CONSIDER APPROVAL OF A RESOLUTION TO APPROVE THE
VULNERABILITY ASSESSMENT REPORT FOR THE CITY'S
WATER SYSTEM
DISCUSSION:
On June 12,2002 President George W. Bush signed into law the "Public
Health Security and Bioterrorism Preparedness and Response Act 2002."
This Act contains amendments to the "Safe Drinking Water Act." These
amendments require each community water system serving populations
greater than 3,300 persons to conduct an assessment of the vulnerability of its
system to a terrorist attack or other intentional acts intended to substantially
disrupt the ability of the system to provide a safe and reliable supply of
drinking water.
The purpose of a Vulnerability Assessment (V A) is to help water system
administrator to evaluate susceptibility to potential threats and identify
corrective actions that can reduce or mitigate the risk of serious
consequences. The assessment considers risks posed from adversarial actions
(i.e. vandalism, terrorist attacks) to the surrounding community on the water
system. An effective vulnerability assessment serves as a guide to the water
utility by providing a prioritized plan for security upgrades, modifications of
operational procedures and policy changes to mitigate the risks and
vulnerabilities to the utility's critical assets. The completion date of the
vulnerability assessment for our community, serving a population greater than
3,300 but less than 50,000 is June 30, 2004.
ISSUES:
In response to the 2002 Bioterrorism Preparedness Act, staff has created a
Vulnerability Assessment Team (VAT) comprised of the Public Works
Director, Public Works Coordinator and the Streets and Utilities Supervisor.
We used a software called VSA T that has been distributed free of charge to
small and medium cities to help them complete their vulnerability assessment
without the help of a consultant and the resulting fees. The VAT identified
the major assets of the city and the corresponding threats to those assets. To
avoid compromising the confidentiality of the assessment, the potential
threats to the system and detailed information is not included in this agenda
report. Staff will distribute the detailed report to the City Council for their
reVIew.

To complete the vulnerability assessment, we needed to determine and
prioritize possible improvements to our water system. The VAT has
prioritized the potential improvements for the City of Prior Lake that will be
identified in the Capital Improvement Program. These improvements will
need to be identified in the CIP and included in the upcoming years. It is
important to add these improvements to the CIP to reduce the vulnerability of
the water system we have identified through this process.
The final step to complete this process is to create an Emergency Response
Plan (ERP) within six months of the completion of the Vulnerability
Assessment Plan. The ERP will include system specific information, contact
information, communication procedures and emergency response protocol.
The VAT will begin completion of the ERP once the vulnerability assessment
has been approved by the City Council and submitted to US Environmental
Protection Agency.
FISCAL IMPACT: No fiscal impact in approving this resolution. There will be future funding
needs if proposed improvements are implemented.
AL TERNATIVES:
The alternatives for the City Council to consider are as follows:
1. Approve a resolution approving the vulnerability assessment report
for the City's water system.
2. Table this agenda item for a specific reason.
3. Deny this agenda item and provide staff with direction.
RECOMMENDED
MOTION:
Staff recommends adoption of Alternative No.1.
ACTION REQUIRED: A motion and a second to adopt the Resolution stated above.

WHEREAS,
The "Public Health Security and Bioterrorism Preparedness and Response Act
2002" was signed into law on June 12, 2002 by President George W. Bush,
requiring communities over 3,300 population to complete a vulnerability
assessment of their water system, and;
WHEREAS,
The vulnerability assessment needs to be completed and submitted by June 30th,
2004, and;
WHEREAS,
Staff has prioritized the potential improvements for the City of Prior Lake that
will programmed in the Capital Improvement Program.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA that:
1. The recitals set forth above are incorporated herein.
2. The City Council approves the vulnerability assessment report for the City's water
system.
