Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: MAY 17,2004 10C DONALD RYE, COMMUNITY DEVELOPMENT DIRECTOR AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE PAYMENT OF FAC;ADE IMPROVEMENT FUNDS TO LANFORD ADLER dba EXTRA INNINGS DISCUSSION: Historv In 2002, the City Council authorized the use of up to $150,000 from Downtown TIF Account funds to fund a fa9ade improvement program for the area covered by the Downtown zoning district. An additional $100,000 was authorized in 2003. Since then, staff has worked with several Downtown businesses to implement the fa~ade improvement program. The use of these funds has already been approved for several Downtown businesses ( Little Lakers Montessori, Speiker building, The Hair Mate/Kapaun Realty buildings, Fongs, Viking Liquor and Ace Hardware). The amounts dedicated to each project total $152,065. This leaves a balance of $97,935 that is available for fa~ade improvements. If this request for $16,500 is approved, the balance available will be reduced to $81,435. Current Circumstances Lanford Adler dba Extra Innings has submitted an application for assistance from the fa~ade improvement program. The estimated total cost of the project is $32,940. Program guidelines call for reimbursement of half the cost of the improvement up to a maximum of $25,000. In this case, half the project cost is $16,470 so the maximum reimbursement would be $16,500. Staff has reviewed the plans for the project and has determined the proposed improvements will meet the design criteria contained in the Downtown zoning district and are therefore eligible for fa~ade improvement funds. The project includes removal of the existing building facade of the building and replacement with brick and a small standing seam metal trim band along the top of the building. The brick will be a dark reddish brown similar to the Library. The 2020 Vision and Strategic Plan contains a Vision Element called Downtown Redevelopment. The second item in this element is "Implement partnering program with Downtown businesses to facilitate building fa~ade improvements." One is to "Identify businesses for fa9ade improvement" and the other is to "Work with identified businesses to complete fa~ade improvements." Clearly, the requested action in this case is directly related to, and in support of, these elements. Issues The primary issue here is whether the City Council wishes to provide the requested assistance. As noted above, the project is consistent with the 2020 Vision and Strategic Plan and complies with design guidelines for the Downtown. Staff is also of the opinion that some kind of time limit should be imposed on this and any other future projects, beyond which the right to receive reimbursement would be forfeited. Staff has another application pending and inquiries from two other Downtown businesses about participation in the program so we believe the construction process should be expedited. Conclusion Staff has concluded the project for which assistance has been requested meets the applicable criteria and recommends approval of the requested funding. The City Council has the following alternatives: 1. Approve the funding assistance as requested. 2. Approve a level of funding assistance different than the level requested. 3. Deny the request for funding assistance. 4. Continue this case to a date certain. Prior Lake, MN 55372-1714 RESOLUTION 04-XX RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING FAC;ADE IMPROVEMENT FUNDS FOR LANFORD ADLER MOTION BY: SECOND BY: WHEREAS: On June 1 i\ 2002, the City Council adopted resolution 02-99 establishing a matching grant program to encourage Downtown building fa~ade improvements and providing funds for the program, and WHEREAS: The City Council has determined there is a need for a program of incentives to encourage businesses in the Downtown area of the City to renovate building facades, and WHEREAS: The City Council has determined such a program is in the public interest and serves a public purpose by encouraging the revitalization of the Down town commercial area, and WHEREAS: The City Council has adopted design guidelines for Downtown development in the City's zoning ordinance, and WHEREAS: Projects to be funded with the grant funds must be consistent with the design guidelines, and WHEREAS: Lanford Adler has applied for a grant not to exceed $16,500 and has submitted plans to the City for the improvements, and WHEREAS: The City has reviewed the plans for the improvement and has found them to be in compliance with the design guidelines in the City's zoning ordinance and consistent with, and supportive of the applicable sections of the City's 2020 Vision and Strategic Plan, and WHEREAS: There are adequate funds available to fund the application. THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, I. The recitals set forth above are incorporated herein. 2. The grant amount of up to $16,500 for Lanford Adler is hereby approved for the properties at 16299 Main Avenue SEe 3. The grant amount is to be paid in an amount up to 50% of demonstrated costs related directly to fayade construction. The City shall reimburse the applicant for actual costs incurred as demonstrated by paid invoices, cancelled checks, lien wavers or such other evidence of payment of eligible costs as the City in its sole discretion may require. 4. In the event the work covered by this resolution is not completed by August 17, 2004, the City shall no longer be obligated to reimburse costs incurred after that date. Contractor will complete the following tasks: 1. Demolition of existing brick front area for new brick replacement. 2. Installation of above referenced area in new substrate, brick and mortar as per discussion. 3. Installation of standing seam roof along top building above new brick wall covering. 4. Installation of structural support system for building signage. 5. Reconfigure and replace front facade area of side entrance roof to match new building roofline. 6. Removal of current siding and reinstallation of cedar shake or similar siding in entry and along side entrance wall areas. 7. Removal of top course of side brick and replacement with maintenance free steel cap on north, east and south sides of building. 8.
