Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: JUNE 7, 2004 lOA DONALD RYE, PLANNING DIRECTOR AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE PAYMENT OF FAc;ADE IMPROVEMENT FUNDS TO O'MALLEY'S ON MAIN, INC. DISCUSSION: History In 2002, the City Council authorized the use of up to $150,000 from Downtown TIP Account funds to fund a fayade improvement program for the area covered by the Downtown zoning district. An additional $100,000 was authorized in 2003. Since then, staff has worked with several Downtown businesses to implement the fayade improvement program. The use of these funds has already been approved for several Downtown businesses (Little Lakers Montessori, Speiker building, The Hair Mate/Kapaun Realty buildings, Fongs, Viking Liquor, Ace Hardware and Extra Innings). The amounts dedicated to each project total $170,086. This leaves a balance of $79,914 that is available for fayade improvements. If this request for $25,000 is approved, the balance available will be reduced to $54,914. Current Circumstances Shelby Armit on behalf of O'Malley's on Main has submitted an application for assistance from the fayade improvement program. The estimated total cost of the project is $67,760. Program guidelines call for reimbursement of half the cost of the improvement up to a maximum of $25,000. In this case, half the project cost is $33,880 so the maximum reimbursement would be $25,000. Staff has reviewed the plans for the project and has determined the proposed improvements will meet the design criteria contained in the Downtown zoning district and are therefore eligible for fayade improvement funds. The project includes removal of the existing building facade of the building and replacement with cultured field stone below the windows and board and battens above the window. The original twin gable roofline will also be restored. New signage and lighting will also be provided. The 2020 Vision and Strategic Plan contains a Vision Element called Downtown Redevelopment. The second item in this element is L: \Community Dev\downtown facade\omalleyscc report\.i\ww. ci~ofpriorlake. com Phone 952.447.4230 / Fax 952.447.4245 ALTERNATIVES: RECOMMENDED MOTION: REVIEWED BY: "Implement partnering program with Downtown businesses to facilitate building fayade improvements." The Tactical Action Plan for 2004 to 2008 has two components directly related to this element. One is to "Identify businesses for fa~ade improvement" and the other is to "Work with identified businesses to complete fa~ade improvements." Clearly, the requested action in this case is directly related to, and in support of, these elements. Issues The primary issue here is whether the City Council wishes to provide the requested assistance. As noted above, the project is consistent with the 2020 Vision and Strategic Plan and complies with design guidelines for the Downtown. Staff would recommend that, where the plans call for either wood or Hardie-Board, the Hardie Board should be required as it is a more durable product. The Council recently approved an amendment to the zoning ordinance that permits materials such as Hardie-Board to be classified as Class lA materials and to be used in conjunction with Class I materials. In this case, Class I materials will comprise 57% of the building face with the remainder Hardie-Board. These percentages are in compliance with the new amendment. Staff is also of the opinion that some kind of time limit should be imposed on this and any other future projects, beyond which the right to receive reimbursement would be forfeited. Staff has another application pending and inquiries from two other Downtown businesses about participation in the program so we believe the construction process should be expedited. Conclusion Staff has concluded the project for which assistance has been requested meets the applicable criteria and recommends approval of the requested funding. The City Council has the following alternatives: 1. Approve the funding assistance as requested. 2. Approve a level of funding assistance different than the level requested. 3. Deny the request for funding assistance. 4. Continue this case to a date certain. Motion to approve attached resolution authorizing payment of fayade improvement funds to 'Malley's on Main, Inc. Prior Lake, MN 55372-1714 RESOLUTION 04-XX RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING FAc;ADE IMPROVEMENT FUNDS FOR O'MALLEY'S ON MAIN, INC. MOTION BY: SECOND BY: WHEREAS: On June 1 t\ 2002, the City Council adopted resolution 02-99 establishing a matching grant program to encourage Downtown building fayade improvements and providing funds for the program, and WHEREAS:The City Council has determined there is a need for a program of incentives to encourage businesses in the Downtown area of the City to renovate building facades, and WHEREAS: The City Council has determined such a program is in the public interest and serves a public purpose by encouraging the revitalization of the Down town commercial area, and WHEREAS: The City Council has adopted design guidelines for Downtown development in the City's zoning ordinance, and WHEREAS:Projects to be funded with the grant funds must be consistent with the design guidelines, and WHEREAS: O'Malley's on Main, Inc has applied for a grant not to exceed $25,000 and has submitted plans to the City for the improvements, and WHEREAS: The City has reviewed the plans for the improvement and has found them to be in compliance with the design guidelines in the City's zoning ordinance and consistent with, and supportive of the applicable sections of the City's 2020 Vision and Strategic Plan, and WHEREAS:There are adequate funds available to fund the application. THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, 1. The recitals set forth above are incorporated herein. 2. The grant amount of up to $25,000 for O,Malley's on Main, Inc. is hereby approved for the properties at 16211 Main Avenue SEe 3. The grant amount is to be paid in an amount up to 50% of demonstrated costs related directly to fayade construction. In any case, the amount paid to the L:\Community Dev\downtown facade\o~Q:~lnrlo~com Phone 952.447.4230 / Fax 952.447.4245 applicant shall not exceed the amount listed in 2 above. The City shall reimburse the applicant for actual costs incurred as demonstrated by paid invoices, cancelled checks, lien wavers or such other evidence of payment of eligible costs as the City in its sole discretion may require. 4. In all cases on the approved plans where wood is specified, Hardie-Board shall be used in its' place. 5. In the event the work covered by this resolution is not completed by September 1, 2004, the City shall no longer be obligated to reimburse costs incurred after that date.
