The indi�ridual obtaining the permft shall, before commencing such work, notiy the City Engineer when the work at each location is to commence; and, when requested by the Engineer, shall submit plans and speciflcations. 2. The public is to be pro�ected by the individual, at all times, from the commencement of the work until the com�etion and acceptance by the City. The installer or coMractor shall so conduct his operations as to cause the minimum incomrenience to the public. The instailer or contractor shall fumish, ere+ct, and maintain, in accordance with the legaliy acxepted standards, all necessary waming and traffic control signs, barricades, traffic cones, and flashing lights to direct and control the movemerrt of traffic through the projed in ail direc�ions and at ail times. The foregoing provlsions shali not in any Vvay relieve the lns�aller or corrtraaor of any of his legal responsibil�ies or liabil�ies for the safety of the public. 4. All openings in bituminous surtaces shall be cut in a straight line with sides smooth and vertical. No ragged �ges will !� permitted. Cutting shall be done with a concrete saw, cutting wheel, jack hammer, spades or similar approved tools. Badcffli materfal shall be suitable for highway embankment construction. No peat, frozen lumps, �+oken asphalt, sod, roots, or other undesfrable mate�ial shall be permitt�i as backfili. Rocks larger than six inches (6'� in diameter shall not be used in backfllling of trenches. The backflll materlal shall be placed in layers not to exoeed one foot (1 � and mechanicaliy canpacted to not less than 95 percent of modi�ed Prodor density. The upper six inches (6'� of the bacicflll shall meet Minnesota Highway DepartmeM Specifications for Class 5 material and shali be c�mpaded to not less than 95 pe►+cerrt of modifled Proctor density. As soon as possible after backflll operations are completed, the cut bituminous edges of the trench shall be pafMed with an asphatt emulsion such as SS-1. Immediately thereafter, the patching mate�ial shall be placed and mechanlcally compacted to not less than 95 percent of modified Prodor densiry. The asphaltic material used in patching shall be of the same type as removed from the roadway, except, that in no case, will a plarrt mixed asphalt of less quality than RAinnesota Highway Department Specifications 2331 be used. The flnish� surface of the patch shall conforrn to the surtace of the undisturbed roadway. No permanent asphalt patches shall be on any base whose temperature is 32 degrees Fahrenhen or less. Cold weather patching shall be of tem�rary nature, using cold mixed asphalt, well graded crushed rock or similar approved materi�ls. Temporary patches shall be tnae to line and grade. Temporary patches shall be replaced by permanent patches when weather conditions permit and notiflcation shall be required as stated in 2. 5. Other areas may be requir�i to be c�mpaded at the diredion of the City Engfneer. 6. Such permittee to be responslble for maintenance and repair of all trenches for a period of one (1) year and if settlement occurs or excavation caves in, the same shall be promptly indicated by adequate waming signs H:\L)titity Pemrils�Ciry of Prior LaloelNatl�waod Rd,doc and shall be restored to proper condition in 8ccordance with specifications above provided as soon as ' conditions permit. 7. All culverts and ditches shaii be replaced in their original position and condition existing p�ior to construction and no change shall be made in drainage without approval of the City Englneer. 8. Permittee shail save the City harmless from all third party daims for injury or damage which may occur between the time the work commences and the time it is finally accepted by the City. 9. The permittee may be required to jack or bore under certain streets, as determined by the City Engineer. 10. The applicant shali fumish evidence of pubiic liability insurance of not less than $100,000/300,000 and property damage of not less than $25,000 issued by an insurance c�mRany authorized to do business in the State of Minnesota on which the City is named as an add�ional insured pa�ty. 11. Except for the n�ligeM acc;ts of the City, its ageMs and its employees, the permittee shall assume all liability for, and save the City, its agerrts and Its employees, harmless and defend same at its sole cost and expense from any and all daims for damages, actions or causes of adion arising out of the work to be done herein and the continuing uses by the pennittee, induding but not limited to the pladng, constructing, and reconstructing, mairrtaining, protecting and use of said facility under this application and permit for construdion. 12. Existing Faalities — The u�ility fadlity and ins�tailations shatl not interfere with any existing utilit�r fadlity on the City's right-of-way or easements. It is the responsibility of the applicarrt to call for necessary locations of existing utilities. (Gopher One) 13. Private Property — The woric permit or permit for construction as issued does not 1n any way imply that the appropriate easemeM exists to allow the applicarrt to work on private property. 14. Cutting Trees — The permission herein graMed does not cor�fer upon the permittee the right to cut, remove or destroy trees or shru�ery within the legal Iimlts of the right-of•way. Easements that are nvt speciflcally identifi� on the plan attached to this permit or relieve permittee from obtaininq any consent othervvise required from the owner of the property adjaaent thereto. 15. Clean-Up — Street, trailways �nd affected �igM-of-way shall be scraped Gean at the end of each work day and swept clean after construdion i� c�mpleted and left in a neat and preseMable condi�on. 16. Replacemerrt of Sod — Wherever top-soil and sod are disturbed, they shall be replaced in kind and maintained satisfador�ly until the turf is established.
