CONSIDER APPROVAL OF A RESOLUTION APPROVING THE
WETLAND REPLACEMENT PLAN FOR STERLING SOUTH
SECOND ADDITION, CITY PROJECT 03-43.
DISCUSSION:
History
On January 18, 1994, the City Council passed Resolution 94-01
adopting the permanent rules of the Wetland Conservation Act
(WCA) of 1991. Along with this, the Council also assumed the role
of local government unit (LGU) for making WCA determinations for
landowners. The purpose of WCA is as follows:
1. Achieve a no net loss in the quantity, quality, and biological
diversity of Minnesota's existing wetlands;
2. Increase the quantity, quality, and biological diversity of
Minnesota's wetlands by restoring or enhancing diminished
or drained wetlands;
3. Avoid direct or indirect impacts from activities that destroy or
diminish the quantity, quality, and biological diversity of
wetlands; and
4. Replace wetland values where avoidance of activity is not
feasible or prudent.
Current Circumstances
As part of the Sterling South Second Addition development plan,
the developer has requested approval of a wetland replacement
plan for the project. The reason a replacement plan is required is
that there is a small wetland area which bisects the site and is
generally in the center of the parcel that will be impacted due to
street construction. The proposed mitigation is for the construction
of the street crossing the wetland. Any means of further reducing
wetland impacts would require shortening or removing the proposed
cul-de-sac which would limit access to the south side of the site.
The final design calls for 14,508 square feet of existing wetland type
2/3/6 to be filled. Mitigation is proposed on-site through 14,799
square feet of New Wetland Credit (NWC) through the expansion of
the existing wetland, 15,589 square feet of Public Value Credit

(PVC) through the establishment of upland buffers, and 12,399
square feet of PVC for creation of a stormwater pond. No
excavation within the existing wetland is proposed. The proposal
meets the mitigation and sequencing criteria. No comments were
received during the comment period.

The memorandum outlines quantities of fill and mitigation credits.
Conclusion
Staff recommends that the Council approve the Wetland
Replacement Plan for Sterling South Second Addition.
ALTERNATIVES:
The alternatives are as follows:
1. Adopt the attached resolution that approves the Wetland
Replacement plan for Sterling South Second Addition (City
Project #03-43).
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item for specific reason.

FOR STERLING SOUTH SECOND ADDITION

MOTION:
SECONDED:
WHEREAS,
the developer has prepared plans that avoid unnecessary wetland filling on the
project to the greatest extent possible; and
WHEREAS,
sequencing criteria has been met; and
WHEREAS,
mitigation is proposed through the following combination: 14,799 square feet of
new wetland credit from an on-site restoration and 27,988 square feet of on-site
public value credit from the creation of wetland buffers and water quality basin.
WHEREAS,
the mitigation plan is in accordance with the Wetland Conservation Act and City
of Prior Lake ordinances.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that
1. The recitals set forth above are incorporated herein.
2. The Wetland Replacement Plan for Sterling South Second Addition is hereby
approved.

Attached, please find a completed Wetland Conservation Act (yICA) Notice of Decision, WCA Findings
and Conclusions, and a Wetland Replacement Application for the Sterling South 2nd Addition
development project. Shamrock Development proposes to fill 14,508 fe of a Type 2/3/6 wetland
complex associated with the construction of an access road from Oaks Lane. Mitigation is proposed on-
site through 14,799 fe of New Wetland Credit (NWC) through the expansion of the existing wetland,
15,589 fe of Public Value Credit (PVC) through the establishment of upland buffers, and 12,399 fe of
PVC for creation of a stormwater pond. No excavation within the existing wetland is proposed.
The application was sent out for agency notice and review on April 20, 2004. The comment period will
end May 14,2004. No comments have been received to date. If comments are received, they will be
forwarded to the City prior to the City Council meeting.
The replacement plan and application have been reviewed and found to be in conformance with the
WCA. It is recommended that the City Council approve the replacement plan based on the attached
Findings and Conclusions.
A decision on this application must be made before June 11, 2004. Once the city council makes the
determination on this application, please let us know and we will send out the final paper work to the
agenCIes.
