The f�liowing regulatiotxs and conditions constitute a part of the application made by any i�tstallcr or contiactor for
the iz�stallation of utilities in any City street right-of-way or C�ty ntillty easement atyd ti�e appl[cant, En ma�ciug his ,
application to do such work, shall agree to abide by these r'egulatlons and conditions:
I. The individua] obtainin,g the permit shall, before commas�cing snch work, nati�y+ the City Engineer when
the work at each location is to r.ommence; and, wh�n rcquested by the En�ineer, shall submit plans and . �
specifications. •

3. "The �ublic is to !� protected by the individuaI, at all times, from !he commencement af the work uttt�l the
completian and accepta»ce by the Ciry. The installer or contractor sI�a21 so conduct his operador�s as to
� cause tlte minimum inconveniettee to tbe public. The installer or contractor shall furnish, erxt, and
maintain, in accordanee with the legally accepted standards, all ne�e.ssary wunmg and traffic cflntrol signs,
barriesdes, traffc cones, and flashing lighis to direct and cotth'ol tl't� movemGnt of traffic throua.�h tha
project in all directions and �t all times.
-•• The foregoing provisions shaii nAt in any way relieve the instailer or c�antractor of eny of his le$al
responsibifities or iiabiiities for the safety af the public.
4. Atl openings in bitu[ninous st�rfaces shali be cut in a straight lir►e with ssdes smooth and veri3cal. No ,
ra;ged edges wiil be permitted. Gut#ing sha11 be done with a concrete saw, cuttin� wheei, jack hammer,
�pades ar sitnilsr approved toots.
Backfi[1 inaterial shall be suitable for h�ghway embankment constructeon. No peat, fro2en Inmps, broken
asphalt, sod, raots, or other undesirable material shall be permitted as backfili. Rocks larger than eix inches
(6'� in diameter sha11 not be used in backfiliing af tirenches.
The backfill materia! shalt be placed in layers not to exceed one foot (1') and mechanically comp�tcted to
not less than 95 percent of modiFied Proc#or density.
The apper six inches (6") of tlte backfill shall meet Menne�ota I�ighway Department Specifseations for
Class 5 material and shall be compaCted to not iess than 95 peccent of modified Pmetor density.
As soon as passible after baelcfill operations are eompleted, the cut bituminaus edges of the trenGh shall be
painted with an asphalt emulsion such as 9S-i. Immediately thereafter, the patching materlat shall be
placed �nd meChanically catnpascted to not Iess than 95 percant of modiflod Proctor density. The asphaltic
matersal used in patching shalf be of the same type as removed from the roadway, exc�pt, that in nQ �as�.

S. �ermittee shall sa�ve the City harmless from all third party claiins for injury or damage which may occur '
between the time tite worlc eommencas and tbe time it is fmally accepted by the Gtity.
9. The permittee may be requind to jack or bore under certain streets, as dettrmmed by the City �ngineer.
10. The applicaat shall furnish evidenee of public liability in�nrance of not less thaa 5100,000/300,000 and
property dama,ge of ttot less than $2S,U00 issued by tm insuranca wmpany authori�cd to do bus9aess in tbo
� State of Minnesota on which the Cety ia namad as an additional 'maured party.
11. Baccept for the nagligent acts of the City, its ageau and its employees, the permitteo shall assume all
liability for, and save the City, ita agents and its employees, harntless and dofer�d same at its sola cosE anQ
expense from any and all elaims for damages, actions vr causes of action arismg out of th� wortc to be done
••� h�rei� and the continuing uses by the permittee, includieg bvt not limited to the placinQ, constructing, and �
recorsstructing, mafntair�ing, protecting and us� of said facifity under this application and permit for
� coitstrtictton.
12. Existir►g Facilitias � The trt'slity facility snd instaliations shalI not interfere with aay exesting tttllity faoility
on tha City's right-�f-way or easements. It is tho r�esponsibility Qf the appticnret to catl for necessary
