Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: ISSUES: CONCLUSION: FISCAL IMPACT: JUNE 21, 2004 5J JANE KANSIER, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION AMENDING THE LEGAL DESCRIPTIONS FOR THE ORDERLY ANNEXATION AGREEMENT BETWEEN THE CITY OF PRIOR LAKE AND SPRING LAKE TOWNSHIP Historv: In October, 2003, the State of Minnesota approved an Orderly Annexation Agreement (OAA) between the City of Prior Lake and Spring Lake Township. The OAA established a schedule for annexation of approximately 3,000 total acres of land located in Sections 4, 10, 11 and 12, Spring Lake Township. When the County Auditor's office reviewed the resolution for the annexation of the second phase of the OAA (2004 area), it was discovered that there were some inadvertent errors in the way the legal description was written. In other words, the legal descriptions do not match the OAA map. In order to correct this situation, the City and the Township must adopt a joint resolution amending the legal descriptions. The purpose of this resolution is to correct the legal descriptions for the Orderly Annexation Agreement. The change in the descriptions does not add any land to the Orderly Annexation Area, nor does it change the intent or substance of the agreement. Rather, it corrects the original description to include the areas identified on the Orderly Annexation Map. The Spring Lake Township Board of Supervisors considered this joint resolution at their meeting on June 10, 2004. The Board unanimously approved the change. Approval of the resolution is consistent with the Orderly Annexation Agreement. Development of the property should occur within the City limits, once sewer and water service are available to serve this site. I! -~......., JOINT RESOLUTION CITY OF PRIOR LAKE AND SPRING LAKE TOWNSHIP A RESOLUTION AMENDING THE LEGAL DESCRIPTIONS FOR THE ORDERLY ANNEXATION AGREEMENT BETWEEN SPRING LAKE TOWNSHIP AND THE CITY OF PRIOR LAKE (DOCKET #OA-967) CITY OF PRIOR LAKE RESOLUTION NO. WHEREAS: The City of Prior Lake and the Town of Spring Lake have entered into an orderly annexation agreement identified as MBA Docket No. OA-967; and WHEREAS: Said orderly annexation agreement designated the land legally described in the original Exhibit 3 and provides for annexation of said land; and WHEREAS: The City of Prior Lake and the Town of Spring Lake have agreed the original Exhibit 3 contains inadvertent errors in the legal descriptions of the areas to be annexed; and WHEREAS: The City of Prior Lake and the Town of Spring Lake have agreed the land legally described in the Revised Exhibit 3 attached to this resolution correctly describes the area included within the orderly annexation agreement; and WHEREAS: The City of Prior Lake and the Town of Spring Lake hereby agree the original Exhibit 3 attached to the orderly annexation agreement will be replaced with Revised Exhibit 3 as attached. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE THAT: 1. The recitals set forth above are incorporated herein. 2. The City of Prior Lake approves the replacement of the original Exhibit 3 of the orderly annexation agreement with the attached Revised Exhibit 3. 3. The staff is hereby directed to forward this resolution to Minnesota Municipal Boundary Adjustment for review and comment.
