MINUTES of the Proceedings of the Village Council of the Village of Prior lake in the County - of Scott and Sta of
Minnesota, including all accounts audited by said Council.
November 4. 1974
The Common Council of the City; of Prior Lake met in re
P.M. November l y gulag- session at 7:30.
4, 974 in the City Council Chambers.
Mayor Stock called the`
meeting to order. Present were Mayor Stock, Councilmen Busse, bakes, Watkins,
Williams, Administrator McGiLire,
Engineer Israelson and Attorney. Sullivan.
The first item on the agenda was the Continuation of Public Hearing ..
vacating and `relocating a portion of Martinson
Island Street right -of -wady. `
Mr. Bill Schmokel explained property to be vacated. Mayor Stock asked if
there were any objections.
Mr. Walt Jefferson, Maple Park, objected to
vacating. Motion was made by Busse to approve of vacating that

property known as Martinson Island Road. .Seconded by Williams and:upon a `
vote taken it was duly passed.`
Mr. Stevens, Breezy Point Road, was spokesman in regard to condition of Road.

Councilman Oakes stated Guidelines for Contractors involving sewer and water,
hookups :'
1. Twenty- -four (24) hours notice shall be given City before any
connection is made by contractor to Public improvement to= house..
2. Any contractor or individual that has - difficulty�:ocating„ the sewer
or wager connection at the
street shall immedistely- contact the
City. If the contractor digs in the street without author izato n
and submits a b ill
to the City, it will be denied, and to show
cause.

Mr. Robel was pxesent in regard to road situation'in his area and asking for
t a catch basin inn front of his property. Councilman Oakes stated that (1)
low point be s a road and be two feet lower than driveway, that a crown
be established and exit be provided that -any car can have
access and egress,
(2) from crown of hill that one -half of road ap on lakeside down to
driveway is designed for 6/10" of rainfall, (3)tthe cost of a catch basin
would be approximately $500 and (4) temporary diversion be made
a

Mr. Robel's driveway. Councilman Oakes recommended that the Council accept
City Engineer's version of storm sewer, and if Engineer is in error Council
should consider the possibility. Motion was made by Oakes that reasonable
access and egress for cars be ,provided into the Robel driveway and that
temporary measures, to divert the water across the Robel driveway be done
this fall to be completed finally with the final completion of this 'project.
Seconded by Watkins
and upon a vote taken it was duly passed.
Police Chief Powell was present in regard to squad car bid. Police Chief =
Powell recommended the Dodge Coronet on the basis of (1) service for car
is close, (2) parts available for police cars' and (3) heavy duty alternator,

fast idle and brake light cutoff switch. Motion was made by Williams to
a
purchase Dodge Coronet from South Side Dodge, at a cost of $4300.00, on
the basis of Powell•s recommendations. Seconded by Watkins and upon a vote

Motion was made by Oakes authorizing' the Planning Commission to retain
Charles Tooker to review'the Zoning :Ordinance, seconded by Williams and
upon a vote taken it was duly ;passed.

Attorney Sullivan stated in regard to Ordinance 74 -14 Hardship Cases,

that the Council will have to define hardship with each case.
,
Notion was made by Oakes that any builder, building a residential unit
or units, that is to be offered for sale without a designated purchaser,
upon application to the City for each unit may receive consideration for
deferment of sewer and water availability fees until the date on which"
the City Administrator receives a request to turn on the water to that
' bui.lding for use, and that this period of extension not to exceed six
months, and that this Motion be an addition to Ordinance =74- 14. Seconded
by Watkins and upon a vote taken it was duly passed.
Engineer Israelson' reviewed sewer and water projects.
Engineer Israelso& is to contact Minnesota Valley Surfacing fors
reasonable completion date and the Council to deal with this in regard
to liquated damages.
The`Engineer `e plained the hfth Avenue Storm Sewer Project. The Mayor
a instructed the Engineer to proceed with communications with the State

Motion -made by Watkins:, seconded by Busse to adopt the following

Candy Paving Feasibility Study was tabled until next meeting.
Next years Sewer and Water PL 75-2 Boudins and Sunfish Flay Area
Sewer and Water in "75" were tabled until °next meeting.
Councilman Oakes recommended that Engineer Israelson bring a written
;r report; of his opinion on each and every change order and a concise
`instances
summary of of Contractors' failure to meet specifications,
to the Council.
Motion was made by Watkins to authorize the Mayor and Administrator
to sign N:stropolitan Sewer Board mmement through Maves'Property
Seconded by and upon a vote taken it was duly passed.
Motion was made by Watkins to adjourn,,seconded by Williams and upon
