyment of a
substantial property right of the "pplicants. Without the variances, the lot cannot be
utilized for any single-family dwelling. The variances will not serve merely as a
convenience to the applicants, but are necessary to alleviate demonstrable hardship.
10. The contents of Planning Case 99-024 are hereby entered into and made a part of the
public record and the record of decision for this case. Pursuant to Section 5-6-8 of the
Ordinance Code the variances will be deemed to be abandoned, and thus will be null
and void one (1) year from the date of approval if the holder of the variances has
failed to obtain any necessary, required or appropriate pc;uuits for the completion of
contemplated improvements.
CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby grants and
approves the following variances to allow the construction of a single family dwelling yet
to be designed;
1. A 1,070 square foot variance to allow the lot area of 6,430 square feet for a lot to be
buildable rather than the required minimum lot area of 7,500 square feet.
2. A 5 foot front yard setback variance to p(;,u.uit a front yard setback of 20 feet rather
than the minimum required front yard setback of 25 feet; and

The following are conditions under which this variance is granted:
1. This resolution is to be recorded with the Scott County Recorder's Office. A building
pc.ul.lit cannot be issued on this property without proof of recording this resolution
pursuant to 5-6-8 of the City Code.
2. The building Pc.u...Jt for this lot can allow a 5 foot side yard setback on one side with a
minimuni 10 foot building separation, pursuant to the Zoning Ordinance in effect at
the time of variance application.
All of these conditions must be met prior to the issuance of the building p\J.lu.ait.
