ADDRESSING OTHER ON- AND OFF- STREET PARKING ISSUES WITH RESPECT
TO CAPTAIN JACK'S.

In early 2004, the owners of Captain Jack's approached City staff about options to
provide additional parking for their patrons. The newly formed Traffic Safety
Committee (TSC) has researched this request. The TSC has thoroughly researched
the area (see attached report) and have met with two of the owners who provided
the TSC with a list of options they have researched (see attached report). The
purpose of this agenda item is to recommend to the Council various actions that
would provide on- and off-street parking together with other safety improvements in
the area.

On April 26th, the TSC met with Steve Sammis and Chris Rooney, owners of Captain
Jack's, to discuss the options they have researched for additional parking. The
attached report shows a number of options they have looked at, most are cost-
prohibitive from a business standpoint. Two viable options that were discussed are
to provide additional on street parking closer to the restaurant and provide a
temporary parking lot to the restaurant in the vacant lot across Green Heights Trail.
The lot would be surfaced class 5 (gravel), and would only be a seasonal use lot
from May 1 slOctober 15th. The TSC discussed these options and below are our
recommendations:
Off-Street Parking:
At the April 5th Council meeting, Resolution 04-62 was adopted which established
policies to help direct the TSC with traffic safety requests. The policy states the
primary objective is to obtain off street parking rather than on street parking if
reasonably possible.
To remain consistent with Resolution 04-62, the TSC has required the Captain
Jack's owners to provide the City with solutions for off street parking. The ownership
has researched several options to alleviate the parking issues. The most viable
option from the business standpoint is to create an off street parking lot on the
vacant lot across from the restaurant. The parking lot would be graded and a Class
5 surface would be installed.

The TSC has met with the planning department who has determined that a
conditional use permit is needed for this request. The staff believes the Zoning
Ordinance allows enough discretion, especially through the CUP process, to allow
the Class 5 surface on a temporary basis. A CUP application has been submitted by
the owners of Captain Jack's for the parking lot. City staff will follow the necessary
steps to complete the CUP. Staff intends to recommend that one condition should
require an agreement between the City and owners regarding the duration of the
CUP and "vested rights" (none) issues. During this process, the homeowners in the
immediate area will be notified of the plans and will have a chance to review the
changes to the off street parking as well as the on street parking changes (see
below). At that time the temporary on street parking changes will be re-evaluated.
On-Street Parking:
The TSC is working with Captain Jack's owners to provide on-street parking as well.
The TSC does realize there is a parking problem during the summer for the
restaurant. The TSC is recommending, on a temporary basis, to allow on-street
parking adjacent to the vacant lot across from Captain Jack's on both Green Heights
Trail and Dutch Avenue. This would result in city staff removing the existing IINo
Parking" signs. The changes in parking would minimize the impacts to the current
homeowners in the area, no changes are recommended in front of any homes.
These changes would be immediate.
To encourage greater safety in the area, the TSC recommends prohibiting parking
on one side of Dunkirk Avenue and Pershing Avenue where currently parking is
allowed on both sides of these streets. Pershing is 24 feet wide and Dunkirk is 22
feet wide. The TSC recommends completing these changes following the CUP
process so the current homeowners have a chance to respond to these impacts.
ISSUES:
In most cases, the City Code requires a paved parking lot. However, the Code does
allow concrete, blacktop or equivalent materials as approved y the Planning Department.
The Code also provides added flexibility for less than full-time lots.
In this case, the proposed off-street lot would not be used during the winter months
(October 16th to April 30th) since there is no demand for parking at that time of year.
Similarly, the on-street parking on Green Heights and Dutch would be limited to May 1st
through October 15th. This will avoid conflicts with City snow and ice control operations.
The addition or removal of "No Parking" signs is typically accomplished through petition
of affected residents. In this case, no petition has been submitted. To facilitate resident
input, the parking changes on Pershing and Dunkirk would not be made before the public
hearing process for the off-street parking conditional use permit is considered. Residents
of the area will receive appropriate notification of both the CUP process and the possible
"No Parking" sign removal in order that they can submit their input before any changes
are made. Since no one is impacted by the Green Heights and Dutch parking change,
those steps can take place upon adoption of the attached resolution.

customers; and
WHEREAS,
Staff will remove the existing "No Parking" signs along the vacant lot on Green
Heights Trail (75ft West of Dutch Avenue) and Dutch Avenue (75ft South of Green
Heights Trail) pending a CUP application has been filed by the Captain Jack
ownership; and
WHEREAS,
The homeowners in the area of Captain Jack's will have an opportunity to review
proposed on-street parking changes on Pershing and Dunkirk through the CUP
process.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that:
1. The recitals set forth above are incorporated herein.
2. City staff is directed to remove the existing "No Parking" signs adjacent to the vacant lot on Green
Heights Trail and Dutch Avenue.
3. Using the Conditional Use Permit process to consider the off-street parking and on-street parking
removal on one side of Pershing and Dunkirk is hereby approved.

The owners of Captain Jack's restaurant have asked about the possibility of
using Class 5 material to surface a seasonal, off-site parking area.
The City Council recently adopted Ordinance #04-13, allowing free-standing
accessory parking lots in R-Use districts, subject to certain conditions and
approval of a conditional use permit. One of the conditions requires the
parking lot to meet the requirements of Section 1107.204.
Section 1107.204 (5) lists the requirements for surfacing. This section
states:
All driveways and all of the area intended to be utilized for parking shall be surfaced
with a minimum of 1 1/2" of bituminous paving on a suitable base, or 6 inches of
non-reinforced concrete or equivalent material approved by the City. Decorative
concrete interlocking pavers may also be used in parking lots.
In areas where parking spaces are used on an average of two or fewer days per
week, grass road pavers, Ritter rings or other such pavers may be used which
permit the growth of ground covers and the infiltration of surface water. Such
pervious paving material shall be approved by the City Engineer.
In my opinion, this section gives the City the discretion to determine what the
surface material can be. As part of the Conditional Use Permit, the City can
place conditions on the use, including limiting the use of the site to certain
times of the year, and surface materials. I feel comfortable with this
interpretation due to the fact that this decision is made by the Planning
Commission with public input.

Investigation of Request:
To change the parking regulations to permit parking on the south side of Green
Heights Trail, west side of Dutch Avenue, north side of Pershing and no parking
on Dunkirk.
February 25, 2004

Introduction:
The request was submitted by Steve Sammis, part of the Captain Jack's ownership group.
The request is to allow additional parking for Captain Jack's patrons.
The information contained in this report was gathered from site investigations, standard
engineering practices, planning department and police and fire regulations.
Existing Conditions:
Captain Jack's is located at 3950 Green Heights Trail SW in Prior Lake. The restaurant
has spaces for a total of 65 parking stalls, which includes one handicap space, one VIP
space and parking for the dock owners. The planning requirement for commercial zoning
parking lots is one space for every 50 square feet of building. Captain Jack's has a total
of 4024 square feet according to City records, which would equate to 80.5 spaces. The
number of parking stalls at Captain Jack's does not conform to the current requirements.
Site Investigation:
During the site investigation, "No Parking" signs were found on both sides of Green
Heights Trail, from Park Avenue continuing west to Dunkirk Avenue. Green Heights
Trail from Dunkirk to the west end is signed "No Parking by Order of Fire Chief' posted
on the Dead End sign. Dutch Avenue has "No Parking" signs on both sides from Green
Heights Trail to Roanoke Street, and Park Avenue has ''No Parking" signs on both sides
from Green Heights Trail to Cates Street. The rest of the neighborhood streets currently
have no signage. See attached map.
Additionally, street widths were collected during the site investigation. Green Heights
Trail (from Dunkirk Avenue to Park Avenue), Park Avenue, Dutch Avenue, and Pershing
Street (from Dunkirk Avenue to Dutch Avenue) are 24 feet wide (face to face). Dunkirk
Avenue, Spring Avenue and Roanoke Street are all 22 feet wide (face to face). Green
Heights Trail (west of Dunkirk Avenue) and Roosevelt Street (which is a private street)
are both 12 feet wide (no curb). Cates Street is 30 feet wide (no curb). There are no
sidewalks or trails along these neighborhood streets.

Standard Engineering Practices:
The typical street width is 28-32 feet for residential roads within Prior Lake. In
accordance with the subdivision ordinance, new roads are required to be 32 feet in width,
with parking allowed on both sides. 28 foot wide streets are allowed, but only with
parking along one side of the street.
Police and Fire Regulations:
The Police department requested that one side of the street remain no parking. This is
needed to provide access and enough turning radius for emergency vehicles servicing the
area. The Fire department typically requires a 20 foot driving lane for their equipment.
A parking lane is approximately 6 feet wide. On a 24 foot wide street with parking on
one side, an 18 foot driving lane would result. While not the typical 20 feet desired, the
fire department would allow parking on one side of a 24 foot wide road. However, the 24
foot wide street is the absolute minimum, the fire department does not find the 22 foot
wide street adequate for their equipment and one parking lane.
Public Works Maintenance Issues:
The Streets and Utilities Supervisor is concerned snow removal with vehicles parking
along the neighborhood streets in a snowfall event. Therefore, the vehicles parked along
these streets would have to follow the City Code 901.207 Winter Parking Restrictions.
This includes no Vehicles on any Street within the City between the hours of two o'clock
(2:00) A.M. and six o'clock (6:00) A.M. from November 1 until March 31 of the
following year. At all other times of the year it is unlawful for any Vehicle to stand on
any public Street within the City between the hours of two o'clock (2:00) A.M. and six 0'
clock (6:00) A.M. after a continuous or intermittent snowfall during which there has been
an accumulation of two inches (2") or more of snow on any Street, and until the snow has
been plowed or removed to the full width of the Street. Any Vehicle parked in violation
of this subsection may be towed pursuant to Minnesota Statutes section 169.041.
Conclusion:
Based on the information gathered for this report, staff recommends to not allow parking
along either side of the street in the neighborhood near Captain Jack's that are not at least
28 feet in width. The No Parking signs already in place on Green Heights Trail, Roanoke
Street, Dutch Avenue and Park Avenue are recommended to stay for the reasons
mentioned in the above report.
